Ovsianik PROPERTY LOCATION: 32930 Route 25 and 225 Eugene's Road, Cutchogue SCTM#'s 1000 -97- 2 - 15 & 16.5 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated December 15, 2016stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PLANNING BOARD OF THE TOWN OF SOUTHOLD: On December 28, 2016, the Planning Board provided written comments recommending that the Zoning Board of Appeals grant alternative relief to increase the easterly buffer on the proposed lot no. 2 from 50 feet to 70 feet in width, which would still permit suitable area to add parking and landscaping required by site plan standards. It was suggested that included with the ZBA approval, permission be granted to use residentially zoned land for commercial parking. Additional comments were made concerning the potential action by the applicant to submit a petition for change of zone. PROPERTY FACTS/DESCRIPTION: The applicant's property, subject to a subdivision petition, is a non- conforming 79,577 sq. ft. split zoned parcel located primarily in the R-40 Zoning District. The property measures 136 feet and 131.22 feet along NYS Route 25, Main Road, on the westerly property line, 220.48 feet along the northerly property line, 331.63 feet along the easterly property line and measures 322.93 feet along Eugene's Road, on the southerly property line. The property is currently improved with a one story frame commercial building and a one story metal building and operates as an automotive gas service operation as shown on the survey prepared by John C. Ehlers,L.S., last revised December 8, 2016. Page 2,January 19, 2017 #7017, Ovsianik SCTM No. 1000-97-2-15 & 16.5 BASIS OF APPLICATION: Request for a Variance under Article III, Section 280-14 and the Building Inspector's November 21, 2016,Amended December 22, 2016, Notice of Disapproval based on an application to permit a lot line change to create two non-conforming lots, at: 1) lots proposed at less than the code required minimum lot size of 80,000 sq. ft.; located, at: 32930 Route 25 and 225 Eugene's Road, Cutchogue, NY. SCTM#1000-97-2-15 & 16.5. RELIEF REQUESTED: The boundary line alteration proposes to correct the non-conformance of an existing commercial building (CO# Z-17053, July 6, 1988) that was constructed on two separate lots, Lot 15 and Lot 16.5. The proposed lot line change will increase the split zoned commercial/residential parcel from 13,939 sq. ft. to 32,974 sq. ft. and, subsequently, proposed lot 2 will be reduced from 67,082 sq. ft. to 46,603 sq. ft. Both lots require variances because of the configuration of proposed non-conforming lot sizes where the code requires 80,000 sq. ft. for each of the lots ADDITIONAL INFORMATION: The Board received a memorandum from the Planning Board dated December 28, 2016. The memorandum recommends increasing the width of the Eugene's Road portion of proposed lot #2 from 50 feet to 70 feet for the purpose of creating an additional buffer to the residential property to the east. The Board finds that the proposed buffer vegetation on the easterly property line of proposed Lot #1 along with an additional 10 foot wide by 150 foot long vegetated buffer along the adjoining property line of proposed Lot#2 and the residential parcel to the east will create a substantial buffer. Additionally the applicant's agent testified that increasing the buffer width to 70 feet may reduce the area needed by proposed Lot #1 for future parking per code which requires 4 parking spaces per each of the 5 existing garage doors and 3 employee spaces. Finally, the dwelling to the east of proposed lot 2 is sited 20 feet away from the shared property line and an additional vegetated buffer will be conditioned to mitigate any adverse impacts from the business use. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2017, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed lot#2 will be similar in size to four of the existing R-80 zoned lots to the east on Eugene's Road. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Lot 16.5 (proposed lot #2) is presently non-conforming with respect to the minimum lot size requirements of the R-80 zone and to reduce its lot size will increase its nonconformity, consequently requiring a variance. Furthermore, the subject commercial building, having a certificate of occupancy, was constructed on both lots 15 and 16.5 and is situated on the adjoining lot line of Lot 16.5 and lot 15 necessitating a lot line change to correct this non-conformance. 3. Town Law &267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 42%relief from the code. Although, the proposed lot line change for lot 2 will create a 46,603 sq. ft. lot in the R-80 zone, proposed lot 2 is similar in size to four of the residential lots to the east on Eugene's Road. Proposed lot 1 will become 32,974 square feet which is conforming to the B zone but is not conforming to the 80,000 sq. ft. required in the R80 Zone district on this split zoned property. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law V67-b(3)(b)(5). The difficulty has not been self-created. There was a certificate of occupancy issued for the commercial building which is partially located on Lot #15 (B-zoned) and Lot #16.5 (R-80 zoned). The proposed lot line change is necessary to bring the commercial building into conformance with the code. 6. Town Law X267-b. Grant of requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a "lot line change", while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Schneider, seconded by Member horning, and duly carried,to GRANT the variance as applied for, and as shown on the Survey/Site Plan prepared by John C. Ehlers,L.S., dated July 19, 2010 and last revised December 8, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. Create a 10 foot wide by 150 foot long vegetated buffer along the easterly property line of proposed lot#2 beginning at Eugene's Road. 2. Obtain approval from the Southold Town Planning Board for the proposed lot line change. 3. Future commercial parking is permitted on the residential portion of proposed lot 1, such as those depicted on the subject survey/site plan cited above, only with the site plan approval of the Southold Town Planning Board. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Wilcenski, Chairman Members of the Planning Board &10& - Date: December 28, 2016 Re: Request for Comments for Ovsianik Located at 225 Eugenes Road, Cutchogue SCTM #1000-97-2-15 &16.5 ZBA#7017 The Planning Board thanks you for the opportunity to provide comments regarding the application referenced above. We recommend that alternative relief be provided for this application as shown on the enclosed map entitled Ovsianik Proposed Lot Line Change with Zoning Districts. The Planning Board is proposing that the new eastern lot line be 70' away from the adjacent property, instead of the 50' currently proposed. The reason for the additional 20' is to provide a more substantial buffer to the residential property to the east. The commercial use of this property could likely expand if they are successful in pursuing a zone change, and the house next door is located only 20 feet from the property line (see map entitled Ovsianik lot line modification & current zoning over aerial). In addition to providing a more substantial buffer to the adjacent residence, the alternative plan will provide enough room to add parking and related buffers and landscaping requirements if the owner applies for that in the future. The parking area depicted on the plans, however, is theoretical. This parking area is not under review at this time, and was provided only as an example to demonstrate that the new lot line would encompass enough area to provide for future parking. Please consider a condition that any new parking area must first receive the necessary review and Southold Town Planning Boai�,v Page 2 _11,-cember 28, 2016 approvals, including ZBA approval to use residentially-zoned land for commercial parking (Town code 280-78 1), and Planning Board Site Plan approval. Finally, the plan contains a notation that the new parcel (97-2-'15) is proposed for a zone change, however this zone change is not in effect at this time. The new lot created as a result of this variance application and the Planning Board's Lot Line Modification application will be split-zoned B and R-80 (see attached map). The members of this board have personally visited the site and are familiar with the property as well .as the surrounding neighborhood.
