Lot No. 11, on a certain map entitled, "Subdivision Map of Bayview
v; Woods Estates", filed in the Office of the Clerk of the County of
Suffolk on September 9, 1970 as Map No. 5520.
BEING AND INTENDED TO BE the same premises conveyed to the grantors
herein by deed dated September 27, 1971, recorded October 1, 1971
in Liber 7018 op 87 .

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of,the party of the second part forever.
The grantees herein, Bruno Kern and Annette Saveli Kern, his wife,
hereinbelow affix their signatures to this instrument evidencing
their agreement to assume and pay the existing mortgage on the
premises described herein which was made to the Southold Savings
Bank by Gunter Morchel and Gisela Morchel, his wife, the grantors
herein, dated May 5, 1977 and recorded May 6, 1977 in the Suffolk
County Clerk's Office in Liber 7883 at page 579, and mortgage made
by Gunter Morchel and Gisela Morchel, his wife, to the Southold
Savings Bank dated March 10. 1980, recorded March 19, 1980 in the
Suffolk County Clerk's Office in Liber 8706 at page 29, which
mortgage contained a statement consolidating/with the first mortgage
referred to, which mortgages were consolidated and extended by
Consolidation and Extension Agreement dated March 10, 1980, recorded
March 19, 1980 in the Suffolk County Clerk 's Office in Liber 8706
page 41, and on which the present remaining principal balance is
$57, 700.92 with interest paid to September 5, 1980.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
erationas a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF,the party of the first part has duly executed this deed the day and year first above
written.
