Dear Mr. Dempsey,
The following action was taken by the Board of Trustees at their
regular meeting of February 28, 1995:
RESOLVED that the Southold Town Board of Trustees deny the
application of WALTER GREEN to construct a 4' X 24' catwalk, a
3' X 12' ramp and a 6' X 20' float based on the standards set
forth in Chapter 97-28F that "could adversely affect the
navigation of tidal waters", and Chapter 97-38I that "otherwise
adversely affect the health, safety and general welfare of the
people of the Town", in that this structure just doesn't seem to
be appropriate for the size of the property and that the
property lends itself to access to the water not a structure on
it.

Dear Mr. Dempsey:
In reference to your letter dated April 7, 1995, please realize
that the reason for denial is for boater safety. The only
reasonable access could be a stake and pulley assembly, which
would allow the dinghy to stay moored in the water, without
having to drag it.
If you have any further questions, please do not hesitate to

It is my/our understanding that we are to maintain this
structure with materials designed to endure 30.years and or
equivalent to the original approved structure and that for any
maintenance which involves more than 5% in length of this
structure we are to give prior written notice to the
administrator, waiting for their approval in all but true
emergency situation's which would seriously endanger life,
property and important coastal natural resource features such as
bluffs or wetlands.. We further understand that failure to
maintain the structure could result in a requirement to post a
bo~d and or have the repairs ordered as a lien against.the
property upon a finding .by the Trustees that said lack of
maintenance would risk life, pro~erty or important natural
resources features including p~cted, rare or threatened

agreement shall only be valid upon the final approval of the

Project Description
The project description must also include plsn~ for reclamation
of land disturbed during construction of the principle and
accessory structures and underground structures (i.e., pipeline
and septic system; make additional attachments if necessary).
Proposal to construct 55' long catwalk~ ramp and float to
accommodate dockage of private boat. Proposed construction
is similar in design and size to other docks in the area.

The CAC recommends approval provided the applicant either collect or
divert any runoff away from the ramp into a buffer area behind the bulkhead.
The buffer area to be in accordance with the Town Code (100-215).

RESOLVED to recommend to the Southold Town Board of Trustees APPROVAL
WITH STIPULATIONS of the Wetland Application of ROBERT AND ANNE
MITCHELL 86-2-14 to reconstruct a 4' x 60' timber dock; 3' x 12' aluminum
ramp; 6' x 20' float to be secured with one 3-pile dolphin on offshore end and
two 2~pile dolphins on inshore end of float.
The CAC recommends approval provided the catwalk is shortened to 50'
and a buffer is provided in accordance with the Town Code 1100-215).

Dear Al,
I have advised my client of the Boards decision on February 28th
with regard to his application for a dock.
Mr. Green has asked to to check with you for alternatives for
his situation. Mr. Green has advised me that he has a bad leg
and can submit a letter from a doctor if necessary. He would
like to have some type of access, perhaps a small floating
dock for his dinghy, to get to his moored boat. In other
words, some type'~f docking fOr the dinghy so he can step down
into it rather than having to haul it and step up into it.
