The following is the Board's findings and determination recently rendered regarding this matter: WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounaing area; and W/IEREAS, the Board has considered all the documentation submitted concerning this request; and WHEREAS, the Board made the following findings of fact: 1. By this request~ appellant requests permission to construct a 10' x 24' attached garage to the existing dwelling. 2. The garage is proposed to be located 60 ft. landward from the existing bulkhead. 3. The parcel in question is located in the Residential and Agricultural Zoning District and is known as subdivision; Map of property of Elizabeth Mesrobain or more particularly known as Suffolk County Tax Map No. 1000-145-4-12.1 and Mesrobian Drive, Laurel, N.Y. 3. Chgpter ~7, Section 97-13 (A-3) all lands immediately adjacent to a tidal wetland as defined in Section 97-13A (3) and lying within seventy-five(75) feet landward of the most landward edge of such a tidal wetland, In considering this request, the Trustees find and determines: (a) That the relief requested is not substantial under the circumstances. (b) That by allowing the request as conditionally noted below, that there will not be any adverse affects to the wetl'ands. (c) That the safety, health, welfare, comfort, convenience and~order of the To~cn will not be adversely affected by the p~oposed request. ~ Accordingly on motion made by Trustee'Kujawski seconded by Trustee Hednoski it was 'RESOLVED permission Be and Hereby is Granted as requested for Mr,- Joseph Grillo-subject to the following provisiOns: -. - Board of Trustees In the matter of Joseph Grillo Page 2. 1. During ~xcavation the fill must be contained so that it does not wash int0 the creek. 2. Care should be taken so as to preclude the entry of any construction material into the adjacent waters° 3. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices and/or vegetated to prevent entry of eroded soil into the creek. Request by Mr. & Mrs. Joseph Grillo, P. O. Box 412 Mesrobian Drive, Laurel, New York for a waiver to the Wetland Ordinance, Chapter 97 from the Code of the Town of Southold, Section 97-13 section A-3 for permission to construct a 10' x 24' attached garage with an insufficient setback from the landward edge of tidal wetlands (or ordinary highwater mark), at Mesrobian Drive, Laurel; more particularly known as Suffolk County Tax Map No. 1000, Section 145 Block 4, Lot 12.1. Following deliberations, the board took the following action: WHEREAS, the Trustees haue personally visited the premises in question and the surrounding area and WHEREAS, the Trustees have considered all the documentation submitted concerning this request and WHEREAS, the Trustees made the following findings of fact: 1. By this application, appellant requests permission to locate a 10' x 24' attached garage to the premises. 2. The garage is proposed to be located 60 ft. existing bulkhead, 3. The parcel in question is located in the Residential and Agricultural Zoning District and is known as lots 6,7 & 8 on the Map of Property of Elizabeth Mesrobain, identified on the Suffolk County Tax Map as District 1000, Section 145 Block 4, lot 12.1. 3. Chapter 97, Section 97-13 (A~3) Ail land immediately adjacent to a tidal wetland as defined in Section 97-13A (3) and lying within seventy-fi~e ~75) feet landward of the most landward edge of such a tidal wetland. In considering this request, the Trustees find and determines: (a) that the relief requested is not substantial under the circumstances; (b) That by allowing the request as conditionally noted below, there will not be a substantial change in the character of the district; (c) that the safety, health, welfare, comfort, convenience and order of the Town will not be adversely affected by the proposed request (d) that the circumstances are unique; (e) that the interest of justice will be served by allowing the request as conditionally noted below: Moved by Trustee seconded by Trustee it was RESOLVED, that permission be granted to construct a 10' x 24' attached garage BE AND HEREBY IS APPROVED in the matter of the request for a waiver for Mr. & Mrs. Joseph Grillo subject to the following provisions: 1. During excavation the fill must be contained so that it ddes not wash into the creek. 2. Care should be taken so as to preclude the entry of any construction material into the adjacent waters. Immediately following construction, all areas of exposed soil shall be properly protected with suitable erosion control devices and/or vegetated to prevent entry of eroded soil into the creek.
