Kin/ps'i, The houses north'of Lot 9 and Lot 10 are all affected by the floating docks constructed on Perry's Pond in Beixedon Estates. The passage which entitles property owners access to the bay is reduced to 17% and is not acceptable to t~e property owners north of the floating docks. The law has upheld, on a number o~ occasions, the riqkts of an. owner of' a water~ront property to build a dock to naviqab!e water. The structure as built is very near'the minimum possible to allow the o~mer his basic rights.. The chan~ei is man made and resides o~ private property and thus is not maintained by either the Town of Southoid or the Coku~t~ of Suffolk.. Maybe this is an opportunity to investigate limiting the size of vessels on your private waterway as a method, t° Prevent this problem from escalatinq with the addition of further docks or larger boats in. your area. Planning for the ~ut~re could help all the residents involved in this prQblem. We would be quite willing to meet with any of the residents to discuss your idea of controlling the size of boats in your' pond. Sincerely, Albert J.
