Trustees of the Town of Southold (hereinafter the "Trustees")pursuant to Chapter 275 of the
Town Code of the Town of Southold or its successor,and various activities conducted upon the
property may thus be subject to the regulation and approval of the Trustees prior to being
conducted;
WHEREAS,the DECLARANT(S)therefore made application to the Trustees for a permit
pursuant to the Wetlands Law of the Town of Southold to undertake certain regulated activities;and

regulated activities, the Trustees required that the storm eroded embarkment landward of the
bulkhead be backfilled with 150 cubic yards of clean fill, planted with native vegetation and

WHEREAS, the DECLARANT(S) has considered the foregoing and has determined that the

same will be in the best interest of the DECLARANT(S)and subsequent owners of the property;
NOW, THEREFORE, the DECLARANT(S) do/does hereby covenant and agree as
follows:
1) Upon the substantial completion of the aforementioned permitted activities there
shall be established and subsequently maintained a"non-turf buffer"as defined by
Chapter 275 of the Town Code; and as depicted on the site plan prepared by En
Consultants last dated April 5's, 2013 and stamped approved on May 15, 2013,
annexed hereto as Schedule"B";and
2) These covenants shall run with the land and shall- be binding on the
DECLARANT(S),his/her/their heirs,assigns,purchasers,or successors in interest and

BEGINNING at a concrete monument set at the southeast corner
of land heretofore conveyed by W. Harry Lister to Henrietta

Dear Mr. Herrmann:
The following action was taken by the Southold Town Board of Trustees at their Regular
Meeting held on Wednesday, May 15, 2013:
WHEREAS, En-Consultants on behalf of JONATHAN BECKER & ANN MARIE
GRECO applied to the Southold Town Trustees for an Amendment to Wetland Permit
#363 under the provisions of Chapter 275 of the Southold Town Code, the Wetland
Ordinance of the Town of Southold, application dated April 23, 2013, and,
WHEREAS, said application was referred to the Southold Town Conservation Advisory
Council and to the Local Waterfront Revitalization Program Coordinator for their findings
and recommendations, and,
WHEREAS, the LWRP Coordinator issued a recommendation that the application to
construct approximately 66 linear feet of vinyl bulkhead in-place of existing timber
bulkhead; and backfill/re-nourish storm eroded embankment landward of bulkhead with
approximately 150 cubic yards of clean fill to be planted with native vegetation and
maintained as a non-turf buffer was found to be Consistent with the Local Waterfront
Revitalization Program policy standards, and,
WHEREAS, the LWRP Coordinator recommended that the proposed application to
reconstruct existing ±3'x28' walkway and 7'x8' deck behind bulkhead; reconstruct

existing 3'x13' steps with platform to beach; and maintain existing 3'x28' stairway with
landings down embankment was found to be Inconsistent with the LWRP, and,
WHEREAS, the Board of Trustees has furthered Policy 6.3 of the Local Waterfront
Revitalization Program to the greatest extent practical through the imposition of the
following Best Management Practice requirements: the issuance of a permit on
structures; small 7'x8' platform on east side of property is not attached to stairs
therefore should not be added to the total square footage of Inconsistent structure; and,
WHEREAS, the structure complies with the standards set forth in Chapter 275 of the
Southold Town Code, and,
WHEREAS, the Board has determined that the project as proposed will not affect the
health, safety and general welfare of the people of the town,
NOW THEREFORE BE IT,
RESOLVED, that for the mitigating factors and based upon the Best Management
Practice requirements imposed above, the Board of Trustees deems the action to be
Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5
of the Southold Town Code, and,
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVES the Amendment to
Wetland Permit#363 to construct approximately 66 linear feet of vinyl bulkhead in-place
of existing timber bulkhead; reconstruct existing ±3'x28' walkway and 7'x8' deck behind
bulkhead; reconstruct existing 3'x13' steps with platform to beach; maintain existing
3'x28' stairway with landings down embankment; and backfill/re-nourish storm eroded
embankment landward of bulkhead with approximately 150 cubic yards of clean fill to be
planted with native vegetation and maintained as a non-turf buffer, and as depicted on
the site plan prepared by En-Consultants, last dated on April 5, 2013, and stamped
approved on May 15, 2013.
BE IT FURTHER,
RESOLVED, that the Southold Town Board of Trustees APPROVE the request for a
Transfer of Wetland Permit#363 from Jacqueline Grassi to Jonathan Becker &Ann
Marie Greco, as issued on October 30, 1986.

At the meeting of the Southold Town Conservation Advisory Council held Wed., May 8,
2013 the following recommendation was made:
JONATHAN & ANNAMARIE GRECO BECKER to Amend Wetland Permit #363 to
authorize the construction of approx. 66 If. of vinyl bulkhead in place of existing storm
damaged timber bulkhead; construct 3' wide landing and steps to beach in place of
existing storm damaged structures; reconstruct storm damaged T wide wood walkway
and TX 8' deck behind bulkhead; and backfill/renourish storm eroded embankment
landward of bulkhead with approx. 150 cy. of clean fill to be planted with native vegetation
and maintained as a non-turf buffer.

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing.The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon recejpt by the
Trustees of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit,and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations.By such acceptance,the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
this permit are being conducted,do, by the acceptance of this permit,give consent to the Town,and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit. _
This operation will not substantially:
A. Adversely affect the wetlands of the town.
B. Cause damage from erosion,turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish,shellfish or other beneficial marine organisms,aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other lands in the vicinity.
1. Otherwise adversely affect the health,safety and general welfare of the people of the town.

Wetland Permit#363 from Jacqueline Grassi to Jonathan Becker&Ann Marie Greco, as issued on
October 30, 1986; and for an Amendment to Wetland Permit#363 to construct approximately 66 linear
feet of vinyl bulkhead in-place of existing timber bulkhead; reconstruct existing ±3'x28' walkway and
7'x8' deck behind bulkhead; reconstruct existing 3'x13' steps with platform to beach; maintain existing
3'x28' stairway with landings down embankment; and backfill/re-nourish storm eroded embankment
landward of bulkhead with approximately 150 cubic yards of clean fill to be planted with native
vegetation and maintained as a non-turf buffer. Located: 4718 Great Peconic Bay Boulevard, Laurel.

The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of
Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards.
Based upon the information provided on the LWRP Consistency Assessment Form submitted to this
department, as well as the records available to me, it is my recommendation that the proposal to
construct approximately 66 linear feet of vinyl bulkhead in-place of existing timber bulkhead
and backfill/re-nourish storm eroded embankment landward of bulkhead with approximately 150
cubic yards of clean fill to be planted with native vegetation and maintained as a non-turf buffer
is CONSISTENT with the LWRP.
Further, it is my recommendation that the proposal to reconstruct existing ±3'x28' walkway and 7'x8'
deck behind bulkhead reconstruct existing 3'x13' steps with platform to beach; maintain
existing 3'x28' stairway with landings down embankment is INCONSISTENT with LWRP Policies
6.3 (below) and therefore, INCONSISTENT with the LWRP.
6.3 Protect and restore tidal and freshwater wetlands.
A. Comply with statutory and regulatory requirements of the Southold Town Board of
Trustees laws and regulations for all Andros Patent and other lands under their
jurisdiction
1. Comply with Trustee regulations and recommendations as set forth in Trustee
permit conditions.
The above noted structures were constructed without Board of Trustees review or
permit.
Further, the proposal to reconstruct existing 13'x28' walkway and 7'x8' deck
behind the bulkhead is not a permissible action. The proposed decking would
equal 140 sq. ft and 275-11 Construction and operation standards regulations
limit the decking size to 100 sq. ft. All other platforms must be located landward
of the top-of- bluff.
Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its
written determination regarding the consistency of the proposed action.

The above referenced permit was issued to Jacqueline Grassi on January 29, 1987 to reconstruct
a timber bulkhead and to backfill at the above referenced property. Please accept this letter and
attached application as a request to transfer said permit to the current owner of record, Jonathan
and Annamarie Greco Becker, whose address is 628 76th Street, Brooklyn, NY 11209, and to
amend the permit to authorize the replacement of the current bulkhead and adjacent structures
that were damaged during Hurricane Sandy, as depicted on the attached project plans. We
previously submitted a request that the work be authorized by the Hurricane Sandy Emergency
Permit but were advised this was not immediately possible without the prior permit having ever
been transferred to the current owners.
Enclosed for your review is a Letter of Request for an Amendment, three (3) copies of the
project plan, and fee of$100.

The project seeks to replace an existing timber bulkhead damaged during Hurricane Sandy with a vinyl bulkhead in the same location to
maintain the property's historical method of shoreline stabilization. The existing property has been improved with and supported and
protected from flooding and erosion by a bulkhead since prior to 1977,and there is no viable non-structural alternative means of
maintaining and protecting the upland portion of the property in its current location. Without replacement and maintenance of the
bulkhead,the subject and adjacent, similarly bulkheaded properties would be exposed to severe erosion,flooding,and damage to the
residential sttvclures located thereon. Therefore the project is consistent with Policy 4.

The validity of this permit is or may be subject to the approval of other governmental or municipal
authorities. The Town accepts no responsibility in applying for or obtaining such approval. In the
event that such approval is necessary, the holder of this permit shall not commence operations here-
under until such approval has been obtained in writing. The failure to obtain such other approval when
required shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees. of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of injuries to persons
and property resulting from such operations. By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and ail claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises upon which the operations authorized by
mis permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
its officers and employees to enter upon the premises where such operations are being conducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.

B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vege-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town,

The following action was taken by the Board of Trustees during
their regular meeting held on January 29, 1987 regarding the above
matter. -~
WHEREAS, The Land Use Company on behalf of Jacqueline Grassi applied
to the Southold Town Trustees for a permit
under the provisions of the Wetland Ordinance of the Town of
Southold, application dated October 10, 1986 and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a public hearing was held by the Town Trustees with
respect to said application on January 29, 1987 at which time all
interested persons were given an oppgrtunity to be heard, and
WHEREAS, the Board members have personally ~iewed and are
familiar with the premises in question and the surrounding area, and
k~EREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town~
NOW, THEREFORE, BE IT
RESOLVED that the Land Use Company on behalf of Jacqueline Grassi
BE AND HEREBY IS GRANTED PERMISSION UNDER THE
PROVISIONS OF THE WETLAND ORDINANCE OF THE TOWN OF SOUTHOLD TO: reconstruct
within 18" approximately 70' of timber bulkhead and to backfill said
structure with approximately 25 cu.yds, of clean sand to be trucked
in from an upland source. Property is located on Peconic Bay Blvd., Laurel.

the Trustees are to be notified upon the completion of the work~

insurance policies insuring against any liability which may arise
in the performance of the operations pursuant to such permit in such
amount as shall be fixed by the Trustees, which said policies shall
name the Town as a name insured. Please take further notice that
this declaration should not be considered a determination made for
any other department or agency which may also have an application
pending for the same or similar project.
A $10.00 Wetland Inspection Fee is now due and payable. Upon
