MEETING OF MARCH 17,2016 TOWN OF SOOLD ZBA FILE# 6930 NAME OF APPLICANT: Marjorie Adams' PROPERTY LOCATION: 2895 Eugene's Road, Cutchogue,NY SCTM# 1000-97-3-20.1 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines'that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of'Planning issued its reply dated February 9, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The property is a code conforming 140,080 square foot lot located in an R- 80 zone. The parcel runs 418.52 feet along Eugene's Road. The parcel runs 420.09 feet on the West side, 309.30 feet on the North side, and 370.87 feet on the East side. The parcel is improved with a two story frame house and garage and a frame shed. There are wetlands on the Northwest side of the property and there is a 100 foot wide scenic easement bordering the length of Eugene's road. The frame house and garage is 202.2 feet from Eugene's road and the frame shed is 105.1 feet from the road. All is shown on a survey by Nathan Taft Corwin L.L.S. dated October 13,2015 and last revised January 26,2016. BASIS OF APPLICATION: Request for Variances from Article III Section 280-15 and the Building Inspector's December 15, 2015 amended December 22, 2015 Notice of Disapproval based on an application for building permit to construct an accessory in-ground swimming pool and `as built' accessory shed, at; 1)proposed in location other than the code required rear yard. RELIEF REQUESTED: The applicant requests variances to construct an in-ground swimming pool partially in the side yard and to permit the as-built shed to remain in the front yard where code requires a rear yard location. ADDITIONAL INFORMATION: Site inspection by the Board revealed that the existing residence is set back more than 200 feet from,the road and substantial screening obstructs the view; and that the as-built shed is setback from the road at more than 100 feet and is buffered by a wooded scenic easement making it difficult to see. FINDINGS OF FACT/REASONS FOR BOARD ACTION: Page 2 of 3—March 17,2016 ZBA#fi930—Adams SCTM#1000-97-3-20.1 The Zoning Board of Appeals held a public hearing on this application on March 3, 2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes. This home is set far back from the street and is behind a 100 foot scenic easement which consists of wooded trees. The pool is only partially located in a side yard and it will not be visible from the street. The as-built shed is set behind the scenic easement however;the shed can be moved to a conforming location or removed. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant for the non-conforming location of the swimming pool cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The septic system is located in the rear yard and there is a New York state designated freshwater wetlands boundary on the Northwest section of the property making it difficult to locate the pool in a code conforming location. The shed could be located in a code conforming location in the rear yard. 3. Town Law V67-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, there are wetlands which limit the placement of accessory structures and a wooded scenic easement which creates a visual buffer so that the in-ground swimming pool will not be publicly visible. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law W7-b(3)(b)(Q. The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an in-ground swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dantes, seconded by Member Goehringer, and duly carried,to DENY the variance as applied for,regarding the accessory shed, and GRANT the variance for the in-ground pool as applied for and shown on the survey by Nathan Taft Corwin LLS last updated January 26, 2016. Subject to the following conditions; 1. The accessory shed shall be demolished or moved to a code conforming location prior to the issuance of a building permit for the proposed in-ground swimming pool. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. Drywell for pool de-watering shall be installed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity.
