THE SPECLALEXCEP~ON ~REQUESTED BECAUSE Petitioner proposes to build a
one story, 40' by 60' office and storage building as shown on the plans
and specifications which is attached hereto as Exhibit A. Petitioner's
property is located in a "C-l" General Industrial District. There
appears to be no question that an office and storage building is permitted
as a use in this district; however, the Building Inspector has determined
under Section 100-91 of the Southold Town Zoning Code that since part of
Petitioner's proposed use of the covered storage area will be for petro-
leum products that a Special Exception is necessary by virtue of Section
100-80 B (16) of the Zoning Code as well as Site Plan Approval. (See
Notice of Disapproval of the Building Inspector dated February 15, 1984,
which is attached hereto as Exhibit B). Your Petitioner has already re-
ceived tentative site plan approval from the Southold Town Planning Board
at its meeting on February 13, 1984, for the location of-the p~op0sed
one story office and storage building subject to the approval .of the
Zoning Board of Appeals, namely for a front yard area variance (see letter
of the Southold Town Planning Board to Richard F. Lark dated February 17,
198~, which is attached hereto as Exhibit C).
Your Petitioner respectfully disagrees with the determination of the
Building Inspector requiring a Special Exception in that your Petitioner
has already been using the property for the storage of petroleum products

THE SPECIAL EXCEPTION IS REQUESTED BECAUSE (contd):
such as fuel oil, gasoline and kerosene since 1946. The use of
Petitioner's property has been recently confirmed by the Southold
Town Zoning Board of Appeals when Petitioner requested permission
to relocate a 20,000 gallon fuel oil tank on this property and
was granted permission to do so by the Southold To%rn Zoning Board
of Appeals (see appeal No. 2565 dated August 10, 1979. approve~
by the Southold Town Zoning Board of Appeals on August 16, 1979,
which is attached hereto as Exhibit D).
The buildings presently used in your Petitioner's fuel oil business
are depicted on Exhibit 1; however, there is no office building on
the property. Petitioner proposes to construct the building as shown
on Exhibit A for use as a customer and dispatching office and the rear
of the building will be a covered storage area for bulk motor oils
and other fuel products for pick-up and distribution to your Petitioner's
customers. This proposed office and storage building is necessary for
Petitioner's growing petroleum business and is absolutely essential
since there is no place on Petitioner's property to transact business
with its customers. The proposed location of the building will en-
hance the general area as well as Petitioner's property and this general
area and will provide for suitable off-street parking for Petitioner's
customers and employees.
The proposed construction and use of this building will not prevent the
orderly and reasonable use of the adjacent or neighboring properties
in this use district. The proposed location will not create any undue
congestion; zn fact, it will help relieve it because Petitioner intends
to use the existing northerly curb cut for ingress for vehicular traffic
and the existing southerly curb cut for egress for traffic. There also
will be a driveway in front of the proposed building so Petitioner's
customer's will not have to park on Youngs Avenue, but will have a con-
venient place to stop and pay bills and transact other business. In
addition~ ample 6ff-street parking, and more important maneuvering
area for fuel trucks delivering petroleum products to ~e~itioner's
premises, as well as Petitioner's fuel oil trucks will b~e afforded
by the proposed layout.
The office building will be furnished water from the existing water
main which is on Young's Avenue. The effice and storage will be self-
contained and will not gzve off any noxious, gaseous odors, Smoke or
soot, nor will there be any disturbing emissions or electrical charges,
dust, light vibration or noise eminating from the building.
WHEREFORE, it zs respectfully submitted the proposed construction
of the office and storage building will be in harmony with the neigh-
borhood and promote the general commercial purposes of this use district.
Your Petitioner requests a special exception from the SQuthold Town
Board of Appeals to construct said building or in the alternative an
interpretation that the determination of the Building Inspector dated
February 15, 1984, is not warranted because in affect Petitioner
has przor special exception approval for the conduct of its business
and the proposed building and storage area will be incidental and in
conformity therewith.

After investigation and.inspection the Board finds that the appli-
~cant is in the fuel oil business, and presently basra'20,000 gallOn .
fuel oil tank presently located on the North Fork Shipyard, Inc.,
property in New Suffolk. They desire to move this tank to their
storage yard on Youngs Avenue to consolidate their business, prevent
vandalism and the possibility of leakage. The Board agrees with the
reasoning of the applicant.
The Board finds that strict application of the ordinance would pro-
duce practical difficulties or unnecessary hardship; the hardship created
is unique and would not be shared by all properties alike in the immediate
vicinity of the property and in the same use district; and the variance
will not chance the character of the neighborhood and will observe the
spirit of the Ordinance.
On motion by Mr. Grigonis, seconded by Mr.'Tuthill, it was

THE SPECIAL EXCEPTION IS REQUESTED BECAUSE (contd):
such as fuel oil, gasoline and kerosene since 1946. The use of
Petitioner's property has been recently confirmed by the Southold
Town Zoning Board of Appeals when Petitioner requested permission
to relocate a 20,000 gallon fuel oil tank on this property and
was granted permission to do so by the Southold Town Zoning Board
of Appeals (see appeal No. 2565 dated August 10, 1979, approved
by the Southold Town Zoning Board of Appeals on August 16, 1979,
which is attached hereto as Exhibit D).
The buildings presently used in your Petitioner's fuel oil business
are depicted on Exhibit 1; however, there is no office building on
the property. Petitioner proposes to construct the building as shown
on Exhibit A for use as a customer and dispatching office and the rear
of the building will be a covered storage area for bulk motor oils
and other fuel products for pick up and distribution to your Petitioner's
customers. This proposed office and storage building is necessary for
Petitioner's growing petroleum business and is absolutely essential
since there is no place on Petitioner's property to transact business
with its customers. The proposed location of the building will en-
hance the general area as well as Petitioner's property and this general
area and will provide for suitable off-street parking for Petitioner's
customers and employees.
The proposed construction and use of this buildinq will not prevent the
orderly and reasonable use of the adjacent or neighboring properties
in this use district. The proposed location will not create any undue
congestion; in fact, it will help relieve it because Petitioner intends
to use the existing northerly curb cut for ingress for vehicular traffic
and the existing southerly curb cut for egress for traffic. There also
will be a driveway in front of the proposed building so Petitioner's
customers will not have to park on Youngs Avenue, but will have a con-
venient place to stop and pay bills and transact other business. In
addition, ample off-street parking, and more important maneuvering
area for fuel trucks delivering petroleum products to Petitioner's
premises, as well as Petitioner's fuel oil trucks will be afforded
by the proposed layout.
The office building will be furnished water from the existing wate~
main which is on You~g's Avenue. The office and storage will be self-
contained and will not give off any noxious, gaseous odors, smoke or
soot, nor will there be any disturbing emissions o~ electrical charges,
dust, light vibration or noise eminating from the building.
WHEREFORE, it is respectfully submitted the proposed construction
of the office and storage building will be in harmony with the neigh-
borhood and promote the general commercial purposes of this use district.
Your Petitioner requests a special exception from the Southold Town
Board of Appeals to construct said building or in the alternative an
interpretation that the determination of the Building Inspector dated
February 15, 1984, is not warranted because in affect Petitioner
has prior special exception approval for the conduct of its business
and the proposed building and storage area will be incidental and in
conformity therewith.
