Two Trustees were present(President Domino and Trustee Goldsmith), as were my clients, neighboring property owner, Fred Moss, my client's engineer, and I. On that occasion,we discussed the Trustees' requirement of the extension of the revetment, along with the extension of coir logs,jute matting, and vegetation. I will advise my client to authorize inspections and applications for this extension. However, the twenty(20)feet extension proposed by the Trustees fails to adequately mitigate the damage caused during the construction of the Moss revetment. Improper construction practices by the contractor,which have been well-documented, include but are not limited to: cut-backs from the top of the bluff in excess of 10% a large bluff-cut; bulldozing the beach and removing a significant amount of pebbles, sand and shoreline sediment in order to shore up the bluff-cut/ramp;two bluff collapses; and the absence of Page I of 2 any means to c( rl run-off during and after construction.*,. ese acts and omissions have caused significant erosion of the bluff crest and has accelerated erosion at the bluff toe and of the beach at my client's property. The portion of bluff closest to the construction is currently at a vertical angle of repose. Please accept this letter as my clients' request for the Trustee Board to re-evaluate this worsening situation. An extension of 20' will not suffice to prevent accelerated erosion and significant loss of real property on the unprotected portion of the bluff. While extending the revetment the entire length of their bluff is the best solution,my clients are willing to discuss other options in order to settle this matter as expeditiously as possible. GROSSER CONSULTING March 10,2017 Ms.Julia Erlich 1435 Demarest Road Orient, NY 11957 Re: Bluff Erosion Condition at 1435 Demarest Road,Orient NY Dear Ms. Erlich: P.W.Grosser Consulting,Inc(PWGC)was retained to investigate the erosion condition of the bluff located at 1435 Demarest Road in Orient, NY(subject property). The client expressed that the current and future integrity of the bluff on their property have been compromised by the construction of revetments on neighboring properties. PWGC visited the property on 3/3/2017 to observe the bluff, the surrounding properties and the ongoing construction effort. Additionally, PWGC was provided with past photographs, surveys, permits and other documents related to the subject property and the revetment construction project at 1585 Demarest Road. The following letter report presents PWGC's professional opinion on the causes influencing the eroded state of the bluff,the environmental impacts from the proposed revetments and recommendations. SITE LOCATION AND HISTORY The property is developed with a single-story residence and has a coastal boundary with the Long Island Sound to the north. The property is separated from the beach by a coastal bluff formed during the most recent period of glacial retreat. The bluff is approximately 35' tall and is composed primarily of sand and gravel with some clay II material. The bluffs of the north shore of Long Island play a crucial role in supplying sand and gravel to the beaches through wind and wave erosion. The property is situated on the western side of a local cove along with nine (9) other residential properties. Figure 1 below depicts the vicinity of subject property from 2013. In December 2010, the bluff experienced significant erosion resulting from a powerful storm with wind speeds equivalent to a Category 2 or 3 hurricane (Freedman, 2010). Photos of the damage to the bluff from high winds and wave action were submitted to PWGC by Julia Erlich and can be found below. The photos show extensive weathering done to the bluff on all properties within the cove. The bluff at 1435 Demarest Rd (subject property) was better sheltered than the others and experienced the least amount of damage. Aerial photos from 1980 to 2016 are available in Google Earth,NY Orthos Online and Suffolk County GIS. A comparison between these photos show that bluff erosion was gradual outside of the major loss of material and surficial vegetation caused by the December 2010 storm. In response to damages from the storm,several property owners within the local cove area had revetments built to prevent further erosion to the bluff. The constructed revetments are a combination of stone riprap providing a hard,armored wall at the toe of the bluff and bio logs with jute matting and native plantings higher up the bluff. The revetments were built in a piecemeal manner,culminating with the neighbor adjacent to the subject property on the east side starting construction of their own in October of 2016. The impacts can be classified as ongoing damage due to the construction of the revetment at the adjacent property and future impacts from the hard shoreline armoring measures completed by other properties within the cove. Additional future impacts will most likely be caused by the lack of flanking or scour protection incorporated into the design of the adjacent revetment to the east. FUTURE IMPACTS FROM ADJACENT REVETMENT DESIGN The design documents and construction drawings for the revetment undergoing construction at 1585 Demarest Road have been made available online by the Town of Southold. The revetment design calls for a nearly vertical rip-rap rock revetment that tapers down to a lower elevation when it meets the property line at 1435 Demarest. The wall abruptly ends with no flanking protection and is subject to overtopping from wave action and scour. Flanking protection typically involves a return wall or a tie-in to an existing wall to avoid creating weak spots at a transition point or property line. In a guide on protection against wave-based erosion,the NYSDEC cautions that improper flanking protection could lead to upland slope failure and undermining at the wall ends(Coastal Erosion Control Design). The US Army Corp of Engineers recommends that 'extension of revetments past the point of active erosion should be considered but is often not feasible. In other cases, a thickened end section,similar to toe protection, can be used when the erosion rate is mild'(USACE, EM-1110-2-1614). According to the construction documents, the revetment at the property line has a top elevation ranging from 8.0'to 12.0' NAVD 88. Per FEMA Flood Map 36103C0066H,the site area has a Base Flood Elevation (BFE)of 14.0' NAVD 88 for a 100-year event and is subject to coastal wave action. Storm events with a more frequent return period,such as the December 2010 storm, have created waves that hit the bluff toe in the past. With wave-action likely above the top of the revetment and no 'soft' stabilization measures installed in this area at the property line,this location will become a weak point and receive an increased amount of erosion. Conditions such as these could cause a progressive collapse of the bluff structure at the property line and inflict damage to property at 1435 Demarest Road. GENERAL FUTURE IMPACTS FROM ADJACENT REVETMENTS In terms of geological processes,the sand and gravel beaches at the shore depend on bluff erosion as a supply of material. As the bluff naturally erodes in a gradual way from wind,gravity and wave action,the sand and gravel is deposited at the toe and replenishes the beach (Coastal Barriers, Beaches and Dunes). By armoring the shoreline,the revetments halt erosion on the bluff face and leads to beach loss. The rate of disappearance of the beach is exacerbated as the length of armored shoreline increases. The impacts from the steeply-slopped rock revetments will be two-fold. Initially,the nearly vertical arrangement of the revetments will reflect waves back out into the water and be more destructive to the beach,cove bed and bluff walls. As the bed is eroded, the cove's bottom will become deeper and offer less protection to the shore against wave-action (Mitigating Shore Erosion Along Sheltered Coasts). The deeper the bottom is, the stronger future waves will be that impact on the bluffs. Crashing waves can strip protective vegetation from the bluff face and remove substantial amounts of sand. These effects will cumulatively inflict significant, long term environmental impacts to the unarmored bluff that exists at 1435 Demarest Road. The design plans for 1585 Demarest Road call for a 5' cut back at the top of the bluff. The cutback extends east to west across the entire bluff until it meets the property line for 1435 Demarest Road. The plans do not detail how the cutback will be tied into the grading at 1435 Demarest. Research into documents and guidelines yields several references to neighboring revetments causing moderate to significant damage to adjacent property. A handbook on shoreline stabilization techniques rates stone rip-rap revetments as having 'moderate to high' impacts to neighboring properties (Shoreline Stabilization Handbook). The Town of Southold's Local Waterfront Revitalization Program (LWRP) document states that hard erosion control structures such as revetments generally cause damage to adjacent shorelines by altering natural sand erosion rates on bluffs that nourish beaches and reflect wave energy during periods of flooding. Academics studies that summarized observations of seawall and revetment performance document the damage these structures cause to adjacent beaches and natural formations (bluffs, dunes etc). Griggs and Tait (1988) found that accelerated erosion occurred up to 500 ft downcoast of riprap revetments caused by wave reflection prevention of upland sand erosion. Komar and McDougal (1988)found that preventing sand erosion that would normally settle on beaches and in shallow waters caused waves to break further inland and accelerate extreme erosion. The Town of Southold's Conservation Advisory Council authored a document entitled "The Starvation of Southold's Beaches"which includes a clairvoyant passage that admits to the damage these rock revetments and their inconsistent construction impose-on adjacent property owners, below. "The result of this piecemeal practice is that some properties are being hardened while adjacent properties for which no applications were submitted remain unprotected. This begins a downward spiral of bluff change by putting the shoreline out of alignment, with unprotected bluffs being selectively and aggressively eroded while armored bluffs are less affected...As the eroded indentation deepens over time, the sediment is mined at the side walls, undercutting the sediment behind these hardening structures of the adjacent protected property. This mining and undercutting will trigger a response from the owner of protected property to construct a return wall of bulkheading or toe armor to prevent the bluff from being eroded from behind the armor. The cycle of erosion and response will continue as long as the sea level continues to rise.As more and more bulkheads,seawalls,revetments and toe armor are installed and less sediment becomes available for transport by the longshore drift, the beaches down current starve, causing drastic changes inshore profiles." The New York State Department of Environmental Conservation "Design of Coastal Structures" document states that engineers/designers of coastal structures must address the following two questions in their design: • Will the structure sufficiently change the direction or magnitude of wave energy at an adjacent or nearby property to adversely affect the shore or bluff? • Will the project change the flow patterns,interrupt or entrap sufficient littoral material to create a deficit of beach material and increased erosion along the shore on nearby properties? With respect to the revetments east of the subject property, PWGC finds the design intent to be woefully inadequate in answering or addressing these requests. In the case of the revetment at 1585 Demarest Road,the design plans don't even acknowledge that a neighboring, developed property (1435 Demarest Road) exists. Furthermore, each new revetment built in the cove area prompted a neighbor to have to construct their own revetment to protect their property and impose damage upon their unprotected neighbors. The recent history of the cove area with regards to shoreline stabilization development has shown to have been antithesis to the recommendations of the NYSDEC and Town of Southold's Conservation Advisory Council. Additionally, natural habitats and natural resources should be protected to the extent possible. The design drawings offer no insight or details into how the revetment would be constructed. Items that were excluded are:contractor machinery access routes,extents of cut and fill on bluff face,stormwater runoff&erosion controls and methods of protecting neighboring property. From viewing photos submitted by the owner (included below), the contractor performed an unpermitted bluff cut to access the beach with machinery at the start of construction in November 2016 (Photo 4). The bluff cut material was eventually lost via runoff by inadequate erosion controls (note the collapsed silt fencing). As of March 8th, the cuts into the bluff face performed by the excavator exceed what was indicated on the drawings. The description for the construction of the rock revetment offered on drawing 1 of 3 states that the wall will be constructed'along'the bluff toe,not cut and embedded into it by several feet. Cut material is currently being stored on this beach with no erosion controls to prevent runoff losses into the nearby ocean (Photo 5). Photo 7 shows bluff cut material stored on the beach with no erosion controls to prevent material loss offsite into the ocean. NYSDEC requirements for permitting bluff restoration and revetment construction state that the design plans should include a limits of excavation line,extents/volume of cuts and fills,fill material to be used and the slopes of the existing and proposed bluff face. The bluff will be more susceptible to permanent erosion loss due to an increase in wave-action strength from the future deepening of the cove, exposure to undermining and scour from poor flanking protection and suspect construction practices. PWGC recommends that the owner of the subject property seek to restore or protect the bluff to prevent significant damage during future storm events.- The owner has the option of restoring their bluff to its native, vegetated condition.while seeking to have the east neighbor's revetment included proper flank protection or construct a revetment of similar design to the end of the cove. The first option provides the bluff face,which is. currently partially stripped of vegetation, with a low cost, soft stabilization solution that includes regrading and terracing. The vegetated bluff would provide protection for erosion, however, would most likely require heavy maintenance after a severe storm event. For the second option,a rip rap revetment would be constructed that matches their neighboring properties to the east. The 1435 Demarest property is furthest west in the cove area and allows for a simple flanking solution that would not impose damage on their neighbors to the west. PWGC's preliminary estimates indicate that the vegetation restoration and terracing solution would cost - approximately$60,000 and does not include the augmentation to the neighbor's revetment. The construction of a revetment of similar design to the neighbors'would cost approximately$250,000. A reconstruction of the bluff stairs,should it be damaged from future,accelerated erosion would cost an additional$50,000. My clients received your letter,dated July 20,2017, regarding the proposed construction activities intended to remediate damage to the bluff caused by construction on the adjacent Subject Premises.This proposal fails to adequately address the damage caused by the reckless construction of the rock revetment at the Subject Premises. Specifically,the construction activity has destabilized the bluff by way of an illegal bluff cut,the removal of 2 large trees,and failing to take any preventative measures during construction to address the consequences of said construction. The improper construction resulted in two bluff collapses,as well as severe cut-backs at the top of the bluff which are not addressed in the letter. This unlawful,negligent,and dangerous activity has already caused accelerated erosion of the bluff and other protected natural features. As you know,my client has presented on-going documentation of this erosion to the Board of Trustees. Therefore,the proposal to extend the Moss revetment 20'will not suffice to prevent future damage and loss of significant real property. Please accept this letter as my clients' request for the Trustee Board to reconsider its evaluation of this matter and require the extension of the Moss revetment to cover the entire shoreline of my clients'property,and similarly extend jute matting,plantings,and terracing. Because the required permit applications and engineering costs will be the responsibility of those responsible for the damage incurred during the revetment construction,my clients will consent to any authorizations required for applications to the Town or Department of Environmental Conservation,will consent to authorizations for any governmental inspections of their property, and will provide the engineer's report previously commissioned by my clients. On April 12, 2017, as the result of the removal of a large locust, also near the property line at the bluff"crest,there was a second collapse due to the deep and extensive root system of the tree. The April 12 collapse is also well documented with photographs. Construction activity also created a significant cut-back from the top of the bluff. The cut-back was exacerbated by the creation of a bluff cut. The cut-back and bluff cut altered the angle of repose and caused further damage to my clients' property. The excavation of the bluff appears to have been designed to create an unlawful, de facto ramp for construction equipment access. 1 The permit issued by the Board of Southold Town Trustees on May 18,2016, specifically authorizes"...that if necessary [Moss] will provide additional coir logs and jute matting to [my client's] adjacent property,particularly if there is an issue with a collapse of the bluff in the vicinity of the neighboring property line during construction of the revetment..." Coir logs and jute matting are necessary to stabilize the contemporaneous planting of approved vegetation while the root systems grow. Damage to the Subject Premises requires, at a minimum,the restoration of my client's bluff with vegetation, additional coir logs, and jute matting. We appreciate that Mr. Terry has recognized that the damage must be addressed, as acknowledged in the email sent to my client on May 17, 2017. I am writing to you to address certain issues that the Trustees have a duty to act upon concerning the prosecution of the work under the above-mentioned permits. It is my understanding that Ms. Moss was issued a coastal erosion permit and wetland - permit,to build a revetment as well as bluff stairs on May 18, 2016, the same date that the environmental review was held by the trustees. My clients attended that review so that their concerns would be noted on the record. One concern expressed by my client was that the subcontractor would deviate from the approved work and make a bluff cut, as he had already done the prior summer, despite the fact that such conduct was not specified in the site plan and was not, in fact, legal. Another concern was the effect an entire line of revetments, five properties long, would have on my clients' section of the bluff. This concern was based on the LWRP which provides that revetments and other"hard erosion control measures" are known to cause "lateral damage to adjacent properties." Despite stating specifically at that meeting, as well as noting on the permit that all materials were to be delivered by barge (no bluff cut), Terry Construction completely acted in contravention to the Board approval and made a bluff cut. The impact of the Terry Construction's actions has been well documented by my client through photos. At this point, it is no longer safe to walk near the top of the bluff due to the absence of support, and the toe of the bluff has suffered considerable erosion resulting in significant loss of vegetation on their section of the bluff which for decades has withstood extreme storms, including the Christmas storm of 2010. My clients were encouraged by Mr. Bredemeyer's assurances that there would be another environmental review, where my clients would be able to speak on the record and emphasize the need for the Trustees to address the damage sustained to the bluff. Unfortunately,the Trustees decided, apparently at the last minute, to hold a"work session"which was not open to the public and would not be on the record. The Trustees' decision to reinstate the permit, for no apparent reason, with no stipulations addressing the damage that occurred as a result of the bluff cut and the subsequent four months during which it was allowed to remain unprotected on an already denuded section of the bluff, defies all commonsense. Equally baffling is why the Trustees decided to re-issue the original permit,which was deviated from so egregiously by Terry Construction,without so much as adding any direction about how the damage to the bluff was to be addressed or how further damage to my clients' property would be avoided. I have no doubt the Trustees are well aware that as a Coastal Erosion Hazard Area, excavating, grading, and dredging are all prohibited, except in certain situations which don't apply here. There are other issues which have come to light, for example the LWRP consistency review in which the coordinator recommends an assessment of the "impacts that could occur to the property to the west from the shoreline armoring,"which was apparently ignored. The damage that has been done to my clients' property cannot be overlooked or unchecked. It is imperative that this situation be addressed as soon as possible,particularly since construction was resumed this morning. If the Trustees refuse to protect my clients' property, the Trustees are, in fact, facilitating in the damages sustained by my clients and are as equally culpable as Terry Construction. Julia Erlich/Denis Maksymowicz DEC 7 2016 1435 Demarest Rd P.O.Box 214 Southold Town ( Orient,NY 11957 trd of Trustees (631)323-8015 November 30,2016 Southold Board of Trustees: At the suggestion of John Bredemeyer,we are submitting this letter so that the record will reflect what we believe are clear violations not only of the Town Code,but also DEC regulations with regard to the bluff revetment and stairway project taking place at the property adjacent to ours, 1585 Demarest Road. We attended the Environmental Review meeting on May 18 at which time we submitted a letter stating our concerns and questions about this project,which included questions about the erosion control measures that would be put in place given that this section of waterfront has been designated a Coastal Erosion Hazard Area. We also voiced concern about the direct effect that the revetment would have on our section of the bluff,given the fact that these "hard erosion control"measures are known cause lateral damage to adjacent properties. In addition we questioned the 5'cutback of the top of the bluff,as well as the location of the proposed new stairs which we believe encroach on our property.At that time we were assured that a number of measures would be taken to address our concerns. Unfortunately this pales in light of the fact that the contractor hired to build the revetment,Terry Contracting,started work on October 24,even though he had yet to obtain a permit from the the town. What's worse,their first order of business was to make a large cut in the bluff so that the huge slabs of rock could be transported to the beach by an enormous bull-dozer via a so-called"ramp,"rather than the standard practice of delivery by barge,which had been stipulated at the environmental review. As you know, the same contractor made a large bluff cut,just three properties to the east of ours(the prior summer),despite the fact that,as in our neighbor's case,there was no mention of a bluff cut in the project description. At that time he was given permission by the Bay Constable to continue work,even though it was a clear violation of Town Code. We find it outrageous that Terry would again use this method of delivery despite the fact that he had already been reprimanded,and that there was no mention of a bluff cut in the work plan. We have been told that Terry Construction was subsequently issued a permit,after the fact,even though the damage had been done. We have also been informed that he was fined and there has been a stop work order implemented. We don't understand why this contractor was issued a permit even though he had knowingly ignored town regulations. We have been documenting the sudden and extreme deterioration of the bluff,with photographs,for the past six weeks. At the time when the cut was made our neighbors bluff was already denuded-ours was not.Now,our bluff has lost a huge amount of vegetation,and is eroding at an accelerated pace. What's more,in their misguided attempt to build a "ramp"they brought bulldozers down to the beach,and shored up the dirt at the bottom with pebbles from the beach. Now the beach itself has all but disappeared from that section of the bluffs. There have also been numerous heavy downpours since then which have caused the dirt piled up on the sides of the cut to be washed away. This also flies in the face of accepted practice of initially stabilizing a denuded bluff with some kind of flora to anchor it. The damage that has already been done is very concerning and we are now in danger of losing our stairs. The poor planing and lack of oversight regarding the attempt to stem erosion has had the opposite effect,and we are suffering the consequences,through no fault of our own. Meanwhile the bluff is eroding more with every passing day. The situation is unacceptable,the damage to our property must be remediated by the parties that have caused it. We would like to know what steps you plan to take to insure the restoration of the bluff,at the very least, to the condition it was in,before this illegal activity took place. In addition,the plans submitted for said revetment and stairs did not include a long-term maintenance program which is required by town code. There was also no mention of any kind of return on the revetment where it meets our part of the bluff,even though that has become accepted practice in an attempt to diminish lateral damage. Given the denuded state of the bluff combined with ongoing mudslides,it defies imagination to think that any structure, revetment or stairs,could be built at all in a manor that would be lasting,least of all for thirty years. It is imperative that the bluff be stabilized,and then secured by whatever means possible. To begin a project like this on a denuded eroding bluff at the'end of October,is not just misguided,it's dangerous, and puts our property,and others at risk.The bigger issue is why the trustees continue to allow revetments to be built on these high bluffs at all,when there is no imminent risk to a house or other structure. It would seem that only those who can afford the$250.000 to$300,00 price tag have luxury of shoring up their section of bluff,while anyone unfortunate enough to own an adjacent property,who doesn't have that kind of disposable income,is forced to watch as their property erodes as a result. In light of the fact that code enforcers do not shirk from imposing fines on those irresponsible enough to toss,say,a couple of tree branches over the bluff, we can only speculate about why there is so little oversight when what's at stake is the bluff itself. The permit for the above referenced property was not issued until October 28, 2016. Despite the permit not being issued until October 28, 2016, it has been brought to this Board's attention that work has already commenced on this project. Furthermore the work undertaken on said project has far exceeded the scope set forth by the Board of Trustees at their May 18, 2016 Public Hearing wherein the permit expeditor averred that the owner stated access to construct would be by barge. One example of the work that exceeds the Wetland Permit and Coastal Erosion Permit is that a bluff cut has been created. Chapter 111-14B(2) precluded a bluff cut unless done in accordance with conditions stated in a Coastal erosion Permit. The method of access for construction was specifically discussed at the May 18, 2016 Public Hearing as a result of the Board of Trustees experience with neighboring sites where bluff cuts resulted in repeated siltation and sedimentation of Long Island Sound. r For the reasons set forth above, and the terms and conditions detailed in the issued permits, you are hereby directed and ordered to immediately stop any and all work on the subject property. Here is the pier, and I just shaded the light blue around the pier, that's all the water seaward of the mean low water line. So there is enough room and surprising amount of F water depth for boat to come in there and maneuver without impacting the eel grass. TRUSTEE BREDEMEYER: Next item, number three, Suffolk Environmental Consulting on behalf of DEBORAH MOSS requests a Wetland Permit and a Coastal Erosion Permit to construct bluff stairs consisting of 4'x5' entry steps to a 4'x8'top platform, 4'x11' steps, 4'x4' middle platform, 4'x9.5'steps, 4'x6' middle platform, 4'x11.5' steps, 4'x6' bottom platform, 4'x8.5'steps, and 4'x4' landing; construct a rock revetment along the toe of the bluff measuring ±12'wide by±175' long and comprised of 3-5 ton armor stone and 50-1001b. Core stone(Key Way), all atop filter fabric; restore bluff face (±5,500sq.ft.)by cutting back the top of bluff+5' landward of the existing top of bluff; install jute matting where required; install Bio-Logs where required; and actively re-vegetate the bluff face using native plantings(i.e., Cape American beach grass or similar species). Located: 1585 Demarest Road, Orient. SCTM# 1000-13-2-7.10 This project has been determined to be consistent with the LWRP,with two cautionary statements attached to the assessment. One is to clarify where the access to the site will be established for the work; and the second, is that the Board should assess the impacts that might possibly occur to the N M Board of Trustees 17 May 18, 2016 property to the west from shoreline armoring as there has been armoring for properties, several properties to the east. The Trustees performed a field inspection on May 11 th. The entire Board present. The Board has been cognizant of several revetment construction projects on the Sound that I would, we would best characterize as unmitigated disasters where after the Board had written permits and received hearing at public hearings, that projects would be accessed by crane and barge, bluff cuts were made the full depth of the Sound, in some cases over 75 feet, with roads dumping silt and materials into the Sound and the people constructing the revetments having to retreat weeks on end while northeast winds ravished and silted up the Sound for hundreds if not thousands of acres. Accordingly, based on our experience,the Board is disposed in the field inspection to note that no bluff cut be allowed, access will have to be by crane and barge only or from the top of the bluff or with some supplemental permitting information concerning the construction of an appropriate access road.That was the basis of our field inspection based on this area and the neighboring homes, which the bay constable was called on a complaint on a construction of a revetment on one of the neighboring homes, as I did receive a call as well, and we have in our file pictures of other jobs that were similar went forward without the approval of the Board,with potentially major damage to Long Island Sound took place over several weeks. Is there anyone here who wishes to speak on behalf of this application? MR.ANDERSON: Bruce Anderson for the applicant Deborah Moss, from Suffolk Environmental Consulting. I want to thank you for meeting me at the site to review it a week ago. As we discussed, and I did have a chance to discuss with the client, that it is our intention and understanding that we will be able to access the shoreline through the barge as there is no large boulders in the water that would preclude that access. So we think that is easily done. As to the second point,to the property to the west, I think the photo that is up there on the screen addresses that. You'll see that the erosion and the compromised bluff is limited to really our property. And the reason is because of the shape of the shoreline there. So it is inconceivable to me that the revetment that we would be building would impact the point which is well off the site. And I think that's where that concern goes. So the revetment itself and the stairs, etcetera, are substantially similar to the other revetments that have been constructed and the stairs that have been constructed in immediate area. And the concern being really the access to the bluff. So it was my understanding if for some reason a bluff cut would be required, it would have to be fully engineered, and that would then be referred to the town engineer, which I think is a fair process. But we are not asking for that at this time. And it's my understanding that the equipment can access the site Board of Trustees 18 May 18, 2016 via barge. I'm here to answer any further questions you may have. TRUSTEE BREDEMEYER: I think with respect to the project, it is pretty straightforward and very much in keeping with the other projects to the east. I guess the concern would be during the course of construction if there was of a failure of the lateral land to the west, would the owners be willing to extend some of the jute matting, in other words as you approach the property line if you end up having bluff collapse during construction, that stabilization could occur by agreement with adjacent land owners, because we have seen beginning,with the severe weather we have been having and another one of the sites where we have gained experience, that sometimes things don't exactly go as planned during construction of these projects. Particularly where there is not a natural angle of repose, the tendency of the bluffs to collapse during construction is a very real concern. MR. ANDERSON: I would say, absolutely, I think that would be the responsible way to go. TRUSTEE BREDEMEYER: Thank you. Any other questions?Would anyone else wish to speak to this application? MS. ERLICH: Okay, I could read it. I just wanted to say, though, that I don't know if that photograph, if it's made clear in the photograph where their property line actually is. Whose stairs are those, by the way? MR. ANDERSON: Those are the adjacent property owner Lalezari. MS. ERLICH: Do you see there,a hedge? MR. ANDERSON: Yes. MS. ERLICH: Okay, so that hedge is pretty much the property line, and you can see that there is some erosion that is beginning to creep over to our property. You can also see our stairs--you see the point there. And you see the stairs sort of, our stairs. And I also want to say that-- TRUSTEE SANDERS: I'm a little confused. Are you here?Are you talking this? MS. ERLICH:Yes. That's our stairs and that's our property.And there was a big storm, Christmas day of 2010,which was followed by Hurricane Irene in the Summer of 2011, and after those two events, every single house east of us, up to Penny's Point, which you can't see in this photograph, had severe erosion. And after the hurricane, every one of them lost their stairs. Every single property to the east of us up to Penny's Point. The first person to remediate was Joan Prager who was two houses down from the person who owns those stairs and she built a revetment, she built new stairs but none of the other neighbors wanted to go in with her. After she built her revetment,the erosion became worse for all the neighbors, which is something I M � Board of Trustees 19 May 18, 2016 think typically happens to adjacent properties with a revetment or any other kind of hard structure, even if its a parallel structure. And so last summer, the person who owns those stairs, I'm trying to figure out, yes, because, okay, the person who owns those stairs and every other house up to Sinclair, the one long, it basically built one long revetment,which ends at the property below these stairs. So the house right next door to us, the Moss house, is now applying for an application to have their revetment done which means we'll be at the end of a long revetment wall, so we are actually concerned about what the effects would be for us. Since--maybe I should read something from the letter here. Let me just start with that. I think in the Southold Town water revitalization project report, which is a long report, but it talks about what the, one of the things it talks about is what kind of erosion measures are deemed to be useful. Particularly on the Sound and high bluffs. And they have come to the conclusion that, in their own report, bulkheads, seawalls and revetments deflect wave energy in a manner that accelerates the rate of adjacent shoreline erosion.And that's just one of the places where they basically say that revetments might work in the short time to protect the property directly behind the revetment but if you are unfortunate enough to live next to a revetment or a bulkhead or a seawall, you are going to suffer the consequences. So we are just worried about the erosion that may occur on our property. Also, according to the plans that we got, there is proposed ; stairs are really just right up against our property line at the top of the bluff. Although it doesn't show where the property line is on your plans. And at the bottom of the stairs where the landing is,the markers that you had put on the beach itself, don't correspond to the drawing. And the drawing appears it would be directly below the landing at the top of the bluff.And ; then there is a revetment that sort of extends six feet beyond that. And we question whether this is actually on the Moss property or on our property. TRUSTEE BREDEMEYER: The project plan is scaled to one inch equals 40 feet, and the distance from the proposed stairs at the closest to your plot line is somewhat less than half-inch, would be approximately 17 to 20 feet that the stairs begin. MS. ERLICH: No. TRUSTEE BREDEMEYER: I'm not here to argue points one way or the other. Typically the Trustees request where sufficient space is possible to gain,that docks, catwalks and stairways be at least 15 feet off side property lines, and that distance,allows for stabilization with the plantings so that there is no erosion that would be created that would go offsite. MS. ERLICH: It would be good if that were the fact but at least according to the markers that you put on the top of the bluff, which I assume indicate where the top of the stairs go, and the landing at the bottom of the bluff on the beach, are not consistent with those measurements. The 17 feet is definitely 00 Board of Trustees 20 May 18, 2016 not consistent. MR. ANDERSON: If I may, the hedge is not actually your property line. The hedge is five feet.The western edge of that hedge is another five feet off of your property line. So the way this is supposed to work is that the upper platform for the stairs is 20 feet off your property line.What I could suggest is if there is a concern that inadvertently the revetment is placed on your lands, that we could have it marked,that is the corner, the juncture of the bottom of, the toe of the bluff,and the property line be marked by a licensed surveyor prior to construction and that should be-- MS. ERLICH: That would be very comfortable. MR. ANDERSON: I would be happy to do that. TRUSTEE BREDEMEYER: Please direct your comments to the Chair. MR. ANDERSON: So if the Trustees were to, as a condition of approval, request that,we would be happy to comply with that. I think that would address your concern. MS. ERLICH: Okay, I just want to say, that there is a pipe marker at the edge of the bluff, it's just to the east of that hedge which has been there, which is the original property line marker. It was there when we bought the property and it is still there. So that is easy to see where the property line is. As far as, you know, measuring, that's good. I think possibly, um, it might be a good idea to have a third-party engineer, evaluate, who is neutral, evaluate the situation as to what kind of damage might accrue to our property as a result of this revetment and all the work that will be done, including the five foot plus cut back that you were, that you plan to do at the top of the bluff. If you are going to cut back five feet, you know, it's all one thing. Its like the waters of Connecticut and New York, it's arbitrary. TRUSTEE SANDERS: Are you willing to hire your own engineer to give a design proposal? MS. ERLICH: No, I'm not. Because we don't think we should be required to pay for that. TRUSTEE BREDEMEYER: Another possibility is the Trustees, in our power, we can hold until the other agencies complete their review. In the case the Department of Environmental Conservation, which will have several different groups within the department review the project.Also, if they were to alter the plans to accommodate any additional changes that would be necessary, I mean obviously we all live in the real world and we witnessed what happened after Sandy.Also the Board has granted the permits for the other structures. You also did hear that the applicant is willing to extend the vegetation and coir logs over on to your property so it might be, and obviously I don't believe such things go on for ever and ever, if you have vacant land yourself you can then also apply to the Trustees for Administrative Permit to do terracing and coir logs on your own side at the same time this work is done and that way would have an interlocking system of vegetation on the upland side that Board of Trustees 21 May 18, 2016 might actually proceed to link up with your existing vegetation. There are certainly limits to what the Board can do but we do rely on the expertise of the Department of Environmental Conservation as well and we could hold final determination here for the DEC permits. MS. ERLICH: Okay. MR. ANDERSON: I would just say that at the end of the day both permits have to agree. So that's probably not necessary.That is to say; if the DEC were to change some aspect of this, we would be coming back here for an amendment anyway, consistent with those changes. MS. ERLICH: I'm not following. Okay, so the DEC-- I don't understand what they mean by the these are title two or chapter two of SEQRA therefore they are not subject to environmental review. How is that? But they are. Or aren't they? TRUSTEE BREDEMEYER: Coastal revetting structures have been typically taken as Type II Actions. And they have not been processed by any of the involved agencies as unlisted actions pursuant to SEQRA. It's just the way they have been processed. MS. ERLICH: But this will be evaluated by the DEC. TRUSTEE BREDEMEYER:That is correct, MS. ERLICH: Prior to any permit. And that has not been done yet, right? TRUSTEE BREDEMEYER: They don't have a DEC permit, to my understanding. TRUSTEE SANDERS: It's subject to a DEC-- TRUSTEE BREDEMEYER: Subject to a DEC permit. MS. ERLICH: So you are making your permit subject to that as well? TRUSTEE BREDEMEYER: This is all under consideration. That's the purpose of a public hearing is to allow you to voice your concerns and for us to get additional information and to talk to the applicant about feasibility of the project. MS. ERLICH:What he suggested-- TRUSTEE BREDEMEYER: You have to address the Chair. MS. ERLICH: That he would extend the jute matting, is that at the top of the bluff or is that at the bottom? TRUSTEE BREDEMEYER: It would be a matter for us to clarify in further discussion. I would presume that where the jute matting is needed, adjacent to the property line is where you are constructing would carry over some reasonable distance onto their property; is that safe to say, top to bottom? MR. ANDERSON: What's safe to say is that we don't have any intention of touching the property and to the extent we can be good neighbors and protect anything directly adjacent, I'm sure we would be willing to do that. I can't suppose there is an incursion onto her property.We are not here to install a revetment on someone else's property or anything on someone else's property. Having said that, you know,we are not here to damage adjacent property. I'm sure we'll take the responsible steps to avoid that sort of situation. After the Christmas day nor'easter in 2010,there was significant damage to the bluffs,especially to the east of us. Many lost their stairs. The following summer Hurricane Irene made a clean sweep of it--everyone east of us,as far as Petty's Bight,lost their stairs. For some reason,we were the dividing line and were fortunate not to have lost ours;I thought it was a temporary oversight on the part of the weather gods. I was wrong. We still have our stairs,but I worry that soon our exemption will be terminated. We have kept an eye on the progression of events,as first,Joan Praeger,who had the most significant damage, built a revetment and replaced her stairs. After that,the erosion to the bluffs on either side of her property accelerated. Last summer three neighbors surrounding her property bit the bullet and built what is now a continuous line of revetments, as well as brand new stairs. That line ends at the house just to the east of us,which has recently been bought by the Moss's. Now they too are submitting plans for their own revetment and new stairs.We can't blame them,after all,their section of the bluff is now completely denuded of vegetation,and needless tosay,the accelerated erosion has left it at a steep angle, hardly what one would call an"angle of repose." I assume that that's the reason why Suffolk Environmental Consulting wants to cut back 5'from the top of the bluff. We wonder,how will that cut back affect the rest of the bluff to the west,since nature is oblivious to property lines. Speaking of which,we also wonder why they have chosen to build the stairs so close to the our property line--the plan detail shows less than Y from the hedge,though for some reason the property line doesn't show up there. In fact,there is a steel pipe marker--that shows exactly where the line is at the top of the bluff and it is just inches from the hedge. We know the previous owner's stairs were located about 20'to the west of where they propose to locate them now. What is more worrisome is the landing on the beach. The markers which they have staked on the beach itself do not correspond with the drawing, they are not in line with the top of the stairs but are to the west of that--and we think if they are not on our property they are very very close,which begs the question:what about the 6.5'of revetment which they have proposed to the west of their stair landing? We wouldn't say no if they offered to extend the revetment the length of our property,but a few feet is not going to help.We believe that it is highly likely that the erosion on our part of the bluff will intensify as a result of the proposed revetment,combined with what is now a continuous wall of rock retainer. Though we are concerned about the effects of revetments on our property,the larger issue is "hard"erosion control measures,particularly in what has been designated by the DEC as a"Coastal Erosion Hazard Area"? The Southold Town Water Revitalization Project itself states(section III-19 p.255): "Bulkheads,seawalls,and revetments deflect wave energy in a manner that accelerates the rate of adjacent shoreline erosion."We understand that the trustees are responsible for ensuring that the Coastal Erosion Hazard Areas Law is enforced and regulated in compliance with Town Code as well as the DEC guidelines. We ask that you take these guidelines into consideration with respect to'the permit under review.We hope that should approval be granted for a permit to build yet another revetment on this section of the bluffs fronting the Long Island Sound,it will include a contingency that will protect our property from the potential harmful consequences of this construction. We would also like to point out that none of permits that have already been granted for the revetments on this section of the bluff involve properties where the actual home has been in any immediate danger.
