SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated January 11, 2017 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 40,049 sq. ft. parcel located in R-80 Zoning District. The northerly property line adjacent to a vacant residential parcel measures 267.00 feet,the easterly property line fronting Hill Crest Drive measures 125.50 feet,the southerly property line fronting Sound View Drive measures 242.00 feet and the westerly property line along Brown's Hill Road (paper street)measures 150.50 feet. The premises is improved by a two story frame home with an attached two car garage, an "as built" deck and an attached "as built" pergola, as well as three "as built" accessory sheds, as shown in a survey prepared by John T. Metzger,L.S., last revised March 2, 2017. BASIS OF APPLICATION: Request for Variance(s) under Article III, Section 280-124; and the Building Inspector's December 7, 2016 Notice of Disapproval based on an application for permits to legalize an "as built" deck addition attached to an existing single family dwelling and an "as built" accessory pergola at: 1) "as built" deck addition less than the code required minimum front yard setback of 50 feet, 2) "as built" accessory pergola located in other than the rear yard, located at; 1315 Hillcrest Drive,NY SCTM# 1000-13-2-8-10. RELIEF REQUESTED: The applicant requests variances to legalize two "as built" structures that are attached to the two story single family dwelling. The deck addition has a front yard setback of 45 feet, and the as built Pergola is located over the deck in a front yard ADDITIONAL INFORMATION: The Building Department has determined that the applicants' improved parcel has three front yards, The subject dwelling faces Hill Crest Drive with a private driveway access to the Page 2, March 16, 2017 #7035, Crowley SCTM No. 1000-13-2-8.10 street which currently serves as the property's only legal access. The parcel also fronts along the southerly property line on a wooded, unopened paper street known as Sound View Drive. To eliminate this front yard zoning issue,the applicant testified that he and the adjacent neighbor to the south attempted to purchase, subdivide, and annex this unopened road from the Town of Southold which they were unable to do. The third frontage is along Brown's Hill Road, a private road which is used for access by property owners in the Brown's Hill subdivision. The subject parcel has no legal access rights to this private road over the street line. Therefore, by Code, this street line shall not be considered to be a front yard. Two other prior variance approvals by the ZBA are relevant to and support this subject application(#6436 dated February 16, 2011; and 45856 dated April 13, 2006). In both instances, each applicant proposed accessory in ground swimming pools in what was determined by the Building Department to be a front yard,rather than the code required rear yard, based upon the parcels having frontage along Brown's Hill Road. However, neither property had any legal access rights to Brown's Hill Road. Additionally in#5856, the parcel was also adjacent to the unopened paper road know as Sound View Drive. A revised survey'prepared by John T. Metzger, L.S. last revised March 2, 2107 was submitted to the Board during the public hearing pursuant to a request that the survey be revised to depict sheds located on the subject property that were seen during site inspections by members of the Board. The applicant's representative assured the Board that she will submit applications to the Building Department to legalize all structures. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 2, 2017 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Building Inspector determined that the rear deck addition has insufficient setback from a town road know as, Sound View Drive. This road is not open and contains woodland and vegetation to block visibility. In addition, the pergola is adjacent to the as built deck and is also buffered by vegetation and not visible from Hill Crest Drive or adjacent properties. Moreover, prior variance relief for front yard setbacks for accessory structures has been granted in this neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant, cannot not be achieved by some method feasible for the applicant to pursue, other than area variances. As indicated, although the applicants have no access over Sound View Drive, the Town still considers that this paper road constitutes street frontage and therefore any structures on the parcel must conform to the code required yard location and front yard setbacks for the zoning district in which it is located. 3. Town Law §267-b(3)(b)(3). The variances granted herein are not mathematically substantial, representing 7%.variance for the deck, and 6% for the pergola. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page'3, March 16, 2017 #7035, Crowley SCTM No. 1000-13-2-8.10 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law > 267-b. Grant of the requested variances are the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as built" rear deck and pergola while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Goehringer, seconded by Member Weisman (Chairperson), and duly carried to: FIND THAT since the subject parcel has no legal access rights to the private road known as Brown's Hill Road, therefore; by Code,this street line shall not be considered to be a front yard and any accessory structures placed in such yard shall comply with the applicable rear and side yard setbacks for the zoning district within which it is located. AND to: GRANT the variances as applied for, and shown on the survey prepared by John T. Metzger, L.S., last revised March 2,2017. SUBJECT TO THE FOLLOWING CONDITIONS: The applicant shall apply for certificates of occupancy in order to legalize all accessory structures on the subject property. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. However, this is a private road. It is not, and has not ever been open to traffic. In fact, it's quite densely wooded.
