SUFFOLK COUNTY ADMINISTRATNE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated September 15, 2016 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268'. TOWN OF SOUTHOLD OFFICE OF THE ENGINEER: This application was referred for review to the Office of the Engineer Town of Southold. In the department's response dated November 22, 2016, concluded that the "as- built" deer fence will not pose and traffic hazards or issues at this location. PROPERTY FACTS/DESCRIPTION: The applicant's property is a conforming 80,022 square foot parcel located in an R-80 Zoning District. The property measures 175.00 feet along South Harbor Road on the westerly property line, measures 432.96 feet on the northerly property line, 194.69 feet on the easterly property, and 432.31 feet along a 25 feet right of way on the southerly property line. The property is improved with a two (2) story frame single family dwelling, a free form stone patio, a frame garage, and a deer fence as shown on a survey prepared by John T.Metzger L.L.S., last dated August 15, 2016. BASIS OF APPLICATION: Request for Variance(s) from Article XXII, Section 280-105C (3) and the Building Inspector's June 30, 2016, Notice of Disapproval based on an application for a building permit to legalize an "as- built" deer fence, at; 1) proposed deer fence located in other than the code permitted side or rear yards, located at: 425 South Harbor Road, Southold,NY. SCTM#1000-75-4-29. RELIEF REQUESTED: The applicant requests a variance for an"as-built"deer fence erected in a non-conforming front yard location on the subject property. Page 2,December 15,2016 #7002, Suprenant/Klahre SCTM No. 1000-75-4-29 ADDITIONAL INFORMATION: One of the applicant's neighbors testified in favor of granting the variance. One letter was submitted against granting the variance. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on December 1,2016 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Supplemental Regulations pursuant to Town Code Chapter 280, Section §280-105, Height of fences, walls and berms, establishes that Fences, walls or berms may be erected and maintained, subject to the following height limitations: A. When located in the front yard of residential zones, the same shall not exceed four feet in height. When located in the front yard of nonresidential zones,the same shall not exceed six feet in height. B. When located in or along side and rear yards,the same shall not exceed 6 1/2 feet in height. C. In residential and nonresidential zones, except properties/parcels engaged in bona fide agricultural production, the installation of a deer exclusion fence may be permitted by obtaining a building permit issued by the Building Inspector, subject to the following criteria: (1) When located in or along side and rear yards, the height of the deer exclusion fence shall not exceed eight feet. (2) Specifications for construction of deer exclusion fences: (a)Fencing fabric: high-tensile,woven wire fence fabric with graduated opening. (b) Spacing between posts: 20 feet. (3) Deer fencing is prohibited in or along the front yard of any property 2. At the public hearing the applicants testified that they are beekeepers who engage in the business of making honey and planting flowers that are essential to bee nutrition. They also testified that the as built deer fencing is crucial to the protection of their crops and livelihood. Photographs during the summer months were submitted with the variance application,which showed sunflowers and other cover crops planted on the subject property 3. Agricultural production is a permitted use in the R80 Zone district in which the subject property is situate. 4. At the public hearing the applicants were asked by the Board of Appeals to submit written evidence that they are currently engaged in bona fide agricultural production and that the income from their farming is their primary source of income. 5. On December 5, 2016 the applicants submitted to the Board of Appeals copies of two grant applications for funding submitted by them in 20016, one to Peconic Land Trust, and the other to New York State New Farmers Grant Fund. By letter dated May 12, 2016, from the Peconic Land Trust, Ms. Klahre was informed of a pre- approval of grant monies after demonstrating investment of equipment and infrastructure costs Further, the applicants also presented a planting plan of their crops which was hand drawn on a copy of their survey and received on December 5, 2016. Additionally, they provided a copy of their 2015 income tax return schedule F "Profit and Loss from Farming. 6. A personal inspection of the subject property by Zoning Board members prior to the public hearing confirmed that there is a cover crop on the rear of the property and that the property is in bona fide agricultural production. WHEREAS,the applicants have sufficiently proven to the Board's satisfaction that they qualify for the bona fide agricultural production exception in §280-105C which does not prohibit deer fencing in a front yard location as long as the property remains in agricultural production; RESOLUTION OF THE BOARD: In considering all of the above factors motion was offered by Member Dantes , seconded by Member goehringer,and duly carried,to OVERTURN the Notice of Disapproval requiring variance relief for deer fencing in a front yard because § 280- 105 does not apply to properties/parcels engaged in bona fide agricultural production. Please consider the following: 1. The original Certificate of Occupancy was issued on 3/9/04. Therefore, this existing residence was constructed prior to the establishment of Chapter 236 for Stormwater Management. 2. The"As-Built" installation of Deer Management Fencing will not increase stormwater related concerns at this particular location. 3. 1 have discussed this location with the Highway Department and South Harbor Road does not appear to have any drainage problems or issues that need to be addressed. 4. The Deer fencing as installed does not appear to create any traffic hazards or issues at this location. Explain how you and your operation meet the eligibility requirements®fV%fVG BOARD OF APPEALS Beekeeper Laura Klahre incorporated her farm Blossom Meadow in 2009 and focused on selling honey, candles,and beeswax related products. Up to a few years ago, she managed 100 honeybee hives,equating to upwards of 8 million bees,all of which were on private property on the North Fork of eastern Long Island. In the last four years,with the problems affecting honeybees, Laura re-evaluated the direction of her farm operations. America's food system, including crops from backyard gardens, cannot afford to rely on pollination efforts solely from honeybees. Native bees including mason bees, sunflower leafcutter bees, and bumblebees are 2- 3 times better at pollinating than honeybees. With honeybees only supplementing the work of native bees and the need for more of regional focus on alternative pollinators, Laura has expanded her operations. Although Blossom Meadow Farm continues to run about 20 honeybee hives,the majority of effort is focused on raising mason bees and most recently sunflower leafcutter bees. Blossom Meadow Farm currently uses the mason bees for orchard pollination contracts,a portion of the yearly crop of bees are sold to backyard gardeners,and the rest are ranched on private property to build up future stocks. Most recently,Ms. Klahre has had success in raising sunflower leafcutter bees,a species that is not yet commercially available although they are great pollinators of sunflowers and other composite flowers. In 2015, Laura Klahre and husband Adam Suprenant bought a farm in Southold NY that was previously farmed with field mums. Much of 2015 was focused on cleanup of the property, including the leasing of equipment to rotovate and plant a mixed-seed cover crop to build the soils. The newly-purchased land gives Blossom Meadow Farm a more solid base of operations and a firm footing for increasing future stocks of mason bees and leafcutter bees,as well as cultivating crops resulting from the work of alternative pollinators: sunflowers(product: dried seed heads for natural bird feeders,using sunflower leafcutter bees);beach plums(products: fresh plums and jam,using mason bees);raspberries and blueberries (products: fresh berries and jam,using bumble bees); and vegetables. Section 2: Reimbursement Request 2)What will the equipment and/or infrastructure be used for and how does it meet the eligibility criteria checked under Section 1D? The proposed funds are to build the infrastructure of Blossom Meadow Farm, specifically to erect a barn(storage of equipment and drying of sunflowers),and secure farm equipment (tractor,refrigerator for overwintering bees,seeder, etc). 3) What opportunities will this capital investment create and what kind of economic impact will this investment have on your operation? A)expanding and diversifying agricultural production This infrastructure will enable us to vastly improve Blossom Meadow Farm's profitability by expanding our agricultural production(bee livestock)and diversifying our agricultural production(sunflowers,beach plums,blueberries,raspberries,vegetables). B) Advancing innovative agricultural techniques that increase sustainable practices Raising and relying on alternative pollinators for our farm's pollination needs is innovative and will increase our farm's sustainability (not relying just on honeybees)and profitability (higher quality fruit as per current peer-reviewed literature). In addition,with more mason bees and sunflower bees, Blossom Meadow Farm will be able to increase the number of pollination contracts each year,increasing other farm's sustainability and profitability as well. Protecting and enhancing habitat for native crop pollinators within the layout of the farm is the newest paradigm in farming, according to the Xerces Society's 2015 publication entitled Fanning for Bees: Guidelines for Providing Native Bee Habitat on Farms. To this end,Blossom Meadow Farm's layout is innovative too. Not only will we be mindful of the types of pesticides used and plants planted,we are setting aside existing natural habitat for the pollinators. As per the map,the early successional habitat set aside on the north side of the property(comprised mainly of little blue stem,goldenrod,and milkweed)already has an existing population of mining bees living in the ground. Blossom Meadow Farm is also innovative by planning to cultivate raspberry in a high tunnel. While the East End of Long Island has nearly ideal growing conditions for raspberry production, frequent rains during bloom and harvest reduces yield, fruit quality and shelf life. High tunnels are unheated large hoop houses covered in plastic that provides an intermediate level of environmental control between field-grown and greenhouse grown crops. The advantages of growing raspberries under high tunnel are increased fruit size and quality, season extension(both early and late)and the reduction or elimination of the need to spray chemicals for insects and disease. Our project will utilize a 30'x 96' GrowSpan round premium high tunnel that was purchased from FarmTek in 2008,never erected, and is currently in storage. Blossom Meadow Farm plans to install photovoltaic solar panels on the proposed barn's roof to fulfill the farm's electric needs, another way we plan on being sustainable. A standing seam metal roof is proposed for the barn because the solar panels can easily be integrated. Although asphalt and composition shingles are probably the most common form of roof in the U.S.,they are one of the worst options for solar panel installation. In most cases,the warranty life of the asphalt roof does not equal the life of the solar panels so it's likely the roof will have to be replaced. Also, common mounting racks require penetrations through the asphalt shingles to reach the roofing structural members below. Those penetrations could lead to leaks and other roof problems and will most likely void the warranty from the roofer and shingle manufacturer. Q Expanding partnerships with other entities such as farm operations and institutions For 2016,I have mason bee pollination contracts with Surrey Lane Orchard(apricots) and Sang Lee Organic Farm(cherries),and again with Breeze Hill Farm. By increasing stocks,we will be able to service more farms in 2017 and beyond. The immediate priority is to get 425 South Harbor Road into production. What types and quantities of agricultural products are currently produced and sold? Current Blossom Meadow Farm agricultural products include mason bee cocoons(sold directly and used for pollination contracts),beeswax products (candles, crayons, lip balm,lotion bars), honey, and seeds(Asclepias syriaca seed packets and native seed wreaths for birds). The total valuation of agricultural products sold in 2015 was over$20,300. Mason bees and mason-bee related items were first sold in 2015,resulting in approximately 15%of Blossom Meadow Farm's sales for the year. Honeybee related agricultural products still comprised over 75%of crop sales in 2015,including over 2,500 candles and over 800 2ounce and 9ounce jars of honey sold. The percentage of sales from honeybee-related items is expected to decrease as the other product categories continue to gain strength. For example, 558,mason bee cocoons were sold to the general public in 2015 and this sales number is expected to dramatically increase over time with more public awareness and interest. Who,what and where is your market(s) or target customers? Blossom Meadow Farm's income is derived from retail sales,wholesale,and writing/consulting/pollination services. While pollination contracts are still dominated by honeybees across the United States, I landed the first known pollination contract for mason bees on the East Coast(Breeze Hill Farm—apples)in 2015. For 2016,I have mason bee pollination contracts with Surrey Lane Orchard(apricots)and Sang Lee Organic Farm(cherries),and again with Breeze Hill Farm. An undesirable change will not be produced in the character of the neighborhood or a detriment to nearby properties if granted, because the property is located in the heart of the agricultural district and, as stated in the Southold Town Comprehensive Plan, "agriculture is an integral part of the identity of the town". The 1.837-acre property located at 425 South Harbor Road, shares about one quarter of its border with Catapano Farm and is less than 500 feet away from two farms that have deer fence on part of the road frontage. Blossom Meadow LLC. (dba Blossom Meadow Farm), owned by property co-owner Laura Klahre, has been actively farming the property since it was purchased in May 2015. In addition to her apiary operation, Blossom Meadow Farm is currently growing sunflowers and other cover crops in back (east) of the residence and along the north side of the property up to the western border of the front yard. In 2017, the operation will expand to commercially grow blueberries, raspberries, beach plums and vegetable crops to offer for sale at its retail location on the Main Road in Cutchogue. Blossom Meadow Farm has been awarded a grant in 2016 from the Peconic Land Trust to pursue its expansion plans. Finally, there are neighboring properties on South Harbor Road that have living fences, consisting of lilac and privet, in the front yards of their properties that equal or surpass eight feet in height. 2. The benefit sought by the applicant cannot be achieved by some method feasible for the applicant to pursue, other than an area variance, because of to the proximity of the property to other residential dwellings. Deer hunting would not be allowed because of setback requirements. Deer regularly visit the property every evening to browse on the cover crops and to bed down for the night. An eight-foot woven wire deer exclusion fence is the gold standard for deer control and is utilized by many farming operations in the Town of Southold. The amount of relief requested is not substantial because article XXII, section 280-105A of the Southold Town code allows a fence in the front yard of a residence not exceeding four feet without a building permit and the variance being requested is for an additional four feet to the height of the fence. 4. The variance will not have an adverse impact on the physical or environmental conditions of the neighborhood or district because it does not add to the footprint of the allowed four-foot fence under article XXII section 280-105A of the Southold Town Code. 5. The alleged difficulty has not been self created because there is ambiguity in the language of the Southold Town zoning code that can lead to differing interpretations of the law. Article III, section 280-13A, subsection 2 of the Southold Town Code allows agricultural operations as a permitted use for R- 80 zoning and Chapter 280 of the Southold Town code does not specifically obviate agricultural operations on a parcel with R-80 zoning after a residence is built. I live right next to his property and have to drive passed the front of his house and down the side of his property to get to ours multiple times a day. I grew up in the Peconic/Southold town my whole life, as did my parents, grandparents,and great grandparents. My wife and I built our house 12 years ago and are raising our 3 children. Coming from a farming family myself, I understand and appreciate farming on the East End however, existing zoning has been created to balance both agricultural and residential needs. Adam Supernant's property is zoned as a residential lot, not agricultural,and as per the code that is already in place,8'high deerfencing in the front yard is not allowed in ourtown for a reason and should not be made an exception because of the potential negative precedent a variance such as this would create. Already,we receive comments by friends, neighbors,and locals that their fence looks like a prison and has been called the "Southold Penitentiary." If this is allowed and others attempt to follow suit, I would hate to imagine what our street, or any street,would look like lined with 8'high deer fencing across the front of everyone's homes as I drive or bike to the beach or to my children's school? I know that our neighbor has a dream of"farming"and I wish them all the best with whatever they plan to grow,we too enjoy and maintain a vegetable and herb garden in our backyard like many other people do out here. But we too had a dream,of living in a beautiful residential area between two other residentially zoned lots/houses where we could drive down the street and not see houses surrounded by 8' high fences. I hope they are made to obey the codes like everyone else has to and can respect and understand our need to express our personal position and our concern for our community in which we live.
