That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application, umy be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. & That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Snothold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstrumon ro free navigation, the said Petmittea will be requimd~ upon due notice, to remove or alter this work or project herein stared without expenses to the Town of Southald. 8. That the said Board will be notified by the Permktee or the completion of the w~rk anth- nrlzed. 9. New York 11971 Fax 1516) 765-1823 Telephone (516] 765-1800 February 26, 1990 Stephen Lupow 315 Walt Whitman Road Huntington Station, NY 11746 Re: App. No. 1-16-90-9-3-1 Dear Mr. Lupow: The following action was taken by the Board of Town Trustees during its regular meeting held on February 22, 1990 regarding the above matter: WHEREAS, Stephen Lupow on behalf of Hay Harbor Club applied to the Southold Town Trustees for a permit under the provisions of the Wetland Ordinance of the Town of Southold, application dated November 7, 1989 and, WHEREAS said application was referred to the Southold Town Conservation Advisory Council for their findings and recommendations, and, WHEREAS, a public hearing was held by the Town Trustees with respect to said application on February 22, 1990 at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW, THEREFORE BE IT RESOLVED THAT STEPHEN LUPOW ON BEHALF OF HAY HARBOR CLUB BE AND HEREBY IS GRANTED PERMISSION UNDER THE WHTLAND ORDINANCE TO: Demolish an existing bathhouse and replacement of same. This permit will expire two years from the date it is si~ae~, if work has not commenced by said date. Fees must be paid, if applicable, and permit issued within six months of the date notification. Two inspections are required and the Trustees are to be notified upon completion of said project. Please return to the Building Department for a determination on the need for any other permits which may be required for this l~roject. The US Army Corp indicated that t~re is ~o necessity to obtain a permit from them under the Na~o~wi~el Plermlt Act 33 CFR ~330.5.
