Box 384 East Madon, NY 11939 RE: 625 OSPREY NESTRD., GREENPORT SCTM#35-6-28 Dear Mr. Kalunas: The following action was taken by the Southold Town Board of Trustees at their Regular Meeting held on Wed., June 18, 2008: WHEREAS, DOUG KALULNA$ applied to the Southold Town Trustees for an Amendment to Wetland Permit #1068 under the provisions of Chapter 275 of the $outhold Town Code, the Wetland Ordinance of the Town of Southold, application dated May 28, 2008, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, in accordance with Chapter 268, said application was found to be Exempt from the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit #1068 to repair in-place a +~-35 section of existing bulkhead along the west end using plastic sheathing, and to seal a 42' section of bulkhead with 4"X 8" plastic sheathing, with the condition of a 10' non-turf planted buffer along the landward side of the bulkhead, and as depicted on the plan prepared by Doug Kalunas received on May 28, 2008 and stamped approved on June 18, 2008. That the said Board of Trustees and the Town of Southold are re/eased from any and all damages, or dalrn~ for damage% of suits ar/sing directly or indirectly as a result of any oper- ation performed pursuant to this permit, and the said Permit-tee will, at his or her own expmse, defend any and all such suits initiated by third parties, and the said Permittee assumes full ~i.hillty with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold 2. Trustee Bredemeyer: A1 talked to the applicant as we were leaving. We were trying to talk him into putting it in place. Then we could waiver the permit. think that it is immediately against. John Holzapfel, C.A.C.: We thought that it could be a waiver if it was in place. We were willing to go ahead with it. Trustee Bredemeyer: We were 'to, they did not want to proceed with that. Trustee Krupski: I think it was her feeling that she wanted to go into the creek. I see on the application if she goes in front of it she will not be coming in front of the existing adjacent bulkhead. · Trustee Bredemeyer: Right, we had the existing adjacent bulkheads jutting out. It was not below mean high water on that particular locus. Trustee KrUpski: I don't believe the water was lapping at it? · Trustee Bredemeyer: The C.A.C. did recommend approval on this application.
