SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not referred as required to the Suffolk County Planning Department under Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested'in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a 18,858.90 sq. ft. parcel located in R-40 Zoning District. The parcel measures 210.00 feet fronting Bow Road, along the northerly property line, measures 87.746 feet fronting Tepee Trail, along the westerly property line, measures 69.04 feet fronting Arrow Lane, along the easterly property line, and 232.22 feet along the southerly property line. The property is improved with a two story frame home with an attached garage as shown on a survey prepared by Paul Barylski, Land Surveying, dated September 23, 2016. BASIS OF APPLICATION: Request for Variance(s) Article III, Section 280-124 and the Building Inspector's October 31,2016 Notice of Disapproval based upon an application for a permit to construct additions and alterations to an existing single family dwelling and new garage, at: 1) less than the code required minimum front yard setback of 35 feet, 2) less than the code required minimum rear yard setback of 35 feet, 3) accessory garage located in other than the code required rear yard, located at: 125 Bow Road, Southold,NY, SCTM# 1000-87-2-23. RELIEF REQUESTED: The applicant requests variances on this non-conforming 18,858.9 sq. ft. parcel, fronting three town roads and having three front yards, for a second floor addition,requiring relief of 34.8 feet front yard setback where 35 feet is required and 22 feet rear yard setback where 35 feet is required. In addition, relief is required for a proposed detached accessory garage to be located in the front yard instead of the required rear yard. Page 2, March 16, 2017 #7027, Murname SUM No. 1000-87-2-33 ADDITIONAL INFORMATION: The appeal involves a non-conforming 18,858.9 square feet parcel in R-40 Zoning District. The surrounding community consists of many non-conforming improved parcels of similar size. The agent for the applicant provided the Board with ZBA prior determinations for six (6) similar setback variances granted by this Board; one of which relates to an accessory garage. In addition, included with the six determinations is one variance for a property that has three front yards, which is similar to the applicants' property. The agent agreed to provide this Board with the corrected site plan showing the rear yard setback of 22 feet(shows 26.1 feet in error). During the public hearing, the applicants' agent testified that the second story of the proposed accessory garage will be used solely for storage. When asked about the dimensions of the proposed garage dormers, it was affirmed that the proposed dormers conform to the Town Code requirements. One neighbor submitted a written objection regarding the proposed detached accessory garage structure in the front yard, because the Nunnakoma Waters Homeowners Association covenants and restrictions states "No structure shall be permitted on the premises other than a single family residential dwelling with one private garage," and an attached garage already exists. Additionally,the proposed two story accessory garage is "out of character with the scale of the adjacent one story residences."However,the Board notes that the existing attached garage is proposed to be converted to habitable space. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on 3March 2, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances requested will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The subject property is close to the northern end of the subdivision. The lot is long and narrow fronting on three roads. The proposed second story addition over an existing one story attached garage, which is proposed to become habitable space on both floors, will not change the existing footprint of the subject dwelling. Based upon personal inspection of the subject neighbor by the Board members, accessory garages do not appear to be characteristic of this neighborhood 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant to construct the accessory garage cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. There is insufficient area in the conforming rear yard to construct an accessory garage, and an attached screened porch exists on the easterly side of the as built dwelling which makes attaching a garage there impractical. Since the applicant proposes to build a second story over the existing attached one story garage for additional habitable space on both floors, the non-conforming setbacks of 34.8 feet front yard and 22 feet rear yard already exists; therefore approval to add a second floor cannot be achieved by any method other than area variances. 3. Town Law 4267-b(3)(b)(3). The variance granted herein for the proposed accessory garage in the front yard is mathematically substantial,representing 100%relief from the code. However,the applicants' property has three front yards and no functional rear yard which creates hardships when proposing to further improve the property. Further mitigation for variance relief results from the proposed front yard setbacks of 35 feet and 43.9 feet which are the setbacks required for a principal structure. However, the Page 2, March 16, 2017 #7027, Murname SUM No. 1000-87-2-33 applicant could reduce the height of the proposed three car two story garage to reduce the overall visual impact of the proposed non-conforming front yard location and make the scale more in keeping with the numerous one story residences in the subject neighborhood. The variance for the front yard setback of 34.8 feet where the code requires 35 feet is de minimus. The proposed rear yard setback of 22 feet where 35 feet is required by code is 37% relief and is substantial. However, no increase in the degree of nonconformity is being proposed and the designated rear yard of the property actually functions as a side yard for the as built dwelling. . 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that variances for the proposed additions and alterations to the dwelling in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. However, since accessory garages are not typical in the subject neighborhood, the proposed two story 3 car accessory garage in the proposed front yard location would adversely impact the character of the neighborhood. 5. Town Law X267-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the rear yard and side yard setbacks and the accessory structure location are the minimum actions necessary and adequate to enable the applicant to enjoy the benefit of a newly renovated home with detached garage in the front yard area while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Goehringer , seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variances as applied for, and shown on the site plans, entitled S-1, and A-1 through A-7, prepared by Mark Schwartz, Architect, dated November 7, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed accessory garage as shown on S-1 of the site plan and architectural plans and elevations titled A8 and A-9 all as prepared by,Mark Schwartz,Architect, dated November 7,2016,shall be revised to a one(1) story accessory garage. 2. Revised plans for a one (1) story accessory garage must be submitted to the ZBA for approval which will be stamped and forwarded to the Building Department as approved before any building permit may be issued. 3. The proposed accessory garage shall remain unheated, contain no habitable space, and be used strictly for storage. 4. The as built shed close to the southerly property line shall be removed, as noted on the site plan cited above. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. If the intent is to provide enlarged garage space, there is no necessity that it be a detached structure.
