The board made the following findings and determination: This is an application for approval of access over a private right-of-way located on the east side of Indian Neck Lane approximately 958.82 feet south from the Main Road (S.R. 25). The right-of-way in question has a legal width of 15 feet, a traveled width of 10± feet, and a length of 643.96 feet to premises having receiving conditional subdivision approval, #221, 6n 4/27/81 by the Planning Board. The portion of the right-of-way outside of the subdivision is under con- sideration by this board. A copy of deed recorded at Liber 9610 cp 313 dated 7/12/84 has been submitted for the record indicating conveyance by Herodotus Damianos to K & L Properties of the rights-of-way to the 5.3± acres in question. The right-of-way is in fair condition and consists of hard packed sand and gravel. There are a few small pot holes and depres- sions throughout. Test holes indicate 5"± of sand and gravel. It is the opinion of this board that certain improvements be made for suitable accessibility by emergency v'ehicles. Accordingly, on motion by Mr. Grigonis, seconded by Mr. Goehringer, it was RESOLVED, that Appeal No. 3292, application for K & L PROPERTIES, INC. be and hereby is GRANTED approval of access in accordance with New York Town Law, Section 280-A, SUBJECT TO THE FOLLOWING CONDITIONS: 1. X) ) ) REASON FOR APPEAL A Variance to Section 280A Subsection 3 A Variance to the Zoning Ordinance ~s requested forthe reason that no building permits will be issued by the Town of Southold without the approval of the Zoning Board of Appeals of the access from Indian Neck Lane to this parcel. (Continue on other side) REASON FOR APPEAL Continued .'1. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because neither appellant, nor any successor in interest to appellant, would be able to obtain building permits for any of the four lots shown on the approved subdivision map. 2. The hardship created is UNIQUE and is not shored by all properties alike in the immediate vicinity of this property and in this use district because the original construction on the property pre-existed the zoning requirements (April 23, 1957) and, in like manner, compliance with 280a of the Town Law. This parcel is a 4 lot minor subdivision, spproved by the Southold Town Planning Board on April 27, 1981, subject to 280a of the Town Law. The property is located off a private right of way, which cannot be used without approval of access. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because the existing access road would only be improved to meet the requirements of the Zoning Board of Appeals. RUDOLPH BRUER: Mr. Chairman, Members of the Board, actually there is a c/o for the existing house based on pre-existing use. The right of way serves this existing house and Mr. Pontino's property. The right of way when it is improved, will actually service an additional three more plots and I think the application is well worth the merits and should be granted. The applicant bought the property knowing that it was an improved, minor subdivision by the $outhold Town Planning Board; he knows that he has to meet the requirements of the Planning Board with respect to the roadway inside the subdivision, and he knows that he will have to meet the standards that this Board sets to build the road. I understand that your engineer has already been out there, and has made certain recommendations. CHAI}~.IAN GOEHRINGER: Do you have a copy of that? RUDOLPH BRUER: Yes I do. Our clients are aware of it and we request that this application be granted as asked for. If you have any questions, I will be happy to answer them. CHAIRMAN G©EHRINGER: No. I have no questions. RUDOLPH BRUER: The present covenants with respect to the pro- perty state that for instance, that the one furthest away from the house that one can only be built on in 1985 and there would be another year before another could and another year before the one next to the house. Mrs. Duchow lives in the main house and does have a life estate there. CHAIRMAN GOEHRINGER: That's in lot #1. RUDOLPH BRUER: Yes, the house whatever we do would help her; her and Mr. Pontino's house. there. Davis Date: March 7, 1987 Re: Appeal No. 3292 K & L Properties - Access Road Comments: This section of access road is in a 15 ft. R.O.W. with a length of 644± ft. from Indian Neck Lane. The existing road in this R.O.W. consisted of 5"± of stabilized sand and gravel in fair condition, lO ft. in width with some pot- holes and minor depressions. Prior to placing the top course the surface was corrected. At option of owners a 2~" bankrun asphalt course was used instead of the 3" stone blend as original]y called for in the top surface. The aspha]t course will provide a better and more durable surface. The asphalt work was done in two operations. A width of 10.5± ft. was placed first in the R.O.W. which was less than called for. At a later date widening was placed on the west side so that the final width now averages 13.5± ft. I recommend acceptance of this access road. ~_~//John W. R.O.W. from Indian Neck Lane to the above sub- on. According to the map, this R.O.W. is not included in the Duchow property. ~he road ft. in length to the subdivision. Comments and approval for this part cf the access come from the Town Board of Appeals. is an existing access road within the subdivision 25 ft. R.O.W. (continuation ~f the in the 15 ft. R.O.W.) that continues to the Duchcw residence where it ends in a con- turnaround. TOe road is 8 ft. in ~idth, about 300 ft. in length and consists cf sand ~ravel, oyster shells, other hard-packed material and is in fair condition. of the 25 ft. R.O.W. within the property is wooded, some areas are heavily wooded with and medium size pine trees. 1 length of access road in the subdivision is 780 ft. ~{ENDATION$ ~ ~idth of road within the subdivision ]~ ft. ~f Widen existing road in the 25 ft. R.O.W. %o t. Widen on the right side. Do necessary clearing and stump removal so that there is 2 ft. from road edges to trees. Remove topsoil, leafmold and other objectionable material under all new r~ad areas. If such material exceeds one foot, remove for one foot only. Replace above excavation with a good grade ~f clean fill. At widened areas grade the replacement material so that a 6" course of compacted acceptable bankrun ~ill coinside with the existing read. ~he 6" bankrun course to have 20% plus cf ~ravel Md 10% plus of loam or an approved equal. Place a 2" top course of 3/4" stone blend on the bank run in new road areas and on existing !road areas. ~here~he~existing road meets cc~crete, regrade it back for a short distance so that the ':stone blend is even with the concrete. Also, grade the ban]~un where it is Dlaced along- side the c~crete so the blend course is even with it. No stone blend should g~o on the concrete. R.O.W. from Indian Neck Lane, approximately 640 ft. in length, to the above subdivision. ~he entrance road is 10 ft. ~ in width, is in fair condition and consists of hard-packed sand and gravel, there are some small potholes and depressions throughout. Test holes indicate 5''~_ of sand and gravel. Due to a pole line inside the north side of the R.O.W., it appears that the road may not be widened, there are monuments on the north side of the 15 ft. R.O.W., and to determine if widening can be done, the R. 0.W. line there s~ould be es tablished. Recommendations - assuming the 10 ft. ~idth is to be used: 1. Fill the potholes and depressions with bankrun sand and gravel. 2. Place a comDacted 3" top course of 3/4" stone blend on ~he corrected surface. If the road can be widened - say to 12 ft., remove topsoil for 6". Replace this excavation with sand and gravel bankrun. Place additional bankrun to the top of the existing road. R.O.W. from Indian Neck Lane to the above sub- )div~sion. According to the map~ this R.O.W. is not included in the Duchow property, the road ~ is 64OZ ft. in length to the subdivision. Comments and approval for this part cf the access Could come from the Town Board of Appeals. ~here is an existing access road within the subdivision 25 ft. R.O.W. (continuation cf the road in the 15 ft. R.O.W.) that continues to the 5~ch~ residence where it ends in a con- crete turnaround, the road is 8 ft. in width, about 300 ft. in length and consists cf sand and gravel, oyster shells, other hard-packed material and is in fair condition. Most of the 25 ft. R.O.W. within the property is wooded, some areas are heavily wooded with large and medium size pine trees. Total length of access road in the subdivision is 780 ft. RECOmmeNDATIONS: 1. Width of road within the subdivision 1~ ft. ~ 2. Widen existing road in the 25 ft. R.O.W. to ~ ft. Widen on t~ right side. 3. Do necessary clearing and stump removal so that there is 2 ft. from road edges to trees. e Remove topsoil, leafmold and other objectionable material under all new road areas. If such material exceeds one foot, remove for one foot only. Replace above excavation ~th a good grade of clean fill. At widened areas grade the replacement material so that a 6" course of compacted acceptable bankrun ~ill coinside with the existing road. 5. the 6" bankrun course to have 20% plus cf gravel a~d 10% plus of loam or an approved equal. ~ Place a 2" top course of 3/4" stone blend on the bank run in new road areas and on existin~ road areas. 0 ~here theexisting road meets concrete, regrade it back for a short distance so that the stone blend is even with the concrete.
