Upon application of JOSEPH FISCHETTI, Hobart Road, Southold, NY for a Variance to the Zoning Ordinance, Article V, Section 100-50(C)[1] for permission to erect sign with less than four-foot clearance from ground, at 52800 C.R. 48, Southold, NY; County Tax Map Parcel No. 1000,051-05-002. The board made the following findings and determination: By this appeal, applicant seeks a variance from Article V, Section 100-50(C)[1] of the zoning code to erect 52" by ]08", the lower edge of which will be two feet above the ground, rather than the required four feet above the ~round. Said sign will advertise only that use permitted on the premises in question and shall comply with all of the supplementary sign regulations of the code pertaining to this zoning district. The premises in question is zoned "B-1 Multiple-Residence" and contains an area of approximately 2.8 acres. For the record it is noted that the premises is presently being improved with multiple dwelling structures, which shall be in compliance wit6 this board's conditional approval of a Special Exception application in accordance with Section 100-50(B)[3] of the Zoning Code as granted February 19, 1983, and any and all other approvals required for same. The board members agree that the property in question and this type of advertising lend itself to the granting of the relief requested, as well as being more in keeping with the landscaping. In considering this appeal, the board determines: (a) that the relief requested is not substantial; (b) that the granting of the requested relief, the character of the neighborhood will not be adversely affected; (c) that by allowing the variance, no substantial detriment to adjoining properties would be created; (d) that no adverse effects will be produced on available governmental facilities of any increased population; (e) that the relief requested will be in harmony with and promote the general purposes of zoning; and (f) that the interests of justice will be served by allowing the variance, as indicated below. Accordingly, it was recommended that the visibility must remain clear and unobstructed for at least l0 feet from the front property line, and the following resolution was adopted: DATED: May 30, 1984.
