Consulting on behalf of Lambert Javelera applied to the S0uthold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated June 6, 1988, and WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and WHEREAS, a public hearing was held by the Town Trustees with respect to said application on March 23, 1989 at which time all interested persons were given an opportunity to be heard, and WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of -the town, NOW, THEREFORE BE IT RESOLVED that J.M.O. We are quite concerned about bank run-off during construction and excavation near this bank which is near a creek and wetland area. We suggest the use of hay bales on this site. Pursuant to the Code of the Town of Southold, the Board of Town Trustees will not act upon an application until it is deemed complete by the submission of documentary proof that all other necessary permits and approvals have been received. Please provide more detail to justify the request to dredge to 4' below MLW. 2. Will any shellfish beds recognized as being important in Town Creek be disturbed as a result of this activity? If so, to what extent will the disturbance be, and what plans are there to mitigate any adverse effects? 3. The proposed vessel is to large for the area. 4.
