NOVELLI 1100 ISLAND VIEW LANE, GREENPORT SCTM# 1000-57-2-42.4 Dear Mr. Herrmann: The Southold Town Board of Trustees reviewed the survey prepared by Gary Benz, L.S., dated November 24, 2015, and performed a field inspection on November 9, 2016, and determined that the entire property, and the proposed construction of a single family dwelling and appurtenances on the captioned vacant parcel, are out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Area (Chapter 111) no Trustee permit is required. Please be advised, however, that no clearing, no removal of vegetation, no cut or fill of land or removal of sod, no construction, sedimentation, or disturbance of any kind may take place within 100' landward from the top of the bluff, or seaward of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the coastal erosion hazard area as indicated above, without further application to, and written authorization from, the Southold Town Board of Trustees pursuant to Chapter 275 and/or Chapter 111 of the Town Code. It is your responsibility to ensure that all necessary precautions are taken to prevent any sedimentation or other alteration or disturbance to the ground surface or vegetation within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result 2 from your project. Such precautions may include maintaining adequate work area between the tidal wetland jurisdictional boundary and the coastal erosion hazard area and your project or erecting a temporary fence, barrier, or hay bale berm. I understand that this is the way most NJ letters are written because 95%of the time some portion of the property is in fact located within 100 feet of wetlands, meaning that other proposed work could require a permit. But here the Trustees confirmed that the entire property is in fact located more than 100 feet from wetlands and is thus located in its entirety outside Chapter 275 jurisdiction. Therefore,would you kindly confer with Jay and/or Mike to see if the letter could be modified to reflect the fact that the entire property is outside Ch. 275 jurisdiction and thus any activities proposed within the confines of the property are exempt from Chapter 275 permit requirements?
