(c)(2)(c) of the Last Will and Testament of Henry A. Gerry (their deceased father) and hereby
extinguish and cancel any restrictive covenant arising therefrom,as set forth in deed dated August
16,2004 recorded September 10,2004 in Liber 12342 Page 620.
TOGETHER with all right,title and interest,if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and
all the estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the
premises herein granted unto the party of the second part,the heirs or successors and assigns of the parry
of the second part forever.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.
AND the party of the first part covenants as follows: that said party of the first part is seized of the said
premises in fee simple,and has good right to convey the same;that the party of the second partshall quietly
enjoy said premises;that the said premises are free from encumbrances,except as aforesaid;that the party
of the first part will execute or procure any further necessary assurance of the title to said premises;and
that said party of the first part will forever warrant the title to said premises.

All that certain piece or parcel of land, situate, lying and
being on Fishers Island, Town of Southold, County of Suffolk and
State of New York, bounded and described as follows :
COMMENCING at a rock at the southeastern end of the wall,
which is at northerly end of the Bowers Ice Pond, said rock being
near the water line of the said pond and marked with a drill hole,
and running from thence by and along the shore of said pond to a
mere stone, which bears by compass, from the aforesaid rock South
fifteen degrees East (S 150 E) and distant in a direct line, fifty
feet six inches (50 ' 6") thence by compass North seventy-one and
three -quarters degrees East (N . 71 3/4° E) forty two feet to a mere
stone. Thence by compass North thirty and three quarters degrees
West (N. 30 3/4° W) fifty-seven - feet (57 ft . ) to a mere stone.
Thence by compass South Sixty-two and one-half degrees West (S . 62
;to W. ) twenty-seven feet and six inches (27 ' 6" ) to the rock at the
place of beginning, said lot contains about six and three-quarters
square rods be the same more or less.
Together with a right of way to said lot, in and over a
certain strip of land, running from the northerly corner of said
lot, by and along the ridge of plowed land till it reaches Crescent
Avenue so called, (the bearings by compass of the Northerly and
westerly intersection of said right of way with the line of
Crescent Avenue from the northerly corner of the above described
lot, being North thirty degrees east, for the said party of the
second part, his heirs and assigns and his servants and the tenants
and occupants from time to time of the premises above granted, the
said strip of land and way being twelve (12) feet wide.
