The validity of this permit is or may be subject to the approval of other governmental or municiDal
authorities. The Town accepts no responsibility in applying for or obtaining such approval In the
event that SUCh approval is necessary, the holder of this permit shall not commence operations here-
unoer until such approval has been obtained in writing. The failure to obtain such other approval when
reouired shall subject this permit to immediate revocation by the Trustees upon receipt by the
Trustees- of written notice from such other governmental or municipal authorities of its refusal or
disapproval.
The applicant does by the acceptance of this permit, assume all responsibility for operations under-
taken pursuant to this permit, and shall take all precautions for the prevention of in.uries to persons
and proper~y resulting from such operations, By such acceptance, the applicant also agrees to indemni-
fy and save harmless the Town, and its officers, agents and employees from any and all claims arising
from operations under this permit and any and all acts or omissions of applicant, his agent and
employees.
The applicant and the owner and occupants of the premises Ul~On which the operations authorized by
this permit are being conducted, do, by the acceptance of this permit, give consent to the Town, and
[ts officers and employees to enter upon the premises where such operations are being c~nducted to
make such inspections as the Town may deem necessary to insure that such operations are being con-
ducted in conformity with this permit.
This operation will not substantially:
A, Adversely affect the wetlands of the town.
B. Cause damage from erosion, turbidity or siltation.
C. Cause saltwater intrusion into the fresh water resources of the town.
D. Adversely affect fish, shellfish or other beneficial marine organisms, aquatic wildlife and vega-
tation or the natural habitat thereof.
E. Increase the danger of flood and storm-tide damage.
F. Adversely affect navigation on tidal waters or the tidal flow of the tidal waters of the town.
G. Change the course of any channel or the natural movement or flow of any waters.
H. Weaken or undermine the lateral support of other tands in the vicinity.
I. Otherwise adversely affect the health, safety and general welfare of the people of the town.

The following resolution was adopted by the Southold
Town Trustees at a Special Meeting held on July 11, 1985
with reference to the wetland application of Sue Hanauer
and Joan Bagley.
RESOLVED that Sue Hanauer and Joan Bagley be granted
permlssion under the provisions of the Wetland Ordinance
of the Town of Southold, New York, all in accordance with
the application. This permit will expire on J~ 1986~fH,/
if the work has not commenced by said date. There shall be
two inspections required; and the trustees shall be notified
when the project is complete.

A Special Meeting of the Board of Town Trustees was held on
THURSDAY, JULY 11, 1985 at 5:00 P.M. at the Southold Town Hall,
Main Road, Southold, New York.
Present were:

Moved by Trustee Kujawski seconded by Trustee Bednoski
WHEREAS, Abigail Wickham on behalf of Sue Hanauer and Joan Bagley
applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold,
application dated April 4, 1985~ and
WHEREAS, said application was referred ~o the Southold Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public hearing was held by the Town Trustees with
respect to said application on June 26, 1985 at which time all
interested persons were given an opportunity to be heard, now,
therefore, be it
RESOLVED that Sue Hanauer and Joan Bagley be granted permission
under the provisions of the Wetland Ordinance of the Town of
Southold, New York, all ~n accordance with the application.
This permit will expire on 3uly 11, 1986 if work has no~
commenced by said date. There shall be two inspections required;

Dear Mr. Jacobs:
As per your request, I have reviewed the drainage situation at
the intersection of Lighthouse Road and Soundview Avenue. A copy of my
memo to you dated 1/30/91 regarding the adjacent Bitses property is
enclosed for your reference. Also enclosed is a letter from the Town
Trustees concerning Mr. Bitses aprlication to construct a "Flood Gate"
on the North side of the road. The parcel of land indicated above is
located directly to the south of the intersection. A major portion of
this parcel is considered to be Fresh Water Wetlands. The major concern
of the Owners, as I understand it, is that road runoff is entering
their pond from the adjacent streets and contaminating their pond.
It has also been stated that the culvert below soundview avenue, (which
allows the two ponds no achieve equilibrium), is also adding to the
contamination.
It is true that road runoff does make its way mnto both ponds.
However, it is also true that this pond is the low point in an area
which acts as a drain for the surrounding +/- 50 acres. The pond on
both sides of the road is acting as a natural recharge basin for the
entire area.
A recent letter that you have received from Mr. Irving Like, who
ms the attorney for the Owners of the above referenced property, states
that the Town is responsible for the "Defective design, construction
and maintenance of the road and drainage facilities". This statement,
in my opinion, is non very acurace. Soundview Avenue was dedicated co
the Town in the year 1914. The design criteria of the times would have
probably been to use whatever nanural drainage areas that were available.
Recent ~erial survey maps clearly show that before the road was built,
the two ponds on both sides of Soundview Avenue were connected. Therefore,
any reference to the connections of the two ponds by way of a culvert
would be, in my opinion, irrelevant.

The road runoff that is directly entering the ponds, although
somewhat undesirable in an environmentally concious world, is an existing
situation that has existed for at least 75 Years. The Fresh Water Pond
on both sides of the road seems to be thriving as it always has. Without
data to document the levels of suspected contamination, that may or may
not exist, it would be premature to even discuss possible alternatives.
A meeting has been requested by Mr. Hanauer through Mr. Likes
letter dated 6/10/91. Please feel free to schedule this meeting at your
convenience. I will be glad to meet with you and Mr. Hanauer to
discuss this matter.

Enclosed please find a return from the Highway Department with
respec~ to a flow control structure near your property on
Soundview Avenue, Southold.
As their concerns are most serzous, this office will requzre
that you supply us with a licensed land survey of your parcel
and the adjacenc project area - including Town road right-of-way
and all structures proposed. Said survey must show all land
forms an one foot (1') con,ours of elevation and accurately
depict the current static water level of both ponds, the road
surface and road crown height, and the invert elevation and size
of all drains in the area.

AS per your request I have inspected the existzng culvert that runs
below Soundview Avenue between two fresh water ponds just west of
Lighthouse Road in Southold. Mr. James Bitses has made a permit
application no construct what he calls a Flood Gate at the north
end of the existing culvert. The purpose for this Flood Gate
appears co be to control the water level of the northern pond which
is located on Mr. Bitses property.
I see at least ~wo maoor problems with his request. My first
concern is the installation of this Flood Gate itself. If this Gate
operates as intended, it would prevent the two Ponds from achieving
equilibrium. Since the average level of the two Ponds are close
no the existing road grade and some flooding does still occur from
time to time, iT would be highly likely that chis Flood Gate would
create a severe road hazard due tc the increased elevation of
the southern Pond.
The second concern is the design & location of the Flood Gate. The
dam or berm will require much more material than the one half yards
proposed in the application. Also, the design calls for this berm
co be constructed entirely on Mr. Bitses property. The Town R.C.W.
for Soundview Avenue is 66 feet wide. If we assume the road pavement
no be centered in this R.O.W., the Town property line will be located
approximately twenty feet out into the Northern Pond. Therefore the
construction of this Flood Gate as proposed would be entirely on
Town Property.
I understand the desire for Mr. Bitses co try and reclaim existing
Fresh Water Wetlands on his p~operuy for his own use but I can non
recommend the construction of this Flood Gate ac the ~xpence of
Public Safety on a Town Road.

A question has been raised regarding this proposal by the Board of.
Appeals. Please be advised that approval by the Town Trustees has been
granted based on the Suevey for Sue Hanauer & Joan Bagley at Southold,
Dated Feb. 26, 1985 and revised March 12, 1985 showing the building
envelope placemenC.50' from the edge of the pond.
Please be advised that there is to be mo disturbance to the Emergent
Aquatic Vegetation in this area and the following provisions shall be taken
during construction:
1. During excavation the fill must be contained so that it does not
wash into the pond.
2. Care should be taken so as to preclude tke entry of any
construction material into the pond.
3. Blacktop driveways can not be used.
Following construction all areas of exposed soil shall be
properly protected with suitable eroszon control devices and/
or vegetated to prevent entry of soil into the pond.
