According to the Deed, Mr. Yaxa owns the underwater land along the high water mark extending across the width of the property, as reflected in the survey J provided by Mr. Yaxa. (100) cages would be added to the existing site and the measurements vary as follows : 20-inches high, 36-inches wide, and 64-inches long; 30-inches high, 36-inches wide, and 42-inches long; 12-inches high, 40-inches• wide, and 94-inches long. At least 10-feet of water will be over the' cages at mean low water. The new location would cover an area of approximately one (1) acre in size and consist of one hundred (100) floating plastic shellfish bags measuring 3-inches high, 18-inches wide, and 36-inches long. The containers at both locations would be connected in trawls and marked with buoys . The Purpose of this project is to maintain and expand a private business venture. Your application was received by the department on July 7, 2003. Prior to the submission of your completed application Shellfish Management conducted an on-site evaluation. A survey was made of any potential negative environmental impacts and used to later complete an environmental assessment pursuant to SEQR. No potentially negative environmental impacts were found. In addition,the application was reviewed by the department's Division of Environmental Permits, which further evaluates any other conflicts and the need for additional permits particularly related to the presence of tidal wetlands. No potential negative environmental impacts or concerns were found, and a full approval was given by Environmental Permits. Conceptually,the department supports and approves of the shellfish aquaculture activities you have proposed. As well as internal departmental review, a completed review had been performed by the U.S. Coast Guard and the Department of State. The U.S. Coast Guard has reviewed your application for the necessity of a Private Aids to Navigation Permit-and found none is necessary. The Department of State has given you a Certificate of Consistency supporting your proposed activities as part of all currently approved'Coastal Zone Management policies in your Township. Lastly, the U.S. Army Corps of Engineers, which is reviewing your, application for the placement of structures in marine water, has yet to make a final determination but is likely to grant permission considering the approval of all other involved agencies.
