Liability Policies in the Amount of The validity of this permit is or may be subject to the approval of other governmental or municipal authorities. The Town accepm no responsibility in applying for or obtainiog such approval. In the event that such approval is necessary, the holder of this permit shall not commence operations here- under until such approval, has been obtained in writing. The failure to obtain such other approval when required shall subject this permit to immediate revocation by the Trustees upon receipt by the Trustees. of written nod_ce from such other governmental or municipal authorities of its refusal or disapproval. The applicant does by the acceptance of this permit, assume all responsibility for operations under- taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons and property resulting from such operations. By such acceptance, the applicant also agrees to indemni- fy and save harmless the Town, and its officers, agents and employees from any and ail claims arising from operations under this permit and any and all acts or omissions of applicant, his agent and employees. The applicant and the owner and occupants of the premises upon which the operations authorized by l~[s permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and its officers and employees to enter upon t~he premises where such operations are being conducted make such inspections as the Town may deem necessary to insure that such operations are being con- ducted in conformity with this permit. Thi~ operation will not substantially: A. Adversely affect the wetlands of the town. B. Cause damage from erosion, turbidity or siltation. C. Cause saltwater intrusion into the fresh water resources of the town. D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege- tation or the natural habitat thereof. E. 'Increase the danger of flood and storm-tide damage. F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town. G. Change the course of any channel or the natural movement or flow of any waters. Box 728 Southold, New York 11971 January 26, 1988 Mr. Paul Kalunas Osprey Nest Road Box 384 East Marion, New York 11939 Re: Application No. 592 - 1000-35-6-28 Dear Mr. Kalunas: The following action was taken by the Board of Town Trustees during their regular meeting held on January 21, 1988 regarding the above matter. Moved by Trustee Krup~ki seconded by Trustee Smith WHEREAS, Paul Kalunas applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated May 6, 1987, and WHEREAS said application ~vas referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on January 21, 1988 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted 'concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general Welfare of the people of the town, NOW, THEREFORE, BE IT RESOLVED that Paul Kalunas BE AND HEREBY IS GRANTED PERMISSION UNDER THE PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN O~ SOUTHOLD TO: Construct a Bulkhead and Pilings abutting the existing bulkhead. This permit is approved Withthe provision that the structure is constructed no further into town bottom than the existing adjacent bulkhead. Property is located on Gull Pond, East shore, East Marion. Paul Kalunas Page 2. This permit will expire on January 21, 1990 if work has not commenced by said date. There are two inspections required and the Trustees are to be notified upon the completion of the work. Prior to the issuance of said permit by the Clerk, the applicant shall file with the Clerk a certificate that he has public liability insurance policies insuring against any liability which may arise in the performance of the operations pursuant to such permit in such amount as shall be fixed by the Trustees, which said policies shall name the Town as a name insured. Please take further notice that this declaration should not be considered a determination made for any other department or agency which may also have an application pending for the same or similar project. PLEASE REMIT $10.00 for Wetland Inspection fees. Upon remittance your permit will be forwarded by mail. PLEASE RETURN TO THE BUILDING DEPT. Planning Board Board of Appeals file 12-17-87 Page 2 DISCUSSION AND RECOMMENDATION OF WETLAND APPLICATIONS On a motion by John Holzapfel, seconded by Ralph Condit, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 593 submitted by Joseph Fischetti, Jr. for The Cove at Southold toconstruct a swimming pool, 10'x 14' equipment shed and concrete deck behind existing bulkheads and construct a gravel access road. The CAC disapprove because it is located within the wetlands area, its too low, located in an area which may be flooded during a storm. Suggest applicant reloate to higher ground. Main Bayview Road, Southold. Vote of Council: Ayes: Ail Motion carried. On a motion by Heather Tetrault, seconded by John Tuthill, it was RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland Application No. 590 submitted for John Keating by Patricia C. Moore to move existing house, rebuild residence, and convert house into garage. The CAC recommends disapproval because location is too close to the bluff. The DEC recommends a distance of 75', CAC feels applicant should follow DEC recommend- ation. Recommend application move project further from bluff. 19995 Soundview Avenue, Southold. On a motion by Ralph Condit, seconded by John Tuthill,it was RESOLVED to recommed to the Southold Town Trustees approval of Wetland Application No. 591 Submitted by En-Consultants, Inc. on behalf of Dr. Stanley Keating to construct a timber dock cOnsist- ing of a 4' x 32' fixed elevated (3.4' above grade of marsh)_. walk; 4' x 12' hinged ramp; 8' x 20' float secured by (2) 8" diameter pilings. Dock replaces previous structure destroyed by storms, deterioration, etc. Haywaters Road, Cutchogue. Vote of Council: Ayes: Ail Motion carried. On a motion by John Tuthill, seconded by Ralph Condit, it was RESOLVED to recommend To the Southold Town Trustees approval of Wetland Application No. 592 submitted by Paul Kalunas to construct bulkhead and pilings abutting existing bulkhead.
