SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 5, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The applicant's property is a non-conforming 8,711 sq. ft. parcel in the R- 40 zone. The northerly lot line measures 130 feet along an adjacent parcel. The easterly lot line measures 65 feet along South Oakwood Drive. The southerly line measures 130 feet, and the westerly line measures 70 feet, along other residential parcels. The property is improved with a single family dwelling, (proposed to be demolished and replaced), a hot tub, (proposed to be removed), and two sheds, 100 sq. ft., and 162 sq. ft., both located in non- conforming front yard areas, as shown, with proposed new 2 story single family dwelling, and proposed new septic system, on the site plan/survey drawn by Jeffrey T. Butler,P.E.,P.C., dated Aug. 15, 2016. BASIS OF APPLICATION: Request for Variance(s) from Article III, Section 280-15 and Article XXIII, Section 280-124 and the Building Inspector's September 2, 2016, Notice of Disapproval based on an application to demolish an existing single family dwelling and rebuild a new single family dwelling, at; 1)proposed single family dwelling is less than the code required rear yard minimum setback of 35 feet; 2)proposed single family dwelling is less than the code required combined minimum side yard setback of 25 feet; 3) proposed construction places existing 100 sq. ft. accessory shed in other than the code required rear yard; 4) proposed construction places existing 162 sq. ft. accessory shed in other than the code required rear yard. RELIEF REQUESTED: The applicant requests four variances in order to demolish and construct a new single family dwelling with a Lproposed non-conforming rear yard setback of 10 feet where 35 feet is required by Code, 2. a non-conforming combined side yard setback of 20 feet,where 25 feet is required, 3. and 4. variances to retain a 100 sq. ft. shed, and a 162 sq. ft. shed, located in front yard areas,rather than the required rear yard. Page 2, December 15, 2016 #7008, Zagarino SCTM No. 1000-145-3-3.1 ADDITIONAL INFORMATION: the applicant testified that there was a house on this property before the enactment of Town Code in 1957. As documented by CO Z800 dated Aug. 10, 1960, the existing dwelling was built in 1960. The existing rear yard setback is less than 4 feet, and the applicant has proposed a 10 foot setback for the new dwelling. The one existing non-conforming side yard setback is 5.8 feet, with an existing combined side yard setback of 22.5 feet, and the applicant has proposed a 20 foot combined setback. The applicant received prior relief by the Board of Appeals in ZBA decision#6257, dated May, 19, 2009, in which he proposed to demolish and re-construct a new single family swelling with lot coverage of 23.3%, and a rear yard setback of 10 feet. In that decision the applicant was denied the variances as applied for, and was granted alternative relief for maximum lot coverage of 22%, and a minimum rear yard setback of 17 feet. Thereafter, for personal reasons, the applicant did not take any action, and so the single family dwelling still exists in its original location. After the public hearing the Board adjourned to the next Special Meeting on December 15, 2016 in order to receive letters from residents on South Oakwood Drive and information from the agent regarding the rear yard setbacks of other properties on the west side of South Oakwood Drive. Letters were received from eight neighbors, all in support of the application, as proposed. The adjacent neighbor to the north specifically expressed support for the 10 ft. rear yard setback proposed by the applicant, because it would maintain his existing views of the Bay. According to the agent's information, the two dwellings to the north of the subject dwelling have conforming rear yard setbacks (61 ft. and 42 ft.) and the two dwellings to the south have non-conforming rear yard setbacks ( 9 ft. and 10 ft.) FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on Dec. 1,2016, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b( A)M. Grant of alternative relief for a 15 foot rear yard setback will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. There are 6 dwellings along the south side of South Oakwood Drive, including the applicant's house. Three of the dwellings have conforming rear yard setbacks, and three have nonconforming rear yard setbacks. Grant of the variance as requested, for a 20 foot combined side yard setback, will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties, since the applicant proposes to have a 10 foot northerly side yard setback instead of the 5.8 foot setback that now exists. Grant of the relief for a front yard location for the 162 sq. foot shed and removal of the existing 100 sq. ft. shed will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although there was no other sheds located in front yard areas that were observed within the immediate neighborhood, the sheds have existed in,their current locations for some time without adverse impact, and there have been no objections from neighbors. 2. Town Law &267-W)(b)(2). The benefit sought by the applicant for a rear yard setback of 10 feet can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could conceivably construct a new dwelling that would have a conforming rear yard. However, documentation shows that non-conforming rear yard setbacks and large front yards, similar to what the applicant proposes, exist in the neighborhood. Additionally, the applicant stated that placing a new dwelling in a conforming location would require the costly removal/reconstruction of his existing driveway and impact the location of a new septic system. The grant of alternative relief allowing a 15 foot rear yard cannot be achieved without a variance. The benefit sought by the applicant for a combined side yard setback of 20 feet where Code requires 25 feet cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance.The applicant's Page 3, December 15, 2016 #7008, Zagarino SCTM No. 1000-145-3-3.1 proposed house will be built utilizing modular construction with standard dimensions, and because of the relative narrow width of the parcel the applicant requires a variance for the proposed nonconforming combined side yard setback. The benefit sought by the applicant for the proposed two sheds located within the front yard area can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant could re-locate the two sheds within a 15 foot rear yard area. However, the applicant testified that he stores equipment in the sheds which could not be easily stored or accessed from the proposed basement area, and no attached garage is being proposed where this type of equipment might be stored. 3. Town Law &267-b(3)(b)(3). The alternative relief granted herein for a 15 foot rear yard setback is mathematically substantial,representing 57%relief from the code. However,the existing rear yard setback is less than 4 feet. The variance granted herein for a 20 foot combined side yard setback is mathematically substantial, representing 20% relief from the code. However, the substantiality is reasonable when considering the non- conforming 65-70 foot overall width of the existing parcel. The relief granted herein for locating a shed within a front yard area is mathematically substantial, representing 100% relief from code. However, to insure that the southerly side yard is open and accessible to fire and rescue personnel, the 100 sq. ft. shed in the front yard should be removed or relocated to a conforming rear yard location. Additionally, one shed located within a front yard will reduce the degree of non-conformance to the code. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and a new septic system will be constructed. , 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. Although the applicant's family may have owned and improved the subject parcel prior to zoning, the depth of the property could conceivably permit the construction of a new dwelling that is located in conformity with the current code. 6. Town Law X267-b. Grant of alternative relief, for the 15 foot rear yard setback, and the requested relief for the 162 sq. ft. shed and combined side yard setback, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a new single family dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Horning, seconded by Member Schneider, and duly carried,to GRANT the variance for a 20 foot combined side yard and the front yard location of the existing 162 sq. ft. shed, as applied for and DENY the location for the 100 sq. ft. shed and the 10 foot rear yard setback, as applied for, and GRANT ALTERNATIVE RELIEF as follows: A minimum rear yard setback of 15 feet. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The 100 sq. ft. shed in the front yard will be removed or re-located to a conforming rear yard before a ,Certificate of Occupancy for the new single family dwelling is issued. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Before applying for a building permit, the applicant or agent must submit to the Board of Appeals for approval and filing, two sets of the final site plan, conforming to the relief/alternative relief granted herein. The ZBA will forward one set of approved, stamped drawings to the Building Department. Failure to follow this procedure may result in the delay or denial of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. PROPERTY FACTSIDESCRIPTION: The subject property is a 8,711 square foot parcel measuring 65.00 feet along South Oakwood Drive to the east, 130.00 feet to the south,70.00 feet to the west,and 52.00+78.00 feet to the north. The lot is improved with a single family house and a shed,as shown by a survey prepared by John C.Ehlers, L.S.,dated September 24,2008. - BASIS OF APPLICATION: Requests for Variances under Section 280-124,based on the Building Inspectors November 14, 2008 Notice of Disapproval concerning a new single-family dwelling(after demolition of the existing building), for the reasons that the new construction: (1)will exceed the code-limitation of 20% lot coverage on this 8,711 square foot lot, and (2)will be less than the code-required 35 ft.minimum rear yard setback. FINDINGS OF FACT The Zoning Board of Appeals held public hearings on this application on March 19,2009 and April 23,2009,at which time writtens and oral evidence were presented. Based upon all testimony,documentation,personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: AREA VARIANCE'RELIEF REQUESTED: The applicant requests a variance to allow a 10 foot rear setback and 23.3 per cent lot coverage. Grant ofthe variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed 10-foot rear yard setback for the replacement dwelling, though still non-conforming, will be greater than exists prior to demolition. The proposed increase in lot coverage,given the location of neighborhood houses,would not have any significant effect on this neighborhood of small lots. 2. Town Law Section 267-0)(b)(2). The benefit of`replacing the existing house can be achieved without a variance with respect to rear yard setback only if the replacement dwelling house is placed 30 feet further forward on the properly.-The benefit sought by the applicant to construct cannot be achieved without a variance for lot coverage on a small 8,711 sq.ft.parcel 3. Town Law Section 267-b(3)(b)(3). The variance with respect to lot coverage from 16.6% to 23.3%, amounting to a 3.3%increase over the code-permitted limitation of 20%which is substantial,given the size of the lot and nature of surrounding properties,but 22%.for lot coverage results in an increase of 174.22 square feet which isnot substantial(as the alternative). The proposed variance with respect to the rear yard setback would be substantial, amounting to 71 per cent reduction in the code-required 35 feet. A variance to allow construction leaving a 17 ft. minimum rear setback, while still.substantial, would allow a 48.5 per cent reduction. 4. Town Law Section'267-W)N(5). The difficulty has not been self-created so far as it is a consequence of the small size of the subject lot and the location of neighboring properties. 5. Town Law Section 267-b(3)(b)(4). No evidence has been submitted to suggest that will have a significant adverse impact on the physical or environmental conditions in the neighborhood. Several neighbors have indicated that they would prefer to have the new house situated where it has been proposed than forthe house be constructed in conformity with the code-required 35 feet. 6. Town Law Section 267-b. Grant of the relief requested is the minimum action necessary and adequate to enable the applicant to enjoy a new dwelling on this property,while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. The proposal before you is a request to demolish and rebuild the dwelling essentially in the same location of the existing house with the exception of the South side yard. If approved, an upgraded sanitary system would be installed which is consistent with the LWRP and we believe will improve water quality in the immediate area. The existing sanitary system is substandard. The location of the sanitary system is pertinent to the redevelopment of this lot in that if it were to be moved, the project plan would change and require the driveway to be relocated. As Mr. Zagarino testified, the delay of the project and added costs due to contractor commitments may prevent the Zagarinos from having a new home that would be energy compliant as well. If the approval for the rear yard setback were to increase from 10', it would require a side yard variance on the Northern property line to less than what is proposed now. The split shown on the property card that took place in 1971 was to acquire property from the parcel to the north so that the exterior staircase }° could be built. Additionally, if the rear yard were to,be increased, it would create an undesirable change in the character of the neighborhood (see attached letters from property owners on Oakwood Drive). I must apologize that in our testimony on December 1, 2016, we stated that the 10' rear yard was approved under the prior grant, the survey we received with the approval reading (FINAL MAP REVIEWED BY ZBA SEE DECISION 6257 DATED 5/19/2009, is what the design engineer, myself and the applicant believed to be the approval. It was a complete misunderstanding on my part and I hope that you accept my apology, there was no intent to deceive the board. We respectfully request that you review the documents submitted and consider the benefit to the applicant and the requests of the surrounding neighbors.
