York, known and designated as Lot No. 31 as shown on a certain map
entitled "Subdivision Map of Section One, Property of George I.
Tuthill and others" and filed in the Office of the Clerk of the
County of Suffolk on January 15, 1929 as Map No. 861, as more fully
described on Schedule A annexed hereto and made a part hereof.
BEING and intended to be the same premises conveyed to the party of
the first part by deed dated December 22, 1999 recorded December 29,
1999 in Liber 12010 cp 367 made by Fred Milner and Mary Milner, his
wife, and by deed dated December 4, 2002 recorded December 23, 2002
in Liber 12226 cp 725 made by Katherine P. Williamson a/k/a Kathrine
Y. Williamson and Zahn R. Williamson, as tenants in common, and by
deed dated January 9, 2003 recorded February 5, 2003 in Liber 12234
cp 108 made by Kathrine P. Williamson a/k/a Kathrine Y. Williamson
and Zahn R. Williamson, as tenants in common.
TOGETHER with all right,title and interest of the party of the first part in and to any streets and roads abutting the
above described premises to the center lines thereof,TOGETHER with the appurtenances and all the estate and
rights of the party of the first part in and to said premises. TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part convents that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first
part will receive the consideration for this conveyance and will hold the right to receive such consideration as a trust
fund to be applied for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using nay part of the total of the same for any other purpose.
The word"party"shall be construed as if it read "parties"whenever the sense of this indenture so requires.
