FINDINGS OF FACT
PROPERTY FACTS: The subject property is a triangular undeveloped parcel of 23,594 sq.
ft. in Southold, with frontage of 240 feet on Oakwood Drive (east) and 277 feet on Lakeside
Drive (west), and a northerly lot line of 171 feet.
BASIS OF APPEAL: Building Department Notice of Disapproval, dated November 1, 2001,
denying a permit for construction of a new house because the proposed location is 17.9 feet
from the rear(northerly) lot line whereas 50 feet are required under Code Section 100-244B.
AREA VARIANCE RELIEF REQUESTED: Applicant originally requested a variance
authorizing construction of the house 17.9 feet from the rear lot line. At the hearing on
January 10, 2002, applicant submitted a revised plan that reflected discussion with the
owner of the property to the north. The revised plan locates the house further south so that
the rear (northerly) setback is 39.2 feet, and applicant requests a variance authorizing that
setback.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, materials submitted and personal inspection, the Board makes the following
findings:
1. The triangular shape of the lot, with two front yards under the Zoning Code,
constrains the allowable building envelope. If the front yard (40 feet) and rear yard (50 feet)
setbacks were fully complied with, only a very small house could be built. Applicant thus
needs a variance.
2. Applicant's revised plan places the house well away from the northerly lot line,
although less than the required 50 feet. If the subject property did not have two street
frontages, the yard in question would be a side yard and could be as narrow as 15 feet. The
revised proposed location will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties.
3. There is no evidence that grant of the requested variance will have an adverse
effect or impact on physical or environmental conditions.
4. Grant of the requested variance is the minimum action necessary and adequate to
enable applicant to enjoy the benefit of a new home while preserving and protecting the
character of the neighborhood and the health, safety and welfare of the community.

RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded Member Collins, it
was
RESOLVED, to DENY the original request for a variance authorizing a rear
17.9 feet, and ALTERNATIVELY to GRANT a variance authorizing a rear setbac of 39.2 feet,
as set forth on the revised site plan submitted to the Board at the hearing o January 10,
2002.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that violates the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
Vote of the Board: Ayes: Goehringer, Tortora, Collins, and Horning. (Member Dinizio was
absent.) This Resolution was duly ADOPTED (4-0).

Upon the application of William Zoumas,filed pursuant to 19 NYCRR 450 on September 19,2002 and
upon all other papers in this matter, the Department makes the following determination:
NATURE OF GRIEVANCE AND RELIEF SOUGHT
The petition pertains to the construction of a new building of Al (single family) occupancy, two
stories in height, of type 5 (a wood frame) construction, approximately 2000 square feet in area, located at
695 Lakeside Drive, Southold,Town of Southold, Suffolk County, State of New York.
The petitioner is seeking relief from:
9 NYCRR 711.2(b),which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation
rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow an existing
bathroom, built into the roof area of the second story with a horizontal ceiling height of approximately
8 feet 3 inches sloping down to 6 feet 3 inches.]
FINDINGS OF FACT
1. The existing bathroom was constructed into the roof area of the second floor of
the building that is the subject of this petition.
2. The horizontal ceiling height in the bathroom is approximately 8 feet 3 inches sloping down to 6 feet 3
inches.
3. With the placement of the fixtures, the 6 foot 3 inch ceiling height is adequate
for normal usage.
4. The petitioner has proposed to install a fire and smoke detecting device in the
second floor as required by the Uniform Code.
5. The local Code enforcement official has been consulted in this matter and does
not object to the granting of a routine variance under the provisions of 19 NYCRR
450.6.

CONCLUSIONS OF LAW
Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would
produce a negligible additional health, safety and security benefit to the occupants of the building.
DETERMINATION
WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b),to allow a
bathroom built into the roof area of the second story with a ceiling height of approximately 8 feet 3 inches
sloping down to 6 feet 3 inches, be and is hereby PROPOSED TO BE GRANTED with the following
conditions:
1. That the petitioner installs fire and smoke detecting alarm devices in the second story in conformance
with the Uniform Code.
2. That the builds conform to all other applicable sections of the uniform Code
This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writino
received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by
the parties.
This decision is limited to the specific building and application before it, as contained within the
petition, and should not be interpreted to give implied approval of any general plans or specifications
presented in support of this application.
