SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated November 10, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. TOWN OF SOUTHOLD OFFICE OF THE TOWN ENGINEER: This application was referred to the Town Engineer. In the department's response dated December 20, 2016, the Town Engineer reviewed the application and found no adverse issues relating to the proposed merger of the two properties. TOWN OF SOUTHOLD PLANNING BOARD: In a memo dated November 14, 2016, the Planning Board provided comments of their review detailing their reasons for support of the variance and the lot line change (merger)petition. PROPERTY FACTS/DESCRIPTION: The two parcels comprising this lot line change(merger)are located in the R-80 Zoning District, and are both currently non-conforming in size. The resulting parcel will measure 176.98 on the westerly property line along Little Neck Road, 541.74 feet on the northerly property line along residential and agricultural properties, 50 feet and 127.12 feet on the easterly property lines adjacent to residential properties, and 150 feet and 392.11 feet on the southerly property lines, also adjacent to residential parcels. Adjacent properly owners who currently have legal access over the right of way will continue to do so. The existing residential property is improved with a two (2) story frame single family-dwelling and attached garage with a stone patio a shown on a survey prepared by John C Ehlers, L.S., dated September 19, 2016. No additional improvements are proposed. BASIS OF APPLICATION: Request for a Variance under Article 111, Section 280-14 and the Building Inspector's September 21,2016,Notice of Disapproval to permit a lot line change(merger),at: 1)the lot line change(merger) Page 2,January 19, 2017 #7012, Zachariadis_ SUM No. 1000-10 '=5-1&5 will result to a lot having less than the required 80,000 sq. ft. in area,at: 1775 Little Neck Road,Cutchogue,NY. SCTM#1000-103-5-1 and 1000-103-5-5. RELIEF REQUESTED: The applicants request relief for the creation of a non-conforming lot area resulting from a lot line change(merger)which involves the conveyance of an adjacent private right of way known and designated as SCTM No. 1000-103-5-1 to be merged with their property. In doing so, the parcel will be less non- conforming; having an increase in size from 27,008 sq. ft.to 46,153 sq. ft.where 80,000 sq. ft. is required: ADDITIONAL INFORMATION: In a letter dated November 15 2016,from the Planning Board Chairman states that the"Planning Board supports the variance as requested." FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on January 5, 2017at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town-Law 6267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The resulting parcel will become less non-conforming, having a total of 46,153 sq. ft. in area instead of the required 80,000 sq. ft. The merger consists of a 50 foot Right of Way once used to service a neighboring agricultural parcel which will be conveyed and merged with the applicant's residential parcel. The ROW is currently used by the subject parcel and by 2 other residential properties to access their dwellings.No changes in community character will occur as a result of this merger. Only the ownership of the R.O.W. will change. By granting relief for non-conforming lot area, the lot line change (merger)will be permitted,and will,therefore,succeed in direct access for the owners to their property. 2. Town Law 6267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue,other than an area variance. The proposed merger will result in a 146,153 sq. ft.parcel, located in an R-80 Zoning District,where 80,000 sq.ft. is required;therefore,a variance is required. 3. Town-Law 6267-b(3)(b)(3). The variance is mathematically substantial,representing 66%relief from the code. However, the merger will decrease the degree of non-conformity of the subject parcel, will not increase the density in the neighborhood, and will permit the homeowners who currently use the R.O.W. to maintain and improve it as needed. 4. Town Law &267-1b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 6267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 5267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of direct ownership access to their home while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The findings of the Board are that the Board is in agreement with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship the hard- ship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance.
