part of the consideration for the issuance of the permit does understand and prescn~ to the fol-
lowing:
1. That the said Board Of Trustees and the Town of Snathold are released from any and
all damages, or dalms for damages, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this pennlt~ and the said Permirtee will~ at his or her own expeme,
defend any and all such suits initiated by third partieg and the said Permittee assumes full ]]abiliry
with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold

6. That there shall he no interference with the fight of the public to pass and repass along
the beach between high and low water marks.
7. That if future operations of the Town of Southold require the removal and/or alt~'ations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall cause tuxreasonable obstructxon to free navigation, the said Permitter will be requlred~
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permlttee ot the completion of the work auth-
orized.
9. That the Permktee will obtain all other Pemaits and consents that may be required sup-
plemental to this permit which may be subject to revoke upon failure to obrai, same.

The following action was taken by the Board of Town Trustees during
their regular meeting held on--April 4, 1991 regarding your request to
amend the above permit.
RESOLVED that the Town Trustees Approve the request of Eh-Consultants
on behalf of William Griffo to amend permit number 3859 to state
the following:
Construct 2 low profile timber groins. The easterly groin will
be 40' in length; the westerly, 50' Each of the groins will be
prefil!ed with a total of 350=/- c.y. of clean sand to be
brought~in from an upland site. Replace (within 18") the lowest
and intermediate bulkheads, each of which are 150' in length.
Returns of 10' may also have to be replaced. Approximately 55
c.y. of sand, loam and top soil from an upland source will be
used to backfill these structures.
All other terms and conditions in the original permit granted shall
remain.
The amended permit shall take effect upon receipt of payment of the
following fees:

Dear Mr. Carrara:
This letter, plus enclosures, is in response to yours of
June 27, 1991.
As you may be aware, the request to install groins was
previously filed with the NYSDEC and other involved
regulatory agencies. As a result of severe beach loss,
it became necessary to replace the bulkhead on an
emergency basis. The only way to obtain a NYSDEC permit
to accomplish this was to withdraw without prejudice the
application for groins.
The bulkhead has now been replaced, and we now are
returning to our original request to install groins as a
long-term solution to the beach erosion problem. The
prior file contains many documents which contain
information and verification of the need for this
structure.
The Southold Board of Trustees was designated lead agency
under SEQRA, issued a negative declaration, and a permit.
I have attached a copy of their approval, as well as a
long EAF, as requested.
Our original request was for groins of greater length but
without pre-filling. The latter aspect of the current

project stems from a request by the New York State
Department of State, which believes that it will minimize
potential down-drift scour.
I have included copies oft heir correspondence requesting
the pre-filling, our acquiescence thereto, and the NYSDOS
certification of consistency to the revised project.
We believe that this constitutes verification that the
project overcomes the presumption of incompatibility
under the Tidal Wetlands Act, as the reason for the
filling is to minimize or eliminate what the Department
of State perceives to be a greater environmental detri-
ment.
It is also our belief that filling the structures with
clean sand fill will have only a temporary and localized
effect upon the substrate. Any benthic in-fauna will be
able to inhabit the newly placed material, resulting in
little or no loss of productivity.
No vegetated wetlands are present~ which would otherwise
be filled.
The need for the project is obvious. The subject parcel
lies in the middle of a groin field of long-standing
presence. The beaches on either side are wider and more
stable. A request to install groins in an otherwise
pristine area can have a significant down-drift effect.
Here, however, where both groins and bulkheads exist on
both sides, no significant effect is anticipated.
A recent discussion with Michael Corey of the Department
of State revealed his belief that the two Departments had
reaohed agreement on pre-filling. He was s~rised to
learn that the NYSDEC is once again opposing, or at least
tentatively objecting tof pre-filling.
The applicant does not wish to be placed in a position
where two agencies have opposing policies. I hope that
this difference can be resolved and that the project can
go forward immediately to avoid further damage to the
shoreline.

Dear Mrs. Peterson:
As I advised you in my previous letter, the lowest and
intermediate retaining walls are beginning to fail due to
the loss of the beach front which in turn is due to the
lack of a DEC approval to install the groins. If allowed
to proceed, the highest retaining wall will similarly
begin to fail which will cause the deck and pool and
eventually the house to be damaged and/or destroyed.
Obviously, this situation must be remedied immediately.
As per our discussion~ I enclose revised work plans
indicating not only the groins and prefilling, which was
required by the Department of State, but also the
replacement within 18" of the 2 lower bulkheads.
The project description is now as follows:

We understand that filling of the area below MLW is a
presumptively incompatible activity. However, in this
instance we believe that this incompatibility can be
overcome by the nature Of the project and its need. Only
a relatively small portion of the fill will be below the
line of MLW. Since prefilling was required by the
Department of State and U.S. Army Corps of Engineers as
a means of mitigating down-drift scour. It will
ultimately be beneficial to the integrity of the
shoreline. Further, since clean fill will be used, there
should be little or no impediment to b~ntb, ic dwelling
invertebrates rising through the newly placed fill and
colonizing it. There will be no adverse effect upon
shore and wading birds as this action will only tend to
preserve the shallow water zone which is being eroded
away at the present time.
Finally, enclosed please find my check in the amount of
$200 to make the total fee submitted to date $410. I
trustthat you will be able to issue a Notice of Complete
Application immediately and, following the comment
period, issue a permit promptly so that work can commence
immediately.
By copy of this letter and revised work plan, I am
requesting modifications from other involved regulatory
agencies with the similar request that review be
expedited in order to avoid serious damage to this
property and the waters of Southold Bay.

Dear Mr. Corey:
My research to determine the extent of erosion occur-
ring at the site has revealed a survey prepared for
a prior owner, which indicates that ordinary high
water is 25' beyond the face of the bulkhead on the
west side and 39' beyond the bulkhead face on the
east side. When compared to current conditions, the
high water line is at the bulkhead on the west side
and 12' from it on the east side. As the notation
on the old survey indicates the high water locations
as of July 23, 1974, the erosion rate on the west
side is 1.56' per year and on the east side 2.44'
per year. The elevation of the beach at the bulkhead
appears to have dropped 2' to 3' While no backfill
has yet been lost, this appears to be inevitable
unless corrective measures are taken.
I have considered your request to reduce the length
of the groins and that of the U. S. Fish and Wildlife
Service to reduce the length of the easterly groin
to 40'. Given the direction of littoral drift and
the distance to the next easterly groin, the 40'
length of the easterly groin is reasonable and
hereby adopted.

Prefilling would be acceptable as long as it is approvable
by other agencies.
Our review of the cross-section indicates that the groins
will be approximately 2' above grade which should qualify
as a "low profile" structure.
I would appreciate your and other agency conunents on
our revised groin proposal.

The following action was taken by the Board of Town Trustees during
its regular meeting held on August 23, 1990 regarding the above
matter:
WHEREAS, ROY HAJE IN BEHALF OF WILLIAM GRIFFO applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated July 2,
1990 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on August 23, 1990 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT ROY HAJE IN BEHALF OF WILLIAM GRIFFO BE AND HEREBY IS
GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: Construct (2) 50'
low-profile timber groins. Groins will extend out from existing
bulkhead. Length was selected as an intermediate between groins to
west (40+') and to east (60+').
This permit will expire two years from the date it is signed if work
has not commenced by said date. Fees must be paid, if applicable,
and permit issued within six months of the date of this
notification. Two inspections are re~ired and the Trustees are to
be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required for this project.

The Trustees have issued a wetland permit for this project. It
requires a wetland permit for being located within 5' below Mean
Low Water.
This Board rarely comments to USCOE on projects for which Town
permits are required.
Generally the Trustees will not oppose a groin field addition if
neighbors on either side have them and strict need is shown
(loss of property, severe erosion, bulkhead damage, etc.).

Wetland Applications Recommendations
TOWN OF SOUTHOLD
The CAC made the following recommendations at its meeting.of July 19, 1990:
RESOLVED to recommend to the Southold Town Trustees disapproval of Wetland
Application No. 6-4-90-35-3-p/o 12.5 & 12.6 of John Braider. The CAC
disapproves the requested 354 ' of timber retaining wall because no need is
demonstrated. The CAC suggests a natural planting of spartina in "cleared
area" would prevent any fruther erosion and any leaching into the pond.
The CAC recommends approval of the proposed floats.

The CAC approves provided the dock does not extend into the creek as to
block navigation. The matter of nonjurisdiction cannot be determined since the
location of the well and sanitary system was not provided.

are located to east and west. Dominant littoral drift
is from west to east. Length was selected as an
intermediate between groins to west (40+') and to
east (60+'). Groins are needed as beac~ has narrowed
significantly in front of subject property.
