SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was not referred as required to be referred to Suffolk County planning department under Administrative Code Sections A 14-14 to 23. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 10,019 sq. ft.parcel in the R- 40 Zoning District. The northerly lot line measures 74.69 feet along Lower Shingle Hill Road. The easterly lot line measures 137.09 feet along a residential parcel, the southerly lot line measures 72.76 feet along Fox Avenue, and the westerly lot line measures 139.63 feet along another residential parcel. The property is improved with an existing single family dwelling, as shown, on the survey drawn by CME Associates, Engineering, Land Surveying &Architecture,PLLC, dated November 4, 2016 BASIS OF APPLICATION: Request for Variance(s) under Article XXIII, Section 280-124 and the Building Inspector's October 6, 2016, Notice of Disapproval based on an application for a building permit to alter an existing porch attached to a pre-existing single family dwelling, at: 1) the proposed alteration is less than the code required front yard minimum setback of 35 feet; 2) the proposed porch alteration is contrary to a prior appeal condition (# 6880, dated September 17, 2015) that porch remain as unconditioned space; located, at: 162 Lower Shingle Hill Road(AKA Fox Avenue), Fishers Island,NY. SCTM#1000-9-1-26. RELIEF REQUESTED: The applicant requests a variance to enclose a 110 sq. ft. porch which was legalized subsequent to Zoning Board relief in September 17, 2015, Appeal #6880, having a front yard setback of 4 feet, where 35 feet is required. The current relief requested will rescind a prior condition which required the porch to remain as unconditioned space. ADDITIONAL INFORMATION: On September 17, 2015 (#6880),the applicant was granted variances to legalize an "as built" porch and accessory shed. The "as built" porch relief was conditioned upon it remaining as unconditioned (unenclosed) space. On August 8, 2016, the applicant's attorney, Richard Lark, requested a de Page 2,January 19,2017 #7016, Cashel SCTM No. 1000-9-1-26 minimus approval to remove the condition so that the porch could be enclosed. Upon review, the Board determined that the proposed improvement was not'de minimus in nature and instructed the applicant to submit a new variance application if he wished to proceed with the improvement. The applicant's design professional, Sam Fitzgerald, submitted a copy of a letter from the homeowners explaining their absence from the hearing and to further express their reasoning for the variance. Mr. Fitzgerald also submitted correspondence by letter and email from neighbors supporting granting the variance. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5,2017 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is comprised of approximately 24 single- family dwellings, almost all of them, if in fact not all, having non-conforming principal setbacks, and some also having non-conforming accessory building areas and setbacks. Enclosing the porch space will not change or expand the footprint of the dwelling. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The porch enclosure cannot be feasibly constructed without a variance for a non-conforming front yard setback because the existing single-family dwelling already has a non-conforming 3.9 ft. setback from Lower Shingle Hill Rd., and a large portion of the dwelling is actually constructed within a non-conforming front yard setback area. 3. Town Law 4267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 89%relief from the code. However, the existing dwelling was built in the early 1900's, with the existing 3.9 ft. front yard setback. Most of the house is actually within a non-conforming area because of the two front yards. The existing porch is only 110 sq. ft. in size and has a slightly larger setback of 4 ft. from Lower Shingle Hill Road, which is a private service road, generally traversed only by vehicles owned by the residents of the immediate neighborhood, their guests, and other vehicles occasionally required to be there for work related purposes. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law X267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an enclosed porch with a non-conforming front yard setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Horning, seconded by Member Schneider, and duly carried,to Page 3,January 19,2017 #7016,Cashel SCTM No. 1000-9-1-26 GRANT, the variances as applied for, and shown on the site plan prepared by Sam Fitzgerald Architect, P.C. (pages 1-13) dated August 2016 (received November 14, 2016), and survey prepared by Richard H. Strouse, L.S. last revised November 4, 2016. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. The applicant after purchasing the property and occupying the house, which was built in 1893 and remodeled in 1918, began the process of modernizing the interior by restoring the flow of the main floor living space as it was originally designed. The applicant is also bringing up to current standards the windows, appliances, electric and heating systems . I grew up spending summers on Fishers Island since the early 1970s, my parents have a home on the East End and I have two brothers who also have homes on the island. My wife and I are active in the community. My wife served on the Library Board and I am a past Commodore of the Fishers Island Yacht Club. My wife and I have four (4) children: Charlie (11), Katie (9), Will (9) and Teddy (6) and two dogs Ginger and Emma. It is our goal to be able to share our love of Fishers Island with them and to spend extended time close to family and friends each summer. Given our affinity and roots on the island, we looked for many years for a house that met our needs with so many children. We decided the Hay Harbor area was a good base given all the children activities so close by. The Gorham property came to market and it was something that was possible for us. As the Board knows, the Hay Harbor cottages are unique in that they were constructed at the turn of the last century (1890s) and were cottages for a larger hotel complex. The home has had limited modernization and it is our goal to make the home safe and return it too as original layout as possible. Our long run goals for the home are to replace windows, wires and modernize the baths and kitchen areas. We have also moved away from oil towards propane a fuel source. Where we need the Boards assistance is to help restore the historic flow of the inside space by allowing us to enclose a rear covered porch to act in a laundry / mud room capacity. With a family of 6 members, there is a lot of laundry and over 18 meals served a day. Thus we need storage, laundry space and a functional kitchen. The current configuration has the laundry in the kitchen space. The dining area of the home is also attached to the kitchen. Thus the presence of laundry under foot and in sight of guests as they come for a meal. The laundry sink and machines block a historic door that still sits on its hinges that used to allow flow from the back of the home to the front porch and lawn. We desire to restore this interior flow and seek the additional functional space by enclosing the outdoor covered storage area used to shield 101b the previously located above ground oil tank location. As discussed the oil tank has been removed in favor of propane, thus the covered area is serving no current purpose. In our proposed change, we simply change out the existing picket fence under the existing roof for a shingled wall with some windows and doors. The change does not impact any set back and in our simple view, materially cleans us the visual appearance of the home while greatly improving its functionality and flow. As we described, the current situation of laundry in the kitchen that is visible from the dining area is not functional of our family. Unlike the hotel days, laundry is done on site. We looked at options to install the laundry in other areas; however the four bedrooms on the second floor are occupied with our children. The bathrooms are not sizable to accommodate the laundry either. Finally, there is no closet space that can house machines of any size on any floor of the house. The notion of putting, laundry in the basement is not feasible. We felt the idea of enclosing the under utilized porch, cleaning up the exterior appearance and enhancing the interior flow , storage and utility of the home was worth the investment of time and resources to explore with the Board. We are hopeful that the Board can see that we are seeking to enhance the home, view shed of our neighbors and that we fully understand the character and uniqueness of Fishers Island. We are not seeking anything that takes away or overly encroaches on any aspect of our island community. We believe that projects like ours will encourage other homeowners to undertake investment in their homes to improve the characteristics of the neighborhood for all. I imagine the variance board is composed of people with families like us and I feel the best approach is to share with them the reality of the situation as I am sure as many are parents as well they would understand our situation on a basic level which is what I would like to present. It is a problem that can be solved and make for a much happier family (especially the wife) by making a change that would benefit the homeowners layout-wise as well as the neighbors aesthetically. I grew up spending summers on Fishers Island since the early 1970s, my parents have a home on the East End and I have two brothers who also have homes on the island. My wife and I are active in the community. My wife served on the Library Board and I am a past Commodore of the Fishers Island Yacht Club. My wife and I have four (4) children: Charlie (11), Katie (9), Will (9) and Teddy (6) and two dogs Ginger and Emma. It is our goal to be able to share our love of Fishers Island with them and to spend extended time close to family and friends each summer. Given our affinity and roots on the island, we looked for many years for a house that met our needs with so many children. We decided the Hay Harbor area was a good base given all the children activities so close by. The Gorham property came to market and it was something that was possible for us. As the Board knows, the Hay Harbor cottages are unique in that they were constructed at the turn of the last century (1890s) and were cottages for a larger hotel complex. The home has had limited modernization and it is our goal to make the home safe and return it too as original layout as possible. Our long run goals for the home are to replace windows, wires and modernize the baths and kitchen areas. We have also moved away from oil towards propane a fuel source. Where we need the Boards assistance is to help restore the historic flow of the inside space by allowing us to enclose a rear covered porch to act in a laundry/ mud room capacity. With a family of 6 members, there is a lot of laundry and over 18 meals served a day. Thus we need storage, laundry space and a functional kitchen. The current configuration has the laundry in the kitchen space. The dining area of the home is also attached to the kitchen. Thus the presence of laundry under foot and in sight of guests as they come for a meal. The laundry sink and machines block a historic door that still sits on its hinges that used to allow flow from the back of the home to the front porch and lawn. We desire to restore this interior flow and seek the additional functional space by enclosing the outdoor covered storage area used to shield the previously located above ground oil tank location. As discussed the oil tank has been removed in favor of propane, thus the covered area is serving no current purpose. In our proposed change, we simply change out the existing picket fence under the existing roof for a shingled wall with some windows and doors. The change does not impact any set back and in our simple view, materially cleans us the visual appearance of the home while greatly improving its functionality and flow. As we described, the current situation of laundry in the kitchen that is visible from the dining area is not functional of our family. Unlike the hotel days, laundry is done on site. We looked at options to install the laundry in other areas; however the four bedrooms on the second floor are occupied with our children. The bathrooms are not sizable to accommodate the laundry either. Finally, there is no closet space that can house machines of any size on any floor of the house. The notion of putting laundry in the basement is not feasible. We felt the idea of enclosing the under utilized porch, cleaning up the exterior appearance and enhancing the interior flow , storage and utility of the home was worth the investment of time and resources to explore with the Board. We are hopeful that the Board can see that we are seeking to enhance the home, view shed of our neighbors and that we fully understand the character and uniqueness of Fishers Island. We are not seeking anything that takes away or overly encroaches on any aspect of our-island community. We believe that projects like ours will encourage other homeowners to undertake investment in their homes to improve the characteristics of the neighborhood for all.
