THIS INDENTURE, made the 6th day of October, Two Thousand Sixteen
BETWEEN
THOMAS SCHLECHT, residing at 155 Beckwith Avenue, Southold,New York 11971, and
LINDA KOHUT, residing at 70 East 10`h Street, #18F, New York,New York 10003, as tenants
in common,
party of the first part, and
STUART NEWMAN and JOYCE NEWMAN, husband and wife, residing at 5261 Fieldston
Road, Riverdale, New York 10471,
party of the second part,
WITNESSETH, that the party of the first part, in consideration of Ten Dollars and other valuable
consideration paid by the party of the second part, does hereby grant and release unto the party of
the second part, the heirs or successors and assigns of the party of the second part forever,
All that certain plot, piece or parcel of land, with the buildings and improvements thereon
erected, situate, lying and being at or near Arshamomoque, in the Town of Southold, County of
Suffolk and State of New York, bounded on the east by lands now or formerly of Frank P. Rink
and Lillian R. Hollmann; on the north by the Long Island Sound; on the west by land now or
formerly of George P. Lederle; and on the south by the North Road; said parcel measuring 100
feet along North Road, the westerly line being 1000 feet east from the easterly line of land
formerly of William Arnott, as measured along the northerly line of North Road, the easterly and
westerly lines of the above premises being parallel to each other and also parallel to the easterly
line formerly of William Arnott; the above described parcel consisting of Lots 21 and 22 as
shown on an unfiled map of Sound Shore Property of Young and Talmage made by Otto W. Van
Tuyl, L.S. of Greenport,New York, on April 11, 1925, amended July 14, 1944.
The above premises also being bounded and described as follows:
BEGINNING at a point on the northerly side of Middle (North) Road a.k.a C.R. 48 at the
southwesterly corner of the premises herein described, said point of beginning being where the
easterly line of lands now or formerly of Carin Scalva, Melissa Stockholm and Jeffrey Udall
intersects the said northerly side of Middle (North) Road a.k.a. C.R. 48;
THENCE along the last said easterly line of lands, North 13 degrees 56 minutes 40 seconds
West, 181.80 feet to the mean high waterline of the Long Island Sound;
THENCE along the last said line, North 50 degrees 48 minutes 59 seconds East, 110.55 feet to
the westerly line of lands now or formerly of John Clark and Marianne Clark;
THENCE along the last said line of lands, South 13 degrees 56 minutes 40 seconds East, 228.94
feet to the northerly side of Middle (North) Road a.k.a. C.R. 48; and
THENCE along the same, South 76 degrees 03 minutes 20 seconds West, 100.00 feet to the point
or place of BEGINNING.
BEING AND INTENDED TO BE the same premises described in a certain deed from Marie
Schlecht, as Executor of the Last Will and Testament of John A. Schlecht, deceased, to Thomas
Schlecht and Linda Kohut, tenants in common, dated 10/3/2001 and recorded 12/24/2001 in
Liber 12159, Page 836, in the office of the Suffolk County Clerk, and in a certain deed from
Marie Schlecht to Thomas Schlecht and Linda Kohut, tenants in common, dated 101312001,
recorded 12/24/2001 in Liber 12159, Page 837, in the Office of the Suffolk County Clerk.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any
streets and roads abutting the above described premises to the center lines thereof; TOGETHER
with the appurtenances and all the estate and rights of the party of the first part in and to said
premises; TO HAVE AND TO HOLD the premises herein granted unto the party of the second
part,the heirs or successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered
anything whereby the said premises have been encumbered in any way whatever, except as
aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law, covenants that
the party of the first part will receive the consideration for this conveyance and will hold the right
to receive such consideration as a trust fund to be applied first for the purpose of paying the cost
of the improvement and will apply the same first to the payment of the cost of the improvement
before using any part of the total of the same for any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
