1nT of Goose Neck, situate at Bay View, Town of Southold, in the County
of Suffolk and State of New York, 11 said map being made by Otto W.
Van Tuyl, Licensed Surveyor, Greenport, New York, dated February 27,
1948 and filed in the office of the -Clerk of the County of Suffolk on
the .22nd day of November, 1948, at 3:00 P.M. , as and by Map No. 1663
(Abstract No. 1686) , Book 9, of Maps Page 15, Township of Southold,
being more particularly bounded and. described as follows:
BEGINNING at a point on the northerly line of Smith Drive North
-. where said line is intersected by the boundary line between lots 34
' and 35 as shown on '!Map of Goose Neck" filed in the Suffolk County
Clerk's Office as Map #1663;
RUNNING THENCE along said Lot 34, North 22 degrees 23 minutes 10
seconds East, 200 feet to the bulkhead at ordinary high water mark
of Goose Creek;
THENCE southeasterly along said high water mark and along said
bulkhead about 200 feet to a point which is South 70 degrees 05
minutes 10 seconds East 202.23 feet from the last described point;
THENCE through lot 37 shown on said map, South 45 degrees 42
minutes 40 seconds West, 272.0 feet to said northerly line of Smith
Drive North;
THENCE northwesterly along said line on a curve to the left.,
having a radius of 150 feet, a distance of 105.0 feet to the point
or place of Beginning.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the (:entet lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to
said premises,
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever. !
TOGETHER with the right to use £or all reasonable purposes for i
bathin, boating, fishing, sporting and recreation, in, common with
other plot owners on, said Map, or owners who may hereafter acquire
other plots as laid out on said Map, subject to such reasonable,rules �
and regulations with respect to the use thereof as the said Smiths
hereinbefore mentioned may from time to time put into effect, the
following described premises: BEGINNING at a point on the curved
northeasterly line of Smith Drive North 150 feet southeasterly along
said line from a monument set at its intersection with the easterly
line of Williams Road; and running thence along land now or formerly
of the said Smiths herebefore mentioned, North 40' 13' East 250 .feet
more or less to the ordinary high water mark of Goose Creek; thence
southeasterly along said ordinary 4gh'water mark of Gooso.Creek
110 feet, more or 'less, to other land now or .formerly of aforesaid
Smiths; thence along said other land of Smiths South 690 00' West
2-50 feet, more or less,- to the-easter-ly line of said -Smith Drive
North; thence northerly along the curved easterly line of said
Smith Drive North 23.09 'feet to the point of beginning.
TOGETHER with ail the .right, title and interest of the party of the
first part in and to the public highway known as Smith Drive North
in front of and adjacent to said premises to the center line thereof,
and in and to West Creek, the waters thereof, and the landsunder
the Waters thereof in front of and abutting said premises on the
East thereof.

AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been incumbered in any way whatever, except as aforesaid.
AND the party of the first,part, in compliance with Section 13 of the Lien Law, covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such consid-
eration as a trust fund to be applied first for the purpose of paying the cost of the improvement and will apply
the same first to the payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read"parties" whenever the sense of this indenture so requires.
IN WITNESS WHEREOF, the party of the first part has duly executed this deed the day and year first above
written.
