No. 5169 - NORTHEAST OVERSEAS TRADING CO. Location of Property: 3570 Kenney's Road, Southold; Parcel 54-5-23. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the easterly side of Kenney's Road, Southold. The property consists of a total area of 12,482 sq. ft. with 100 ft. frontage along Kenney's Road. The parcel is improved with a new single- family dwelling, constructed under Building Permit #24521 dated September 3, 1998. The setbacks of the existing dwelling are shown on the Peconic Surveyors P.C. survey updated July 13, 1999, at 50.2 feet from the front line and 32.1 feet to the closest corner of the garage at the rear of the house. Also existing is an "as built" open deck shown at 10.3 feet and 22.9 feet from the rear lot line at its closest points. BASIS OF APPLICATION: Building Department's May 8, 2002 Notice of Disapproval denying a permit for an "as built" deck addition at less than 35 feet from the rear lot line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 19, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: APPLICANT'S REQUEST: Applicant is requesting approval of the location of an 'as built" deck addition at 10.3 feet from the rear lot line. The open, unroofed deck is 26 ft. by 24 ft. in size. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board made the following findings: The property is a small lot consisting of 12,482 sq. ft. and improved with a single-family dwelling. Applicant wishes to obtain approval for an "as built"26 ft. by 24 ft. wood deck, constructed 10.3 feet from the rear yard property line instead of the code required 35 feet minimum. Under a prior Appeal No. 4650 dated January 27, 1999, applicant was f Page 2—October 3,0 I, Appl. No. 5169—Northeast Overseas Trading 54-5-23 at Southold granted a rear yard setback variance at 32.1 ft. for an "as built" concrete foundation for the residence. 1. The board believes the proposed 10.3 ft. setback would be too close and intrude on the adjoining property. The board concludes that with a greater setback and minimum relief set forth below, the deck will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. 2. The benefit sought by the applicant can be achieved by some method feasible for the applicant to pursue other than the area variance requested. Applicant can reduce the triangular portion of the deck closest to the rear yard property line to increase the setback to 20 ft. instead of the proposed 10.3 ft. 3. The proposed variance of 10.3 feet is substantial in relation to the code's 35 ft. minimum; and while the board believes a 20 ft. setback is substantial, it is less offensive. 4. The alleged difficulty has been self-created because the applicant maintains that he did not know that a building permit was necessary for the deck. 5. No evidence has been submitted to this board to suggest that this minor variance will have any adverse impact. 6. Grant of the alternative relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an open deck, while preserving and protecting the character of the neighborhood, and the health, safety, and welfare of the community. 1 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Tortora, seconded by Member Oliva, and duly carried, to DENY the requested variance, and ALTERNATIVELY to GRANT a variance authorizing an open deck addition no closer than 20 ft. to the rear property line.
