SEQRA ,DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the Staters List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is improved with a single-story, one- family dwelling located on the southerly side of Cedar Point Drive West, a private road which extends off of Little Peconic Bay Lane, Southold. The total lot size of this property is 11,610 sq. ft. with 90 ft along Cedar Point Drive West and 91 feet along the high water line of West Lake. BASIS OF APPLICATION: Building Departments April 3, 2002 (2001,sic) Notice of Disapproval to locate new dwelling construction at less than 75 feet from the bulkhead: The request with regard to lot coverage was removed from the Building Department's Amended Notice of Disapproval dated July 29;2002 when applicant submitted a revised survey of July 23,,2002. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: A Variance is requested under Sections 100-239.4B for a new dwelling, proposed to replace the existing dwelling, with deck areas, all as shown on the survey dated July 23, 2002,,prepared by Peconic Surveyors, 'P C. Applicants are requesting a setback of 10 feet from the deck to the bulkhead at its closest point. ADDITIONAL INFORMATION: At the public hearing held on August 22, 2002, the applicants agreed to move the house four feet closer to the road, providing for a greater setback for the new house to the bulkhead. REASONS FOR BOARD ACTION, DESCRIBED BELOW Based on the testimony and record before The Board andpersonaI inspection, the Board makes the following findings: 1. (This location is also noted to be approximately 35 feet from the mean high water mark on the southeast corner and 25 feet on the southwest corner of the property.) 3. The requested area variance is substantial, however this is a reconstruction of an existing house and applicant has agreed to move the house four feet landward, thereby increasing the rear yard setback and decreasing the front setback. The code requirement is 75 feet setback from the bulkhead. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The Board of Town Trustees has reviewed this proposal and issued approvals with conditions on July 19, 2000 under#5188 and amendment dated October 30, 2000. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Oliva, and duly carried to GRANT, the variance as applied for(shown on the July 23, 2002), and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The setback from the bulkhead (rear) shall be increased by four feet (as agreed by applicant), bringing the building closer to the front lot line; 2. The setbacks shall be 19 feet on the west corner and 20 feet on the east corner. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. No. 5143- DOUGLAS DEFEIS. Property Location: 1165 Cedar Point Drive West, Cedar Beach Lot 135, Southold; Parcel 90.-1-3. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is improved with a single-story, one- family dwelling located on the southerly side of Cedar Point Drive West, a private road which extends off of Little Peconic Bay Lane, Southold. The total lot size of this property is 11,610 sq. ft. with 90 ft. along Cedar Point Drive West and 91 feet along the high water line of West Lake. BASIS OF APPLICATION: Building Department's April 3, 2002 (2001, sic) Notice of Disapproval to locate new dwelling construction at less than 75 feet from the bulkhead. The request with regard to lot coverage was removed from the Building Department's Amended Notice of Disapproval dated July 29, 2002 when applicant submitted a revised survey of July 23, 2002. , FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: A Variance is requested under Sections 100-239.4B for a new dwelling, proposed to replace the existing dwelling, with deck areas, all as shown on the survey dated July 23, 2002, prepared by Peconic Surveyors, P.C. Applicants are requesting a setback of 10 feet from the deck to the bulkhead at its closest point. ADDITIONAL INFORMATION: At the public hearing held on August 22, 2002, the applicants agreed to move the house four feet closer to the road, providing for a greater setback for the new house to the bulkhead. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The reconstruction of the existing house's character will conform to the local surrounding houses, with no undesirable change in the neighborhood. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance due to the restricted building envelope and wetland restrictions. DeFeis 90-1-3 at Southold • be 20+- feet at its closest point to the property line, and 19+- feet on the southwest corner at its closest point. (This location is also noted to be approximately 35 feet from the mean high water mark on the southeast corner and 25 feet on the southwest corner of the property.) 3. The requested area variance is substantial, however this is a reconstruction of an existing house and applicant has agreed to move the house four feet landward, thereby increasing the rear yard setback and decreasing the front setback. The code requirement is 75 feet setback from the bulkhead. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The Board of Town Trustees has reviewed this proposal and issued approvals with conditions on July 19, 2000 under#5188 and amendment dated October 30, 2000. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Orlando, seconded by Member Oliva, and duly carried to GRANT, the variance as applied for(shown on the July 23, 2002), and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The setback from the bulkhead (rear) shall be increased by four feet (as agreed by applicant), bringing the building closer to the front lot line; 2. The setbacks shall be 19 feet on the west corner and 20 feet on the east corner. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The existing structure although constructed to Building Code then in force,would be ' deemed sub-standard today for several reasons,to name a few; ■ no secondary means of egress in the event of a Fire. • Inadequate,primative wiring • No insulation.etc, _After deliberating with Building Dept.,Officials &area contractors, it was determined that to replace the existing structure on the identical, existing foundation footprint. would be the most practical&economical alternative available to us. We then set about obtaining all the necessary Approvals &Permits to accomplish this. The steps we executed are as follows; -- Southold Town Trustees Wetlands Permit# 5188 —to replace existing structure. • Ammendment to Trustees Permit# 5188 to include existing patio decking, dock • State of New York Dept. of Env. Conserv. Permit# 1-4738-0245/00007 to replace existing structure on same foundation footprint . • US army Corps of Eng. Approval to replace,;)dwelling,on existing foundation ■ Suffolk County Health Dept. Waiver after hearing to approve new septic system for new structure. We were then told by Plans Review that we would need a variance for two issues; - New structure within 75 feet from bulkhead. - Lot Coverage closer to 30%than 20%required. The site data reflects 7,092 S.F. & an existing building size of 1,400. which would be less than than total lot area of 20.% The front& side yard setbacks are also in conformance. &will continue to be. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility, including relevant records,is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permitarea when requested by the Department. A copy of this permit, including all referenced maps, drawings and special conditions, must be available for inspection by the Department at all times at the project site or facility. Failure to produce a copy of the permit upon request by a Department representative is a violation of this permit. General Condition 2: Relationship of this Permit to Other Department Orders and Determinations Unless expressly provided for by the Department, issuance of this permit does not modify,supersede or rescind any order or determination previously issued by the Department or any of the terms, conditions or requirements contained in such order or determination. If future operations by the State of New York require an alteration in the position of the structure or work herein authorized, or if, in the opinion of the Department of Environmental Conservation it shall cause unreasonable obstruction to the free navigation of said waters or flood flows or endanger the health, safety or welfare of the people of the State, or cause loss or destruction of the natural resources of the State,the owner may be ordered by the Department to remove or alter the structural work,obstructions,or hazards caused thereby without expense to the State, and if, upon the expiration or revocation of this permit, the structure, fill, excavation, or other modification of the watercourse hereby authorized shall not be completed, the owners, shall, without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore to its former condition the navigable and flood capacity of the watercourse. No claim shall be made against the State of New York on account of any such removal or alteration 2. The State of New York shall in no case be liable for any damage or injury to the structure or work herein authorized which may be caused by or result from future operations undertaken by the State for the conservation or improvement of navigation, or for other purposes, and no claim or right to compensation shall accrue from any such damage. 3. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S.Army Corps of Engineers, U.S. Coast Guard, New York State Office of General Services or local government which may be required. 4 All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. There shall be no unreasonable interference with navigation by the work herein authorized. 7 If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State, and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. No claim shall be made against the State of New York on account of any such removal or alteration. 8. GENERAL CONDITIONS General Condition 1: Facility Inspection by the Department The permitted site or facility,including relevant records,is subject to inspection at reasonable hours and intervals by an authorized representative of the Department of Environmental Conservation (the Department) to determine whether the permittee is complying with this permit and the ECL.Such representative may order the work suspended pursuant to ECL 71-0301 and SAPA 401(3). The permittee shall provide a person to accompany the Department's representative during an inspection to the permit area when requested by the Department. Granting of this permit does not relieve the applicant of the responsibility of obtaining any other permission, consent or approval from the U.S.Army Corps of Engineers, U.S.Coast Guard, New York State Office of General Services or local government which may be required. 4. All necessary precautions shall be taken to preclude contamination of any wetland or waterway by suspended solids, sediments, fuels, solvents, lubricants, epoxy coatings, paints, concrete, leachate or any other environmentally deleterious materials associated with the project. 5. Any material dredged in the conduct of the work herein permitted shall be removed evenly, without leaving large refuse piles, ridges across the bed of a waterway or floodplain or deep holes that may have a tendency to cause damage to navigable channels or to the banks of a waterway. 6. If upon the expiration or revocation of this permit, the project hereby authorized has not been completed, the applicant shall,without expense to the State,and to such extent and in such time and manner as the Department of Environmental Conservation may require, remove all or any portion of the uncompleted structure or fill and restore the site to its former condition. Any debris or excess material from construction of this project shall be completely removed from the adjacent area (upland) and removed to an approved upland area for disposal. No debris is permitted in tidal wetlands and or protected buffer areas. 3. All areas of soil disturbance resulting from this project shall be stabilized immediately following project completion or prior to permit expiration, whichever comes first. The approved methodologies are as follows: a. Stabilization of the entire disturbed area with appropriate vegetation (grasses, etc.). b. B. stabilized as per specifications identified on approved plans. c. C. temporarily stabilized with straw or hay mulch or jute matting or other similar natural fiber matting within 1 week of final grading. Temporary stabilization shall be maintained until a mature vegetative cover is established. 4. The storage of construction equipment and materials shall be confined to within the project work site and or upland areas landward of the house. 5. All fill shall consist of"clean"sand, gravel, or soil (not asphalt, flyash, broken concrete or demolition debris). 6. Necessary erosion control measures i.e., haybales, silt fencing, etc. are to be placed on the downslope edge of any disturbed area. This sediment barrier is to be put in place before any disturbance of the ground occurs and is to be maintained in good condition until thick vegetative cover is established. 7. Roof runoff shall be directed to drywells landward of the house for immediate on-site recharge. 8. Driveways and parking areas shall be constructed of pervious material.
