part of the consideration for the issuance of the Permit does understand and.prescribe to the fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any a~d
all damages, or elaim~ for damages, of suits arising directly or indirocrly as a result of any ope. r-
adon performed pursuant to this permit, and the said Permit*ee will, at his or her own expeme,
defend any and all such suits initiated by third parties, and the said Permittee assumes full liability
with respect thereto, to the complete exclusion of the Board of Tntstees of the Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to cotoplete the work involved, but should circumstances warrant, request
for an extension toay be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to toaitoain the structure or project involved, to provide evidence to anyone concerned that auth-
orizatmn was originally obtained.
4. That the work involved will be subject to the inspection and approval of the Board or
its agents, and non-cotopHance with the provisions of the originating application, may be ea,,~e for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or fi, in the opinion of the Board of Trustees, the
work shall cause unreasonable obstruction to free navigation, the said Permit'tee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permittee oI the completion of the work auth-
orized.
9. That the Permittee wilt obtain all other permits and coments that may be required sup-
pletoental to this permit which may be subject to revoke upon failure to obtain same.

RE: Hay Harbor Maintenance Dredging
Permit No. 3971 Amendment
AS mentioned during my recent telephone call to your office, the Hay
Harbor Club on Fishers Island, New York, desires to resume dredging of the
entrance channel into Hay Harbor. This is covered under Town Permit No. 3971,
amended by your office in August last year.
There is a condition in the New York State DEC Pexmit which requires
dredging to be complet~ by March 15, of each calendar year. However, due to
economic concerns and the previously scheduled contracts and con~i.~nts of the
dredge company~ Gwenmore Marine Dredging of Mystic, CT, dredging will not be
able co commence until April cf this year. It is requested by the Hay Harbor
Club that your permit be extended an additional year and that dredging be
specifically allowed up until May 31, 1993 for the followlng reason. The March
15th deadline was issued in order to avoid physical disturbance of the nesting
s~tes on stony Beach used by Oyster Catchers and Terns as welt as the Sea Gulls
and Cormorants wh/ch already frequent the island. As you know, during last
year's dredging operation which began in April and continued through May 31st,
an alternative disposal site was utilized~ that being the Fishers Island Power
Company site on West Harbor. It is intended that the same disposal point will
be used again this year since there is salvage value to the dredge materials
and this scope of work is not appreciably different or more costly than
disposal on Stony Beach. Since there will be no physical interference with the
nesting of the referenced bird species it is requested that this extension be
granted. I transmit herewfth, a copy of each of the respective permits for
your reference.
I trust that you will find this request complete and acceptable and look
forward to receipt of a permit amendment. If the need for further discussion
arises, please call me at your earliest convenience.

Hay Harbor Dredging Modifications
Dear ~ir. Bredemeyer:
Confirming our conversation last month, I offered the following
supplemental information for the dredge projec~ of Hay Harbor entrance channel
on Fishers Island, New York. ~ork was physically c~plete on the northerly
half of tile channel on ~y 31~ 1992; it is estimated approximately 60% of the
dredging is complete at this time. The dredged channel is slightly wider than
intended~ approximately ~0 to 50 feet in width, instead of the 30 ~o ~0 foot
width proposed on the application documents. The reason for this ~s that
during the process of dredging~ the 30 to 35 foot wide bargas occupied
virtually the entire width and depth of the channel~ causing water ~o flow
around the edges of the barge with increased rapidity and turbulence° ~nis
scouring action along ~ae edges and beneath the barge caused sand 5o erode from
the banks and fill in the channel do~alstream of the barge~ requiring additional
materials 5o be dredged, thus causing the over run.
At this point, the northerly half of the channel is complete. It ~s
estimated that an additional ~00 yards (+/-) will be removed fr~ the southerly
half of the channel %~en dredging reconvenes ~n ~e fall; 900 yards of material
has been r~oved so far from ~he channel.
It is respectfully requested that an ~endment to Tow~ Permit No. 3971 be
issued for this a~ditional vol~e of work~ raising the permitted volume fr~
!000 +/- CY to 1500 +/- CY~ Your assistance is appreciated~ please let ~e know

The following action was taken by the Board of Town Trustees during
its regular meeting held on January 16, 1992 regarding the above
matter:
WHEREAS, DOCKO, INC. ON BEHALF OF HAY HARBOR CLUB applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated March 1,
1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations~
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on January 16, 1992 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the psople of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT DOCKO, INC. ON BEHALF OF HAY HARBOR CLUB BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
maintenance dredge the entrance channel into Hay Harbor approximately
1,000. c.y. to depth of 4' at MLW.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.

Supplemental Information
Dear Mr. Barbosa:
In accordance with our most recent conversation two weeks ago, I have
completed assembly of the supplemental information requested by your office and.
suk~it it herewith for your review.
First of all, the scope, of work and disposal method have been changed. The
plans have been revised to show the new proposed method of dredging, that being
clamshell bucket, for upland disposal on Stony Beach. This approach was
suggested by the NYS DEC during a joint site inspection conducted earlierthis
sum~er. Approximately 1,000 CY of fine sand will be dredged from the channel,
placed on a deck barge for transportation to the southerly end of Stony Beach
shown on the revised Plan View, and then lifted across the crest and deposited
on the Sound side. The void ratio of Stony Beach is substantial, on the order
of 30%, being cc~prised of cobbles and boulders, and it will allow virtually
all of the sand to seep inuo these voids relatively quickly, possibly within a
few months depending on the amount of rain we have this fall. This technique is
shown on the new Sheet 4 of the application drawings. Two sets of the revised
drawings are enclosed.
Attached ere the test results from the Bulk Sediment Analysis conducted on
a cc~posite sample of ~naterial from the proposed dredge areas; as you can see,
this is clean maEerial. Although the mercury content is slightly above Class I
limits, upland disposal seems reasonable, and is considered acceptable and
appropriate by the DEC. The owners of Stony Beach, the wilmerding Family, have
reviewed this information and agreed to the project so long as the DEC and the
Fishers Island Conservanc} are apprised and any imposed restrictions are
adhered to, and we certainly agree with this approach.
Finally, we checked with the Suffolk County Board of Health, Dr. Robert
Nuzzi, regarding spills and discharges in Hay Harbor; they have no records of
any spills in the harbor.

WORK SEQUENCE AND SCHEDULING REQUEST
APPLICATION DATE: March 31, 1991
APPLICANT: Hay Harbor club
The project, as proposed, calls for the re~aoval of 5,000 +/- cubic yards
(CY) of sand which has acreted across the narrow entrance to Hay Harbor on
Fisher's Island, NY. It is anticipated that the material will be dredged using
a clam shell bucket and dumped at the New London open water disposal area
located about 2.2 miles to the west of the site. Because of budgetary
limitations, it is not likely that the entire project can be accomplished in
one year; this project must be phased. Initially, sand will be dredged frcm
the two highest priorty areas shown on the application drawings as sections
III and IX. Area III is a sand spit that is clearly visible in the aerial
photograph toward the northerly end of the channel. Area IX is the shallow
and narrow area at the southerly ~end of the charnel. This first phase will
include removal of approximately 1,600 CY of material. The channel shown on
the application drawings is slightly different than the currently marked
channel. Deviations have eviden~!y occurred due to the shifting nature of the
Sand bar.. The new channel is situated to take advantage of naturally deeper
sections of the e×isting channel and stakes will he relocated to mark the new
alignment_ The course of the channel may continue to shift and future
maintenance dredging will be laid ou~ so as to follow the natural alignment.
The justification for this project is two-fold: first to improve tidal
flushing characteristics of the h~arbor and thus improve water quality, and
secondly to open the channel for improved access for beating. In order to
realize the maximum benefit of this project, by achieving these two
objectives, and because of the small amoun~ of material that will be
disturbed, it is respectfully requested that this first phase of dredging
(1,600 CY) be approved to allow work through the end of June 1991. The
r~nainder of the work can and will be done in accordance with; customary
seasonal limitations and as funds become available. The application documents
outline the full scope of work envisioning that all dredging will be
accomplished during the life of the permits. Because of the constant acretion
of sand across the mouth of the harbor, it is also requested that maintenance
dredging be permitted as needed in the future.
During the initial coordination of this pro]ect with the US Army Corps
of Engineers, NYS DEC, Suffolk County and the Town of Southold, it became
clear that alternative dredging techniques would not be acceptable but that
dredging by clamshell bucket would be. The only rig in the area that can work
in such a narrow, shallow channel is operated by Gwenmor Marine Dredglng in
Mystic, CT. The barge width is 25 feet and minimem draft of the tug is 6 feet.
In order to do the work within the budget allotted, the first phase will have
to be done at favorable tides and a~ about one-third of the barges capacity at
which point the barge and uug have the same draft.
