Moved by Trustee Bredemeyer seconded by Trustee Krupski WHEREAS, John Kalimnios requested a WAIVER of the Wetland Ordinance to level the west side of his property and to construct a fence to create a play area for his children to consist of a 630 sq. ft. area, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding %rea, and WHEREAS, the Board has considered all the documentation submitted concerning this request, and WHEREAS, the Board made the following findings of fact: 1. By this request appellant requests a Waiver of the Wetland Ordinance Article II, Section 97-22 to level the west side of the yard area and to construct a fence to create a play area to consist of a 630 sq. ft. area. IN VIEW OF THE FOREGOING AND IN CONSIDERATION OF THIS REQUEST THE BOARD BY UNAMIOUS VOTE APPROVED THE REQUEST MADE BY JOHN KALIMNIOS WHEREAS, the project will not adversely affect the wetlands of the Town, nor weaken or undermine the lateral support of any lands in the vicinity, nor will adversely affect the health, safety and general welfare of the people-of the town.
