the State of New York, 1893; and Chapter 404 of the L?s of the
State of New York 1952 and the Soufhold Town Ordinance en-
titled "REGULATING AND THE PLACING OF OBSTRUCTIONS
IN AND ON TOWN WATERS AND PUBLIC LANDS and the
REMOVAL OF SAND, GRAVEL OR OTHER MATERIALS FROM
LANDS UNDER TOWN WATERS;" and in accordance with the

Dear Mr. Just:
The following action was taken by the Board of Town Trustees
during its regular meeting held on January 26, 1996 regarding
the above matter:
WHEREAS, J.M.O. Consulting on behalf of FREDERIC C. HAMILTON
applied to the Southold Town Trust~es for a permit under the
provisions of the Wetland Ordinance of the Town of Southetd,
application dated December 8, 1996, and,
WHEREAS, said application was referred to the Southotd Town
Conservation Advisory Council for their findings and
recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustee~ with
respect to Said application on January 26, 1996, at w~ich time
all interested persons were given an opportunit-f to be heard,
and,
W~EREAS, the Board members have personally viewed and are
familiar with the premises in question and the surrounding area,
a~d,
WHEREAS, the Board has considered all the testimony and
documentation submitted concerning this application, 8~,
WheREAS, the structure complies with the standard set fort/~ in
Chapter 37-18 of the Southeld Town Code,
W~EREAS, the Board has determined that the project as proposed
will not affect the health, safet~ and general welfare of the
people of the town,
NOW THEREFORE BE IT, ~
RESOLVED, that the Board of Trustees grants a Wetland Permit to
construct walks, terraces and gardens. A s~aked line of hay
bales witk silt fiencing shall he installed prior to and
maintained during all periods of co~str~ction. ~

BE IT FURTMW~RESOLVED that this determination should not be
considered a determination made. for any other Depazhment or
Agency which may also have an application pending for the same
