Lark, Esq., Main Road, Cutchogue, NY for a Variance to the Zoning Ordinance, Article IX, Section 100-93 for permission to construct office building with an insufficient frontyard setback, at 1515 Youngs Avenue, Southold, NY ("C-I" General Industrial Zone); County Tax Map Parcel No. 1000-60-1-6. The board made the following findings and determination: By this appeal, applicant seeks permission to construct an one-story, 40' by 60' building for office and storage use which is proposed to be set back approximately 22' from its farthest point and 18' from its near- est point, westerly of an existing fence located at the easterly frontyard area of the parcel in question. The premises in question contains an area of 38,550 sq. ft. with frontage along ¥oungs Avenue of approximately 150 feet. The premises is improved with four separate garage/storage buildings, three above-ground fuel storage tanks and existing fences and walls around its perimeter (exclusive of the present two accesses at Youngs Avenue). Abutting the premises on the north is a driveway and parking area for Agway, on the west Agway, on the south Long Island Railroad and on the east Youngs Avenue. The subject premises is located in a 'C-1 General Industrial" Zoning District. For the record, it is noted that the premises has been the subject of prior appeals No. 2565 rendered July 26, 1979 and No. 241 of December 1959. Application No. 3236 for a Special Exception con- cerning the use of this building has been filed simultaneously herewith and rendered also this date. It is the opinion of this board that the relief requested is not substantial in relation to that existing on the premises in question and abutting properties and therefore would not adversely affect the character of the district. At the southeast corner of the premises exists a 19.5 by 13.5-foot storage shed set back from the existing fence 16' at its farthest point, and set back 25' from the fence on the south. Opposite the parcel across Youngs Avenue is an existing office and storage building with a minimal frontyard setback. (CONTINUED ON PAGE TWO) DATED: June 6, 1984. In considering this appeal, the board determines: (a) that the relief requested is not substantial; (b) that by granting the requested relief, the character of the neighborhood will not be adversely affected; (c) that by allowing the variance, no substantial detriment to adjoining properties would be created; (d) that no adverse effects will be produced on available governmental facilities of any increased population; (e) that the relief requested will be in harmony with and promote the general purposes of zoning; and (f) that the interests of justice will be served by allowing the variance, as indicated below. Accordingly, on motion by Mr. Douglass, seconded by Mr. Sawicki, it was RESOLVED, that Appeal No. 3237, application of GOLDSMITH AND TUTHILL, INC. for permission to construct principal building for office and storage use with an insufficient frontyard setback, BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS: -- 1. Building shall not be closer than 22 feet from the east (front) property line; 2. Building shall not be closer than 45 feet from the north property line, as applied and shown on the 2/18/84 site plan. Tax 3. Planning Board final site plan approval. Petitioner's property is rectangular in shape having 150 feet of frontage along Youngs Avenue and a depth along the Long Island Railroad tracks of 257 feet. Located on the property are fuel oil and gasoline storage tanks both above and below ground as well as several garages and sheds all used in Petitioner's busi- ness of wholesale and retail sales of gasoline, fuel oil, and petroleum products. Due to the location of the storage tanks and garages, the only feasible location for an office and covered storage building is in the front yard area of your Petitioner's property. Petitioner's property is zoned "C-l" Industrial District which requires a front yard setback of 150 feet as well as a rear yard setback of 100 feet. Considering the entire depth of Petitioner's property is only 257 feet, it would be virtually impossible without a variance under today's zoning standards to construct any type of building on the property. By locating the building in the approximate center of the property and 22 feet from the front property line will allow your Petitioner to require a one way traffic loop for the purpose of ingress and egress to Petitioner's property. It is proposed to have the northerly entrance for one way ingress into Petitioner's property and the southerly curb cut on Youngs Avenue will be (continued on Rider attached hereto under #1) 2. The hardshipcreated is UNIQUEand isnotshared by all prope~ies alike in the immediate vicinitvof ~kispropert~gnd in,his use d~trict because Petitioner's premises has been used for the azs~rzbu~zon oz petroleum prouucts since 1946. However, there is no office building or enclosed storage to serve the public on the premises. Due to the location of Petitioner's storage tanks and existing garages, the only feasible place to locate an office building and provide suitable off- street parking is in the front yard area. 3 The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because an inspection of not only Petitioner's property but the immediate properties surrounding it reveals they are de- voted to that of an industrial use. Agway to the north and west of Peti- tioner's property; Southold Lumber Company to the east across Young's Avenue, and the Long Island Railroad tracks bordering Petitioner's property on the south. In addition most of the properties in this neigh- borhood as far as lot size, width and yard requirements do not comply with the current zoning ordinance mainly because this commercial neighborhood was established long before zoning. It is essential Petitioner have an office and enclosed storage building on the premises, and the proposed location will not only reduce traffic congestion but provide suitable off- street parking for both Petitioner's customers and employees as well as enhance the overall appearance of this property. The proposed office and storage building will produce no increase in population density, nor will it result in any substantial change in the character of the neighborhood or be a detriment to any adjoining properties. Considering the size and shape of your Petitioner's property as well as the location of the existing truck garages and storage tanks, there is no other practical place to locate this office and storage building without having a variance. TO set the building further back will take away from the area to be devoted to off-street parking for Peti- tioner's customers and employees; as well as make it exceeding difficult if not impossible to have maneuvering room for trucks providing deliveries of fuel products to Petitioner's premises as well as your Petitioner's own trucks for the loading of fuel products. Considering all the above factors the interests of justice will be served by allowing this front yard variance which is not substantial considering the neighborhood and what is already built on your Petitioner's property.
