Jerk FINDINGS,DELIBERATIONS AND DETERMINATION MEETING OF FEBRUARY 16,2017 ZBA FILE# 7026 NAME OF APPLICANT: Areti LaValle PROPERTY LOCATION: 555 Soundview Ave, Orient NY SCTM 1000-15-3-7 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 27, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated January 30, 2017. Based upon the information provided on the LWRP Consistency Assessment Form submitted as well as the records available, it is the coordinator's recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. SUFFOLK COUNTY SOIL AND WATER CONSERVATION DISTRICT (SWCD): This application was referred for an evaluation and recommendation. According to a letter from the agency, dated February 1, 2017, an inspection of the property was conducted on January 4, 2017. The agency technician observed areas of the bluff as highly unstable in areas of water sprinkler installation, and in some areas erosion was apparent. It was recommended, in order to maintain bluff stability, that excavation and construction equipment not to be stored or left running in proposed construction area, additional rooftop stormwater contribution be installed to divert run off away from bluff face, and re-vegetative planting for bluff stabilization. Landscape debris needs to be removed and bluff should be regularly inspected and immediately repaired especially after storm events. PROPERTY FACTS/DESCRIPTION: The parcel is a non-conforming 26,355 square foot waterfront parcel located in an R-40 Zoning District. The parcel measures 100 feet along the Long Island Sound to the north, measures 100 feet along the southerly property line fronting Soundview Avenue , 268.14 feet on the along the westerly property line and265.48 feet along the easterly property line The property is improved with a two story frame dwelling, an attached garage and rear porch As shown on a survey prepared by Paul Barylski, LLS dated November 5, 2016. Page 2,February 16,2017 #7026,Lavalle SCTM No. 1000-15-3-7 BASIS OF APPLICATION: Request for a Variance under Article XXI1, Section 280-116A; and the Building Inspector's November 16 2016, Notice of Disapproval based on an application for a permit to construct additions and alterations to an existing single family dwelling at: 1) proposed additions and alterations located less than the code required 100 feet from the top of the bluff; located, at: 555 Soundview Avenue, (Adj. to Long Island Sound) Orient,NY. SCTM# 1000-15-3-7. RELIEF REQUESTED: The applicant requests a variance to make additions and alterations to an existing house that will result in a bluff setback of 67.5 feet where code requires a 100 foot setback. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on February 2, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s)will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes. The proposed second story addition will make the subject dwelling consistent in size with other homes in the area. Other non-conforming bluff setbacks exist in the subject neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing two story residence has a non-conforming setback from the bluff. Any additions and alterations on the seaward side of the dwelling will require the benefit of an area variance. 3. Town Law &267-b(3)(b)(3). The variance(s) granted herein is mathematically substantial, representing 32.5% relief from the code. However, the existing structure has a non-conforming bluff setback which the proposed additions and alterations will not change. . 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Additionally,the Suffolk County 'Soil and Water Conservation District has made recommendations regarding the proposed construction in order to prevent further destabilization of the bluff face, which have been included in the conditions required for this variance relief . 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Horning, and duly carried,to Page 3,February 16,2017 #7026,Lavalle SCTM No. 1000-15-3-7 GRANT the variance as applied for, and shown on the Architectural plans prepared by Charles M. Thomas, Architect, labeled A-1-5 and dated July 14, 2016 and survey prepared by Paul Barylski, LLS dated November 5, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Approval by the Town of Southold Board of Trustees, as required. 2. In Accordance with Suffolk County Soil and Water Conservation District recommendations: a) Excavation and construction equipment not to be stored or left running in proposed construction area. b) Irrigation sprinklers located along the top of the bluff should be disconnected. c) Additional rooftop stormwater contribution fitted with downspouts where necessary and diverted away from bluff face and into drywells in order to reduce surface water flow to the bluff face. d) Re-vegetative planting as recommended for bluff stabilization according to recommendations of SWCD. e) Removal of landscape debris. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new,application and public hearing before the Zoning Board of Appeals. This evaluation of the property located at 555 Soundview Avenue, Orient was conducted on January 4, 2017. The following are the observations and recommendations respective of the findings of this inspection. At the time of the visit the property upland of the bluff appeared to be in stable conditions. The ground is covered in turf grasses and there are no obvious signs of erosion evident. The home is fitted with gutters and downspouts which discharge onto the surface. The yard is equipped with an in-ground sprinkler system with overhead sprinklers. Some of the sprinkler heads run along the top of the bluff. . The bluff is highly unstable. To the east of the stairwell, signs of gully erosion are evident and the face of the bluff completely lacks vegetation. Looking to the west side of the stairwell, similar signs of erosion are evident, severely lacking vegetation, landscaping debris has been deposited, and there is overhanging vegetation along the top of the bluff where a scarp has formed. Excavation and construction equipment should not be stored or left running on the proposed construction area due to the fact that the heavy weight and vibrations of these machines may cause instability atop the bluff. Water running over the bluff face is a catalyst of erosion. Therefore, Irrigation sprinklers located along the top of the bluff should be disconnected. At this time I do not, recommend removing them considering the high level of instability of this bluff. Accordingly, any additional rooftop stormwater contribution should be considered and fitted with downspouts where necessary. All downspouts should be diverted away from the bluff face and into drywells in order to reduce surface water flow to the bluff face. The toe, face, and top of the bluff shows sign of severe erosion, therefore structures atop the'bluff will be compromised if bluff stabilization is not attained. Prior to planting, a natural angle of repose or proper slope should be obtained as the first step towards stabilizing this bluff. All exposed (unshaded) bare soils around the stairway should be seeded. The bluff face needs to be revegetation with the proper vegetation. Landscape debris needs to be removed. Finally, the bluff should be regularly inspected and immediately repaired especially after storm events.
