part of the consideration for the issuance of she Permit does understand and prescribe to she fol-
lowing:
1. That the said Board of Trustees and the Town of Southold are released from any
all damages, or claims for damages, of suits as/sing dilrectiy or /ncl/reatly as a re, it of any opee-
ation performed pursuant to this permit, and the said Pexmittee will, at his or he~ own expense~
defend any and all such suits initiated by third parties, and the said Pexmittee assumes f-ull
with respect thereto, to the complete exclusion of She Board of Trustees of She Town of Southold
2. That this Permit is valid for a period of 24 mos. which is considered to be the
estimated time required to complete the work involved, but should dro,m~ances warranh tecfues~
for an extension may he made to She Board at a latex dat~
5. That this Permit should be retained indefinitely, or as long as the said Permittee wishes
to maintain the structure or project involved, to provide e~-idence tu an)om concerned flint auth-
orizatiun was originally obtained.
4. That .the work involved will be subject to she inspection and approval of she Board
its agents, and non-compliance with the provisions of the orig/nating application, may be cause
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference wish navigation as a result of the wot/
herein authorized.
6. That there shall be no interference with the tight of the public to pass and repass along
the beach between high and Iow water marks.
7. That if future operations of the Town of Southold requke the removal and/or alteration*
in the location of She work herein authorized, or if~ in she opinion of the Board of Trustees, She
work shall cause unreasonable obstmetton to free navigation, the said Permittee will be requi~
upon due notice, m iemove or aker this work or project herein stated without expenses m the To~m

8. That She said Board will be notified by the Permittee ot the completion of the work auth-

9. That the Permittee will obtain all other permits and consents dmt may be required
plemental to this permit which may be subject to revoke upon failure to obtain same.

Re: Amendment of Permit No. -3865
Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees during
their regular meeting held on April 4, 1991 regarding your request to
amend the above permit°
RESOLVED that the Town Trustees Approve the request of Proper-T
Services on behalf of Ante Grgas to amend permit number 3865 to
state the following:
The width of the walkway is increased from 3' to 4' The width.
of the hinged ramp is also increased to 4'. The height of the
walkway above grade at the high water mark is increased to 5' as
per plan dated March 25, 1991.
Ail other terms and conditions in the original permit granted shall
remain.
The amended permit shall take effect upon receipt of payment of the
following fees':
Dock: 1' X 80'= 80 sq.ft. X $2.00/per s.fo = $160.00
Ramp: 1' X 16'= 16 sq.ft. X $2.00/per s.fo = $ 32.00

Dear Sir:
The owner requests that the permit described above be amended
as follows:
The width of the walkway is increased from 3' to 4'. The
width of the hinged ramp is also increased to 4' This is
to provide greater safety for young children and elderly
members of the family.
The heigh5 of the walkway above grade at the high water
mark is increased to 5'. This is to ensure ample clearance
between the decking and the water during spring tides.
A revised drawing '~Plan and Section Views", dated 3/25/91, is
enclosed.

Dear Mr. Fitzgerald:
The following action was taken by the Board of Town Trustees during
its regular meeting held on September 27, 1990 regarding the above
matter:
WHEREAS, JAMES FITZGERALD IN BEHALF OF ANTE GRGAS applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated July 18,
1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on September 27, 1990 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT JANES FITZGERALD IN BEHALF OF ANTE GRGAS BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Replace
and extend existing (permit ~1678) open-pile walkway, hinged ramp and
to install piles to secure floating dock located on Mattituck Creek.
This permit will expire two years from the date it is signed if work
has not ~commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification. Two inspections are required and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.
Permit will be issued upon pala~ent of the following fees for work to
be done below Mean High Water Mark:

Recommendation of Wetland Applications

The following recommendations were made by the CAC at its August meeting:
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 6-3-90-87-5-1 to construct approximately 56' of timber bulkhead,
a 2' return at the western end, a 4' return at the eastern end and to backfill
structyure with approximately 26 c.y. of clean sand which shall be trucked in
from an upland source. The C^C recommends disapproval because there is no
sign of erosion. Placement of a bulkhead may lead to erosion by backwashing
of stormwaters. Application submitted by Howard Ludecker.

RESOLVED to recommend to the Southold Town Trustees a positive declaration
of Wetland Application No. 6-2-90-106-4-1 of Sebastian Cove Property Owners
Assoc. to maintenance dredge a previously dredged area of Sebastian's Gutter
to a depth of -3' at MLW, with resultant spoil to be disposed of at an upland
site. The CAC also recommends disapproval of the construction of six 4' x 30~
floats. The Council suggest the Trustees request an ElS. The project is a
Type I action because it is adjacent to NYDEC wetlands protection area, it is
located in a CEA, and the location is in an area that is a primary, principal or
sole source aquifer. Also, shellfish opportunities exist around the area.
The CAC in addition recommends that, instead of the requested floats, two floating
docks along the bulkhead to accomodate six boats.

RESOVLED to recorrmend to the Southold Town Trustees approval of Wetland Applic-
ation No. 7-3-90-113-8-2 of Joseph and Martha Janowcz to construct a 4' x 100'
wood access walkway; 4' x 40' timber catwalk dock; 3t x 20' aluminum ramp;
8' x 24' timber float dock with two 2-pile support dolphins and two 2-pile mooring
dolphins.

Application No. 7-2-90-113-6-15 of Ant~ Grgas to replace and extend existing

floating dock.

RESOLVED to recommend to the $outhold Town Trustees disapproval of Wetland
Application No. 7-6-90-111-1-16 of Frank and Sandra Curran to construct an
accessory building. The CAC recommends disapproval because project is within
3' of the water, it will impact the environment, the Council has concerns about
water contamination which may occur from materials (gas, fertilizers, etc.) being
stored so close to the water; and the lot coverage is excessive.

RESOLVED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. ~-1-90-31-12-16 of Eugene Perino to construct steps,
ramp and dock. The CAC approves provided the platform and dock are properly
elevated.

Wetland Application No. 7-5-90-92-1-2.1 of Torsten Johnson was tabled.
RESOVLED to recommend to the Southold Town Trustees approval with stipulations
of Wetland Application No. 6-4-90-6-1-10 of Robert E. Patterson to construct two
guest rooms, gravel path and to install one additional 6' drywell at existing sanitary
system. There is to be minimal regrading. The CAC recommends approval provided
the project is moved approximately 10~ east of the 10' contour line (project is
presently proposed within 50' of a freshwater wetland.)
