SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated October 5, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. BASIS OF APPLICATION: The applicants request a Special Exception pursuant to Article III, Section280-1313, Subsection 14 of the Zoning Code,to operate and legalize an as built Bed and Breakfast within their existing single-family dwelling, accessory and incidental to their residential occupancy under the Building Department's Certificate of Occupancy 27736-Z dated October 5, 2001. The existing proposed one (1) bedroom for lodging and serving of breakfast for two (2) B & B casual, transient roomers will be located on the basement level were an apartment was created without benefit of a permit through the conversion of an existing garage attached to the single family dwelling ADDITIONAL INFORMATION:. The stove has been removed from the as built kitchen of the apartment and no cooking in the B&B area is permitted or proposed. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on December 1, 2016at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence, and upon review of the code requirements set forth pursuant to Article III, Section 280-13B(14) to establish an Accessory Bed Page 2, December 15, 2016 #7007, Dellaquila SUM No. 1000-115-4-8.4 and Breakfast, the Board finds that the applicant complies with the requirements for the reasons noted below: 1. Frank and Denise Dellaquilla, the applicant(s) herein, and are the owners of the property currently improved with a two story frame single family dwelling with attached wood deck, an in-ground swimming pool and two accessory frame sheds as shown on the survey prepared-by Nathan T. Corwin, III, dated March 17, 2016. The owners/applicants will continue,to occupy same as their principal residence while the Accessory Bed and Breakfast facility is managed and operated. 2. The applicants plans comply with the on-site parking requirements and provide for three parking spaces, two (2)' for the principal single-family use and one (1) for the Accessory Bed and Breakfast bedroom. 3. The applicants complies with the requirements of a dwelling unit as defined in Section 280-4 of the Town of Southold Zoning Code 4. The Accessory Bed and Breakfast, as applied for, is reasonable in relation to the District in which it is located, adjacent use districts, and nearby and adjacent residential uses. 5. The Special Exception is accessory to the principal use and will not prevent the orderly and reasonable use of adjacent properties. 6. This accessory Bed and Breakfast will not prevent the orderly and reasonable uses,proposed or existing in adjacent use districts. 7. No evidence has been submitted to show that the safety, health, welfare, comfort, convenience or the order of the town will not be adversely affected. 8. This zoning use is authorized by the Zoning Code through the Zoning Board of Appeals as noted herein, and issuance of a Certificate of Occupancy from the Building Inspector is required by code before an Accessory use may be occupied. 9. No adverse.conditions were found after considering items listed under Section 280-142 and 280-143 of the Town of Southold Zoning Code. 10. Submission of a Certificate of Compliance or similar document will be necessary for issuance by the Building Inspector certifying that the premises conforms to Chapter 280 of the Zoning Code for an Accessory Bed and Breakfast use. 11. Review of inspection of the premises determined approximate sizes of the following rooms: B&B bedroom 200 sq. ft., Bathroom 82 sq. ft., sitting room area, with breakfast bar 375 sq. ft. 12. This B&B is permitted for two persons only for overnight use. Restrictions of B&B, no sleeping in sitting room and stove and cooking facilities not allowed. I Only Permitted are a microwave, a coffee maker, and a refrigerator. RESOLUTION 'OF THE BOARD: In considering all of the above factors, motion was offered by Member Goehringer, seconded by Member Weisman(Chairperson)and duly carried to GRANT the Special Exception permit for an Accessory Bed and Breakfast, to be used only in conjunction with the applicants-owners residence, as applied for and shown on the survey prepared by Nathan T. Corwin, III, dated March 17, 2016 and Basement Existing Floor Plan prepared by.Deerkowski and Arm,Engineering, dated July 6, 2016. SUBJECT TO THE FOLLOWING CONDITIONS: 1. This Special Exception approval is limited to one(1) guest bedroom/bathroom with occupancy by no more than 2 transient roomers. ' If, in the future, the owners wish to expand the number of guest bedrooms they must submit a new Special Exception Permit application to the Office of the Zoning Board of Appeals. This Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department each year to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. NOTE: This Special Exception permit cannot be transferred to new owners Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any violations of the conditions, occupancy or other requirements described herein, may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception permit as granted herein. The Board reserves the,right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. The house is set back almost 300 feet from New Suffolk Avenue on a 2 acre lot. The house is split level and the B&B bedroom is below the main house and provides a walk out living space. The garage was converted to living area for the owner's parents many years ago and the one bedroom will be used as the B & B rental. C. In addition to meeting the standards prescribed by the zoning ordinance, the following requirements will be met: . - 3 1. The accessory B&B will be located only in the principal dwelling. A smoke alarm shall be provided on each floor and in every guest room. A fire safety notice shall be affixed to the occupied side of the entrance door of each bedroom for B&B use indicating; 1)means of egress, 2) location of means for transmitting fire alarms, if any; and 3) evacuation procedures to be followed in the event of a fire or smoke condition or upon activation of a fire or smoke-detecting or other alarm device. The dwelling shall have at least two (2) exits and there shall be a window to code to provide emergency egress in every sleeping room for B&B use. Means of egress shall include at least one of the following alternatives: 1)A portable escape ladder that attached securely to the sill, shall be provided for second story rooms for B&B use, constructed with rigid rungs designed to stand off from the building wall, it shall be capable of sustaining a minimum load of 1,000 pounds, and shall,extend to and provide unobstructed egress to open space at grade, 2) an exterior stair per code, 3) or limited area sprinkler system per code. The space has large windows and sliding glass doors which provide emergency access directly to the outside. 6. There shall be no exterior signage identifying the use as a Bed and Breakfast in residential areas. OK 7.No accessory apartment, as authorized by Section 280-13(B)(14), shall be permitted in or on premises for which a Bed and Breakfast is authorized or exists. There will be no accessory apartment because the bedroom is proposed for B&B rental. There is no stove in the lower floor living area, there is only one kitchen on the first floor where the family cooks, and the breakfast is served on the lower floor. 8. This conversion shall be subject to a building permit, inspection by the Building Inspector and Renewal of Certificate of Compliance annually. Based upon all testimony,documentation,personal inspection of the properly and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance(s) will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Although both buildings could conceivably be relocated to conforming locations on this large residential property, the large shed is old and would likely be demolished if it had to be moved, and the small shed is surrounded by large trees and on sloping terrain that make it very inaccessible to moving equipment. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial,representing 100%relief from,the code for the shed in the side yard location and 23.6%variance for the shed with the non-conforming setback from the northerly property line. However,the large shed was built in its current location prior to updates in-the-bulk schedule and the small shed_appears_to be in the_conforming rear yard because the property is irregular in shape and the house is sited at an angle to the property lines which then technically dictates the determination of the rear and side yards. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law§267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant has clearly indicated the difficulty in moving either of the two sheds. 6. Town Law §267-b. The notice of disapproval dated September 14, 2016 will be,addressed by the B&B Special Exception application. The room proposed for B&B rental is not being proposed for use as an accessory apartment. The building inspector asked the Board to approve the "layout"which includes a living room and a wet bar. There is no stove. This space cannot be an "accessory apartment" without a stove for an independent cooking area. Moreover, this same room is the proposed B&B rental. Pursuant to your letter of May 18, 2016 we addressed the corridor needed for two rooms by requesting only one B&B room. We have prepared plans of the entire house. We have applied for a building permit for the "as built" renovations of the existing house made by the prior owner. The prior owner, after the two story house was constructed, relocated the bedrooms from the first floor to the second floor. This was all done before my client purchased the property. In addition, my client finished the lower level of the split level house for his parents. The parents have passed away and the space which could be rented as an "owner occupied accessory apartment" will not be used as an accessory apartment. The one bedroom will be rented as a B&B room. The building permit will also include renovations of the lower level. The "layout" of the lower level is used by the family. The finishes such as the granite counters and bar seating is merely a wet bar and seating area. There is no legal basis to demand that the owner remove the finishes (counter seating). The extra bedroom and living area (and wet bar) is enjoyed by the family"as built" as comfortable living space. Their adult daughter enjoys the space when she visits. When the bedroom is rented by a B&B guest, this living area provides a serving area for the "breakfast and snacks", and together with the wine cooler, is the social area to interact with the guests. Every B&B has private quarters for the family and social areas for the guests. When only one room is rented the "layout" is whatever works best for the family and guests. The Special exception approval is conditioned on no separate accessory apartment (typically in another part of the house). This notice of disapproval would be applicable if we were applying to retain the accessory apartment use and rent rooms on another floor. The B&B regulates the rental of the bedroom. The "layout" of the living room and wet bar is open to the B&B guest as well as the family which occupies the entire house. The prohibition of having two accessory uses (in use) simultaneously in a single family dwelling was originally added when the DYER application on Terry Lane (across from my home) requested a B&B. They also had existing accessory apartments being rented in the same house. I oppose permitting two separate accessory uses on the one property. The Zoning Board agreed and later the Town Board legislated the prohibition to require owners to choose between the two accessory uses; a B&B use or accessory apartment, not both uses in the home being run simultaneously. Before the Bed and Breakfast is occupied by guests, the applicant must obtain the final Certificate of Compliance for Bed and Breakfast occupancy from the Building Department. Please also be advised that this Special Exception Permit requires an operating permit and inspection by a Building Inspector from the Building Department that must be renewed annually. It is the applicant's responsibility to contact the Building Department to schedule the required inspection. Failure to do so may require a public hearing before the Zoning Board of Appeals to review potential action to revoke the Special Exception Permit granted herein.
