Dear Mr. Harvey,
The following action was taken by the Board of Town Trustees
during its regular meeting held on ~ 2~, 1995 regarding the
above matter:
WHEREAS, Alexander Harvey, II, applied to the Southold Town
Trustees for a permit under the provisions of the Wetland
Ordinance of the Town of Southold, application dated March 24,
1995, and,
WHEREAS, said application was referred to the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with
respect to said application on May 25, 1995, at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
and,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, and,
WHEREAS, the structure complies with the standard set forth in
Chapter 37-18 of the Southold Town Code, which will be listed on
a separate page, and,
WHEREAS, the Board has determined that the project as proposed
will not affect the health, safety and general welfare of the
people of the town,
NOW THEREFORE BE IT,
RESOLVED, that the BOard of Trustees approves the application of
ALEXANDEK HARVEY, II, to regrade top of bluff in approx. 900
s.f. area to create more stable slope angle, install erosion
control mat, seed and plant to re-vegetate area, underpinning
approx. 24 1.f. of existing foundation at corner of house,
install drain line to redirect existing roof runoff to land side
of house. Located: off East End Road, Fishers Island.
Permit to construct project will expire two years from the date
it is signed. Fees must be paid, if applicable, and pe~it
issued within six months of the date of this notification.
Two inspections are required and the Trustees are to be notified
Upon comPletion of sald project.

Gentlemen:
With further reference to the application submitted byme with
my letter of March 21, 1995 in connection with a minor grading
project at Fishers Island, I am informed that you would like to
have as a part of your file the permit papers issued by the New
York State Department of Environmental Conservation (the ,DEC").
Accordingly, I am enclosing copies of the following:
(1) Letter to me dated March 16, 1995 from
Environmental Analyst Kevin Kispert;
(2) DEC Permit;
(3) General Conditions, Special Conditions and
Supplementary Special Conditiohs;
(4) construction papers to be submitted by the
contractor for ~his work~ and
(5) Notice to be posted at the project site.
I would appreciate it very much if you could expedite your
consideration of this application. A contractor is awaiting your
action so that the work can be started immediately. To avoid
further erosion as a result of spring and summer rain, it is
necessary that the grading and planting be done this spring.

minor grading project at my summer home on Fishers Island.
hereby request waiver from the full application process. As
indicated by the enclosed documents, this is a minor project which
would have no environmental impact if implemented.
Enclosed herewith are the following:
(1) Check in the amount of $40 representing the
waiver fee;
(2) Executed and notarized application form;
(3) Three copies of survey of property;
(4) Three copies of plan and specifications
for proposed bluff stabilization.
I would appreciate it if the Board of Trustees would consider

SPECIFICATIONS FOR BLUFF STABILIZATION
General Conditions
· Ail work on the bluff is lo be performed in such a way as to
minimize disturbance to the blug soi~ and existing vegetation and
to ensure continuing stability of the bluff All work performed on
the bluff shall be done by hand labor, with the exception of
exravalion which can be performed front a stable point above the
edge of the bluff. Foot tragic and movement of malerials on the
bluff is to be minimized, particularly in the area of existing
vegetation, and during planting of new vegetation.
Grade area as shown on plan and delails to achieve a l(v):l.5(h)
slope.
Installation of Tensor Erosion Mat TM-3000:
Site Preparation
Smooth grade and compacf all areas to bo covered wgh rnal
Remove ail rocks, dirt clods, vegetation, Irash, and other
obstructions that may cause mat to bridge ground surfaco
Incorporate slew release 5-20-~0 fertilizer into top 3" of soil at
tare of 25 lbs/1000 sq. It
Anchor Trenches

before placing mat.

Mat Placement
Unroll mat flat side against the ground, parallel to dgecfion of

erosion underneath
Beginning aI the uphill end, bury transverse terminal end of mat
secure and prevent erosive flow underneath, using Terminal End
Trench (Figure 3) Mat shall start 2-3' above the crest el s~eep
slopes or at edge of house foundation and extend to edge of
existing vegetalion below slumped area.

4).

Use continuous run of matting for each vertical section. Do not
'splice' shorter sections.
Overlap adjacent edges of mat by 3" (min.) and anchor - see
"Ground Fastening" (Figure 6).
Ground Fastening
Use heavy duty pins, U shaped wire staples, or poly ethylene pegs
for anchoring mat to the ground surface. Metal pins should be 3/16"
diameter steel with a 1-1/2" diameter steel washer secured at head
of pla. Wire staples should be a m~mmum of 8 gauge. All anchors
should be 18" tong,
Ground fasteners different from those mentioned here may be used if
approved by manufacturer of mat and by Projec~ Engineer Care
must bo taken to assure that fasteners hem mat securely at the
surface and have sufficient ground penetration to resist pullout. DO

· Fo begin, secure each roll end with anchors 2-1/2' apart (3 per 5'

As mat is roiled out. secure it to the ground on 3 foot centers, To
assure 9round conformity, add extra anchors around obstacles er
depressions in ground surface where mat may bridge. Use staple
pattern shown in Figure 8. Steel pros, wire staples and plastic
pegs should be driven flush to ground surface,
In all transverse check slots, anchor each roll at 2-1/2' intervals
before backfilling and compactglg (Figure 4)

PLANTING/SEEDING MATERIALS
Plant the following grasses and woody materials. Choice of grasses
will depend on the time Ihe planting work will be done.
1. Grasses:
Cool Season Planting (before April 15 or after Oct. 15):
Plant American Beach Grass (Ammophila brevigulata)
80% Cape May variety
20% Native Species
Plant in clumps of 3-5 cuhns, clumps spaced 18' o.c. Culms to be
planted 6" deep.
Warm Season Planting (late spring - early summer):
Seed with the followin9 mix (percentages by weight of Pure Live
Seed) at the rate of 6 oz./~000 sq. ft.:
25% Atlantic CoAstal Panic Grass
25% Blackwell Switchgrass
25% Bi9 Bluestem 'Niagara'
25% AIdous Little Bluestem
Weeping bovegrass or Goldstrfke Sand Lovegrass at the rate of 1,1
az/1000 sq, g. (3 lbs./acre).
2. Shrubs/Vines (warm or cool planling season):
Plan~ 20 Rosa rugosa on along edge of lawn on each side of regr~ded
area (10 each side), 2-3 fl. o.c, in staggered row to form loose
hedge
Plant 4~ Rosa wichuriana, appro× 4-5' o.c in area covered by
Plant 6 Myrlc& pennsylvanica in two clumps of 3 ea. in lower 2/3 of
area covered by erosion mat. PlAnts within clump to be 2-3' o.c.
SPOT EROSION CONTROL AND PLANTING:

smooth surface for sheet flow of runoff, Depending on season.

NOTE:
The work shown on these plans is intended to stabilize the upper
portion of the bluff by decreasing the slope angle and by protecting
the surface by me~ns of erosion control matting and vegetation. The
work proposed does not address present or future erosion at the toe
of the bluff which may affect stability of the upper area. Due to the
unceHain nature el- weather ,and ether natural processes, any
stabdizadon efforls on bluff areas must be considered fo be
temporary.
