BAILLEY and FLORENCE C. BAILEY, his wife, residing , ., ' ' at North Country Road, Wading River, New York party of the first part,and HUGH J. MURPHY and ROSEMARY MURPHY, /residing at 135 Terrace View Avenue, Bronx, New York, \7 y party of the second part, WITNESSETEI,that the party of the first part, in consideration of ten dollars and other valuable consideration paid by the party of the second part, does hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the second part forever, ALL that certainlot p , piece or parcel :.f :and, with the br,tlui,(gs and improvements thereon erected, situate, lying and beingjvgt at Pine Neck, in the Town of Southold, County of Suffolk and State of New York, bounded and described as follows: BEGINNING at a point where the northerly line of the right of way intersects the easterly line of Oaklawn Avenue, said point being N 383. 96 feet north of the intersection of the said Oaklawn Avenue with the northerly line of Pine Neck Road; running thence north 10 degrees 58 minutes 20 seconds east the following two courses and distances: (1) north 10 degrees 58 minutes 20 seconds east 11.47 feet; (2) north 10 degrees 58 minutes 20 seconds east 23. 57 feet, to an iron pipe set at an angle in the easterly side of Oaklawn Avenue running thence north 13 degrees 01 minutes 40 seconds west 70 feet; thence still along the said side of said Avenue and part of the way along bridge abutment north 11 degrees 37 minutes west 29 feet, more or less, to a timber bulkhead, thence along the timber bulkhead as it twists and turns with the ordinary high water mark of Jockey Creek the following four distances: (1) easterly 16 feet, more or less; (2) southeasterly 37 feet, more or less; (3) easterly 45 feet, more or less and (4) southerly 43 feet, more or less; thence running along the ordinary high water mark of Jockey Creek, 14 feet, more or less , to a point where the dividing line between the premises herein and the land now or formerly of Beatrice Nehrbus intersects the said high water mark;running thence along the land of said Beatrice Nehrbus south 7 degrees 18 minutes west 56 feet to a point in the northerly line of the aforementioned right of way; running thence south 76 degrees 48 minutes 40 seconds west 94. 12 feet to the point or place of beginning. BEING AND INTENDED TO BE the same Aremises which were conveyed to the party of the first part herein by deed from Ellis W. and Jacqueline Gaskell, dated July 23 , 1973 and recorded in the Suffolk County Clerk's Office on August 6, 1973 in Liber 7459, at page 591. TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and roads abutting the above described premises to the center lines thereof; TOGETHEk with the appurtenances and all the estate and rights of the party of the first part in and to said premises;.TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or successors and assigns of the party of the .second part forever. AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby the said premises have been encumbered in any way whatever, except as aforesaid. AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of the first part will receive the consideration for this conveyance and will hold the right to receive such consid- eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the payment of the cost of the improvement before using any part of the total of the same for any other purpose. The word "party" shall be construed as if it'read "parties" whenever the sense of this indentpre so requires.
