No. 5162 - DAVID J. THOMPSON Property Location: 1400 Sound View Avenue, Orient; Parcel 15-3-22. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is a 13,518.7 sq. ft. parcel located on the south side of Sound View Road, Orient. The dimensions of the lot are: 100 ft. along Sound View Road, 125 ft. deep, and 116 ft. along the rear property line. The properties adjacent are: • vacant on the west side, a new dwelling under construction on the east side, vacant on the southwest rear line, and an existing dwelling to the southeast. BASIS OF APPLICATION: Building Department's April 4, 2002 Notice of Disapproval, for an area determined by the Building Department to be greater than the 2 1/2-story code limitation. (This area is above the second-floor master bedroom and adjacent to a small attic.) FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning'Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: Variance under Section 100-30A.3 and Bulk Schedule to allow for a mezzanine, adjacent to a small attic, above the second floor. The floor area of the mezzanine is 248 sq. ft. which is less than one-third of the (second floor) area below it. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record :before the Board and personal inspection, the Board makes the following findings: A, Grant of the area variance will not produce an undesirable •change in character of neighborhood or a detriment to nearby properties. The request for a variance on this application is an internal alteration which cannot be viewed from the outside. The house from grade is 35 feet to the mean ridge. The purpose of the mezzanine is to allow for more natural lighting to the lower floor areas. The height will not exceed the code requirement of 35 feet. 3. The requested area variance is not substantial. 4. The relief is a self-created because it is within an architectural design planned at the applicant's request. 5. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. As explained in reason number one above, the variance is internal, and the house meets all the required setbacks and is less than the 35 ft. height limitation of the code. By utilizing a cathedral ceiling, the applicant is able to construct a mezzanine in the half-story area. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member Orlando, and duly carried to: APPROVE the application as applied for and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The windows in the Mezzanine shall be able to be opened; 2. There is to be a chain ladder located in the mezzanine area for emergency purposes. 3. The area shall NOT be used as a habitable, living area qt any time. '' This action does not authorize or condone any current or future use, setback or other features of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: The applicant's property is a 13,518.7 sq. ft. parcel located on the south side of Sound View Road, Orient. The dimensions of the lot are: 100 ft. along Sound View Road, 125 ft. deep, and 116 ft. along the rear property line. The properties adjacent are: vacant on the west side, a new dwelling under construction on the east side, vacant on the southwest rear line, and an existing dwelling to the southeast. BASIS OF APPLICATION: Building Department's April 4, 2002 Notice of Disapproval, for an area determined by the Building Department to be greater than the 2 1/2-story code limitation. (This area is above the second-floor master bedroom and adjacent to a small attic.) FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, at which time written and oral evidence was presented. Based upon all'testimony, documentation, • personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be trueeand relevant. • AREA VARIANCE RELIEF REQUESTED: Variance under Section 100-30A.3 and Bulk Schedule to allow for a mezzanine, adjacent to a small attic, above the second floor. The floor area of the mezzanine is 248 sq. ft. which is less than one-third of the (second floor) area below it. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in character of- neighborhood or a detriment to nearby properties. The request for a variance on this application is an internal alteration which cannot be viewed from the outside. The house from grade is 35 feet to the mean ridge. The purpose of the mezzanine is to allow for more natural lighting to the lower floor areas. The height will not exceed the code requirement of 35 feet. 3. The requested area variance is not substantial. 4. The relief is a self-created because it is within an architectural design planned at the applicant's request. 5. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. As explained in reason number one above, the variance is internal, and the house meets all the required setbacks and is less than the 35 ft. height limitation of the code. By utilizing a cathedral ceiling, the applicant is able to construct a mezzanine in the half-story area. BOARD RESOLUTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Chairman Goehringer, seconded by Member Orlando, and duly carried to: APPROVE the application as applied for and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The windows in the Mezzanine shall be able to be opened; 2. There is to be a chain ladder located in the mezzanine area for emergency purposes. 3. The area shall NOT be used as a habitable, living area at any time. Such height shall be measured from such datum to the highest level of a flat or mansard roof,or to the average height of a pitched,gabled,hip or gambrel roof, excluding bulkheads and other roof construction as set forth in subdivision (g) of this section. (f) The height in stories of a building shall be determined from a datum established by the average elevation of the finished grade adjoining the exterior walls of the building,where such walls face legal open space or abut other open space which is level for 10 feet or more.Areaways, driveways and entrances of abrupt change in elevation and totaling 10 percent or less of the length of the wall shall not be included in determining the average elevation.
