DEED
THIS INDENTURE made the 27th day of December. 1985, between
North Fork Beach Condominium, a partnership existing under the
laws of the State of New York, having a place of business at 50
North New York Aver e, Huntington, New York, party of the first
part and Charles Tupper , residing at 9 Roberta Avenue ,
Farmingville, New Ark 11738, party of the second part:
That the party of the first part, in consideration of Ten
Dollars (510.00) lawful money of the United States; and other
good and valuable consideration, paid by the party of the second
part, does hereby grant and release unto the party of the second
c61p part, the heirs or successors and assigns of the party of the

lying and being at Southold, Town of Southold, Suffolk
County, New York, being known as Unit #41 as shown on

1350 Office on July 12, 1985, as Map No. 1199 and "Amended
p" Map of North Fork Beach Condominium filed December 11 ,

interest as tenant in common in the common elements of
d46YI.00' the Condominium described in the Declaration of
Condominium entitled, "North Fork Beach Condominium"
recorded in the Suffolk County Clerk ' s Office in Liber
9829 CP 142. The premises on which said condominium
has been created is situate, lying and being in the
Town of Southold. County of Suffolk and State of New
York, being bounded and described as follows:
BEGINNING at the corner formed by the intersection of
the southerly side of Sound View Avenue, with the
Northwesterly side of North Road, C.R. 27 ;
Running thence from said point or place of beginning
along the northwesterly side of Sound Road C.R. 27 ,
south 40 degrees 20 minutes 00 seconds West 333. 15 feet
to land now or formerly of Larsen;
Running thence along said land and along lands now or
formerly of Czech, Kempner and Main, North 16 degrees
15 minutes 00 seconds West 351.97 feet to the southerly
side of Sound View Avenue and running thence along the
southerly side of Sound View Avenue the following 2

feet to the corner aforesaid, at the point or place
of beginning.
Together with the appurtenances and all the estate and rights of
the party of the first part in and to said premises.
TOGETHER with the benefits, rights, privileges, easements
and subject to the burdens, covenants, restrictions, by-laws,
rules, regulations and easements all as set forth in the
Condominium Documents filed and recorded as aforesaid.
SUBJECT to: The provisions of the Declaration, By-Laws site
plan and floor plans fo the Condominium recorded or filed
simultaneously with and as part of the Declaration as the same
may be amended from time to time by instruments recorded or filed
in the Suffolk County Clerk' s Office, which provisions, together
with any amendments thereto shall bind any person having at any
time any interest or estate in the unit , as though such
provisions were recited at length herein.
TO HAVE AND TO HOLD the premises herein granted unto the
party of the second part, the heirs or successors and assigns of
the party of the second part forever.
AND the party of the first part covenants that the party
of the first part has not done or suffered anything whereby the
said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section
13 of the Lien Law, covenants that the party of the first part
will receive the consideration for this conveyance and will hold
the right to receive such consideration as a Trust Fund to be
applied first for the purpose of paying the cost of the
improvement and will apply the same first to the payment of the
cost of the improvement before using any part of the total of the
same for any other purpose.
The use for which the Unit is intended is that of a unit in
a motel, subject to the applicable governmental regulations and
zoning ordinances of the Town of Southold and the restrictions
contained in the Declaration.
This conveyance is made in the regular course of business
actually conducted by the party of the first part.
