~. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces-
sary H,~RDSHIP because the existing dimension requirements of the site as
improved do not allow the proposed expansion for a "bottle return"
facility as required by the New York State "Bottle Law" and reasonable
health requirements mitigating against inside storage in a s~re that
sells food. Passage of the recently enacted Bottle Law was not
anticipated at the time of original construct~n and t.herefore outside
storage was not included.

I am the adjoining property owner on the east side of the
7-11 Store in Cutchogue, New York. I object to having an acces-
sory building constructed on either the east side or the west side
of the present 7-11 Store as it is a ridiculous request. It will
place the building too close to the property lines reducing open
space and service vehicles gaining access to the accessory building
will interfere with the existing parking area in the front of the
store. There is presently a large back yard on the property which
is not being used for anything. There appears to be no good
reason why this area could not be utilized for the construction of
the proposed storage building as well as provide for access of
delivery and garbage vehicles.
Due to the small parking area in the front of the store I am
surprised there are not more accidents with customers attempting
to back in and out of the parking spaces. For the safety of the 7-11
customers any new buildings should be constructed in the rear of
the property, as a building in the side yard areas will cause
further traffic congestion because of access problems and could lead
to a serious accident. If an accident occurred as a result of the in-
creased congestion, I believe the Town would be held responsible for
helping create an unsafe condition.

Dear Ms. Pascucci:
Following a field inspection of the 7-11 stores at
the above mentioned locations and review of same
at the Planning Board meeting of July 9, 1984, the
Planning Board makes the following recommendation.
It was the consensus of the Board that the proposed
accessory buildin~ should be located in the rear
of the stores. It was also suggested that a leanto
could be constructed in the rear of the stores rather
than the utility building in order to provide more
storage.

Analysis Unit, Building 40, S.U.N.Y., Stony Brook, NY 11794, (tel. 516-751-7900), if

personally visit them at their Stony Brook office for instructions and application
