JAMESAPRESTON and ELLENAPRESTON, his wife, both residing at Front Street, Greenport, L. I. , New York, CO r+, M party of the second part, WITNESSETH, that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of the second part forever, ALL that certain plot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being*DdeK near Southold, Town of Southold, ,County of Suffolk and . State of New York, bounded and described as follows : BEGINNING at a point on the southeasterly side of a 50 foot private road where the same is intersected by the southwesterly side of land conveyed to Earl W. Simmons and his wife by deed recorded in the Suffolk County Clerk's Office in Liber 2644 cp 422 (now or formerly of Witherspoon) and from said point of beginning running thence along said land South 64 degrees 50 minutes East 109,.08 feet; running thence South 45 degrees 43 minutes West 74.29 feet; running thence North 37 degrees 35 minutes West 23 feet; running thence South 52 degrees 25 minutes West 20 feet; running thence South 37 degrees 35 minutes East 15.8 feet; running thence South 38 degrees 50 minutes West 48.60 feet; running thence North 39 degrees 24 minutes West 75.52 feet to the southeasterly side of said 50 foot private road; running thence along the southeasterly side of said 50 foot private road the follow- ing courses and distances : (1) North 45 degrees 15 minutes East 13.73 feet, (2) North 30 degrees 10 minutes East 86. 27 feet to the point or place of BEGINNING. BEING the same premises conveyed to the grantor by deed dated December 8th, 1971 from one Robert L. Hyatt, said deed recorded in the office of the Clerk of Suffolk County on December 13th, 1971 in Liber 7066 cp 121. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to said premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of -the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
