No. 5191 - MALCOLM and ETHEL McALLISTER 1000-9-6-8.4 and 8.3 STREET & LOCATION: NW side of Oceanview Avenue, Fishers Island SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the northwest side of Oceanview Avenue, Fishers Island. The property is a 3.12 acre parcel improved with two single-family dwellings, all as shown on the map prepared by Chandler, Palmer & King, Surveyors amended 6/28/02. BASIS OF APPLICATION:, Building Department's July 8,2002 Notice of Disapproval for the reason that a portion of a new accessory swimming pool structure (as formed) is located partly in a front yard and side yard, rather than in the required rear yard or in the area conditions under ZBA Approval #5025 rendered 12/13/01. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on September 19, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. AREA VARIANCE RELIEF REQUESTED: A variance is requested under Section 100-33 for a swimming pool structure, which location was modified by the owner or his agent, and requested in a similar yard area, determined by the Building Department to be partly front and side yard, as shown on the amended map prepared by Chandler, Palmer & King dated 6/28/02. The-setback is shown at 64 feet from Ocean View Avenue and 106+- feet from the southerly property line. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted, and personal inspections, the Board makes the following findings: 1. The granting of an area variance will not produce an undesirable change in the character of the neighborhood, or be a detriment to nearby properties because the location of the proposed in-ground pool provides for a 60ft. front yard setback from Ocean View Avenue, and a 100+ft. side year setback from the adjacent parcel. The single family dwelling on this site also has a 60ft. front yard setback. 2. The benefit sought by the applicant cannot be achieved by some other method, feasible for the applicant to pursue, other than an area variance, because the steep topography in Page 2—September 19, 2002 ZBA Appl. No. 5191 -McAllister- 9-6-8.4 and 8.3 the rear yard area, and the location of the applicant's driveway, which is also in the rear yard, leaves the side yard as the only feasible location for a pool on this property. 3. The request variance is not substantial because the pool will have a 60ft. front yard setback, and a 100+ft. setback from the affected side yard. The total lot coverage after this construction will not exceed the allowable coverage for this parcel, which is located on 3.12 acres, in an R-80 zone. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood. There are no wetlands that will be impacted, and the pool will be screened along Ocean View Avenue by a preexisting 6-8 ft. tall hedge row. 5. The difficulty has not been self-created, but is due to the steep topography existing in the rear yard. 6. The action of this board, in approving this area variance, is the minimum that is necessary and adequate for the property owner to benefit from the addition of a pool, while at the same time preserves and protects the character of the neighborhood, and the health; safety, and welfare of the community. REASONS FOR BOARD ACTION: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member, Tortora, seconded by Chairman Goehringer, and duly carried, to GRANT the Variance as applied for, in accordance with the survey prepared by Chandler Palmer and King (CPK Design Group) dated 6/28/02, with the same condition(s) as provided under Appl. No. 5025 (regarding a landscape plan). This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. AREA VARIANCE REASONS : (1) An undesirable change will not be produced in the CHARACTER of the neighborhood or a detriment to nearby properties if granted because: The Board of Appeals, in its decision of December 13 , 2001 (Appeal No. 5026) granted the location of an in-ground swimming pool in the westerly side yard area of this property. Although the contractor made an error in excavating for the construction of the pool 64 feet from Ocean View Avenue, instead of 95 feet, the new location is still in the side yard and does not in any way change the residential character of the neighborhood, nor will it be a detriment to the nearby properties . (2) The benefit sought by the applicant CANNOT be achieved by ' some method feasible for the application to pursue, other than an area variance because: The mistake of the contractor in installing the pool in the 52 ' to 58 ' contour area did not require the taking down of any trees; and will lower the profile of the pool area, blending in with the topography of the front yard. As indicated in the second paragraph of the letter of the contractor, David C. Beckwith, dated June 21, 2002, a copy of which is attached hereto, it would be cost prohibitive, being an additional $176, 500 to relocate the pool to the 95 ' area and landscape the existing location. (3) The amount of relief requested is not substantial because: The contractor' s mistake is actually a benefit in that the pool will be level, or slightly below the front yard area and reduces the need for tall retaining walls, particularly on the westerly side . If the original appeal had proposed the pool in its present location the request for the side yard variance would have been- the same due to the size of -the property and, in particular, this side yard area. At this new location the pool will be 106 ' from the property of the nearest neighbor, Helen P. McKown. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: As stated in the original application, because of the topography of the side yard area and the location of the dry well for the pool ' s backwash, there will be no water runoff . The pool ' s relocation, when completed, will not be visible from the roadway because it will be basically level with the front yard and the fencing will have landscaping screening on the road , side as well as the westerly side. Mr. Goehringer: On July 3 , 2002 I filed an application for relocation of the swimming pool with the Clerk of the Board of Appeals . It has come to my attention that there is a substantial backlog with the Board of Appeals holding public hearings . I respectfully request a public hearing on this matter to be held as soon as possible for the following reasons : 1 . If the location of the pool is approved it takes a minimum of two weeks to order the concrete from Connecticut because of the coordination with the ferry 2 . The construction of the pool takes three concrete trucks for one continuous pour. The Fisher' s Island ferry has room for only two of this size cement truck so two boats have to be chartered during the time of the concrete pour. Once the concrete cures it has to be plastered with concrete which requires only one truck but, again, in coordination with the Ferry District . 3 . Further, the area surrounding the pool will be backfilled and grass planted in most of the areas . Hopefully this can be done before the cold weather to prevent erosion from occurring. _... McAllister, I submitted the above- captioned application to you on July 3 , 2002 . This application was based on the decision of the Builder Inspector dated June 24, 2002 which stated: "1) The proposed accessory pool location do not match the variance granted by the Southold Town Zoning Board of Appeals" . It has come to my attention on July 8, 2002, the Building Department issued a subsequent decision that the location of the in-ground swimming pool is "now being proposed partially in the front yard" . (I am enclosing a copy of the Notice of Disapproval dated July 8, 2002 . ) I checked with the licensed surveyor, Richard H. Strouse, who prepared the plan, and he informed me the determination of the Building Department was not correct in that the relocated proposed pool was still in the side yard area as it was 64 feet from Ocean View Avenue. The surveyor claims the side yard area commences at 60 ft . from Ocean View Avenue due to the orientation of the residence and its relationship with Ocean View Avenue . If Mr. Strouse ' s determination is correct, then the relief requested is for the relocation of the pool in the side yard area. Last summer, I contracted with BD Remodeling & Restoration, Inc. to install a swimming pool on my property. The pool will be used by myself and my family, during the summer months, particularly July and August . It was decided to locate the pool in the side yard because the rear yard contains too many trees which would have to: be removed, as well as the topography is really low, making it totally impractical to locate a pool in ,the rear yard area and have any meaningful use to my family. I agreed to have it located, in the westerly side yard in an area adjacent to the westerly side of the house, as this would be an unobtrusive location. The house on this lot is situated on an angle to Ocean View Avenue so it is not easy to determine where the legal front yard ends and the side yard begins . Be that as it may, I had nothing to do with the application for the Building Permit, the subsequent Variance Application and the actual siting and construction of the pool . Now I find that the contractor did not locate the pool in the area in which he proposed in its application to the Board of Appeals . However, on reflection, comparing the original plan with the revised plan, it is clear to me that the revised plan is far superior and should not interfere with Helen P. McKown' s property nor will the pool be visible from the roadway when completed. Although the pool is still in the side yard area, I am upset because the contractor did the relocation without the Town of Southold' s permission. My family and myself are being punished because of it, as we were supposed to have a completed, operating pool by the commencement of summer. Now all we have to look at is a somewhat ugly, construction site, not to mention that J Zoning Board of Appeals July 1, 2002 Page 2 my family does not have a swimming pool . All of this has happened due to no fault of myself or my family. Therefore, since thee are no additional variances being requested, I am hopeful the Zoning Board of Appals will reconsider the matter as soon as possible, so that my family will be able to utilize the pool this summer.
