4.~ That this Permit should be retained indefinltely, or as long as the said Permit-me wishe~
to maintain the structure or project involved, to provide evidence to anyone concerned that auth-
orization was originally obtained.
5': That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Board.
6. That there will be no ,mreasonahle interference with navigation as a result of the wc~k
herein authorized.
7.. That there'ghall be no interference with the right of the public to pass and repaxs along
the beach between high and Iow water marks.
8. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the,
work shall cause un.reasonable obstrumon to free navigation, the said Permittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold. '

Dear Mr. JUst :
The following action was taken by the Board of Town Trustees
during their regular meeting held on March 23, 1989 regarding the
above matter:
WHEREAS, J.M.O. Consulting on behalf of Lambert Javelera applied
to the S0uthold Town Trustees for a permit under the provisions of
the Wetland Ordinance of the Town of Southold, application dated June
6, 1988, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on March 23, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
-the town,
NOW, THEREFORE BE IT
RESOLVED that J.M.O. Consulting ON BEHALF lambert Javelera BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Reconstruct single family dwelling, foundation and garage on property
located Equestrian Ave., Fishers Island, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the date of this notification. Two
inspections are required and the Trustees are to be notified u.Don
completion of said project.
Please take notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
Permit will be issued upon payment of the following fees:

Dear Mr. Greene:
Please be advised that this office has received a partial
application in the above referenced matter. We are quite
concerned about bank run-off during construction and excavation
near this bank which is near a creek and wetland area. We suggest the
use of hay bales on this site.
Pursuant to the Code of the Town of Southold, the Board of
Town Trustees will not act upon an application until it is deemed
complete by the submission of documentary proof that all other
necessary permits and approvals have been received.
Please keep this office informed of your progress in this
matter. We wish to be involved zn your environmental review
under the S.E.Q.R.A. Legislation.

Comments regarding the application of Frank & Antoinette Notaro
1. What are the sizes and drafts of the vessels that are to be
accommodated at the proposed dock? Please provide more detail to
justify the request to dredge to 4' below MLW.
2. Will any shellfish beds recognized as being important in
Town Creek be disturbed as a result of this activity? If so, to
what extent will the disturbance be, and what plans are there to
mitigate any adverse effects?
3. The proposed vessel is to large for the area.
4. Submission of a mitigated plan of the work to be done as
discussed by the Board with the agent and landowner.
