WHEREAS, Suffolk Environmental Consulting, Inc., on behalf of MILDRED M. PASCUCCI applied to the Southold Town Trustees for an Amendment to Wetland Permit#8920 under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated December 5, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found to be Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, ` } 2 WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on April 17, 2019 and July 17, 2019, at which time all interested persons were given an opportunity to be heard, and, NOW THEREFORE BE IT, RESOLVED, that the Southold Town Board of Trustees APPROVE the Amendment to Permit#8920 to install an AI/OUTS septic system (Hydro-Action AN400) within the established 15' wide non-disturbance buffer area that runs along King Street, utilizing ±300 cubic yards of clean fill retained and surrounded by.a 160 linear foot long retaining wall with a top elevation of 6.5 ; and to install a native planting scheme featuring the planting of beach grass over an 88'x20' area running along the easterly portion of the premise and over the septic system; with the condition of the prohibition of sod within the area presently labeled as "native fescue" and the addition of baccharis on the southern and northern side of the property; and as depicted on the revised site plan prepared by Suffolk Environmental Consulting, Inc., received on August 2, 2019, and stamped approved on August 2, 2019. I own the property at 435 Narrow River Road(formerly 225 Narrow River Road),Orient, NY 11957, next to 305 Narrow River Road, where I have been a resident since 1965. 1 oppose the application regarding the permit in question.Given the precarious environmental conditions,the addition of any building on the land would be detrimental to the entire area,including at least a dozen nearby properties with houses. The lot in question is located in a precarious low-lying spot,adjacent to protected wetlands and close to Hallocks Bay and Orient Harbor.Over the past 50 years,the area has become even more vulnerable as a result of beach erosion,soil depletion,and other natural and man-made changes.As a result,flooding and drainage are major issues of concern for residents in the vicinity. Unfortunately, I have seen and experienced serious flooding on Narrow River Road.The flooding reached a devastating crisis point during Super Storm Sandy. My home was severely damaged during the storm,in part because there is not sufficient protection from severe high tides,storms,and extremely heavy rain.Any construction on the lot at 305 Narrow River Road will put all the land and homes in the neighborhood at greater peril. In order to protect the natural beauty and sustainability of Narrow River Road,the sensitive wetlands,and current dwellings in the area, I strongly urge you to reject the application. Pascucci 305 Narrow River Road, Orient SCTM# 1000-26-3-11 Dear Members of the Board of Trustees, On April 17, 2019 I read through the file for the above referenced application and performed an engineering field inspection of the subject property on behalf of Catherine Matthews, the northwesterly adjoining owner located at 275 Harbor Road, Orient,New York. Based upon my reading of the file and field inspection I observed or determined the following: Groundwater Elevation/Soil Conditions The subject property and adjoining properties have a very high water table. The test hole data shown on the survey of the Pascucci property reveals that groundwater was encountered at d depth of 2.6which the surveyor denotes as being at elevation 0.2' and then denotes this as being the "highest expected groundwater" elevation. The sanitary plans for this application were prepared by Joseph Fischetti P.E. and denote that the highest expected groundwater to be at elevation 1.0', which I presume allowed for a variation(or increase) in the groundwater elevation. When I performed my field inspection I found the groundwater elevation to be only 6" below the top of the casting on the drainage structure at the corner of King Street and Harbor Road. The survey shows that the street elevation adjacent to this structure is 2.03'. The top of the casting is close to this road elevation,making the groundwater elevation at the time of my inspection on April 17,2019 approximately elevation 1.5'and not elevation 0.2 reflected on the sanitary plan test hole. The weather was clear at the time of my inspection so I would expect that the "highest expected groundwater" would be at a somewhat higher elevation, probably closer to elevation 2.0'. In the course of my inspection I also observed areas of 1 ponded water on the road shoulder along the edge of the property as well as within the property itself. An examination of the soil boring depicted on both the survey and the sanitary plan reveals that the top 1' of soil is "dark.brown loam" (top soil) and that the next 3' is "brown silt" with water in the lower half of the "dark brown loam" strata, followed by a strata of coarse sand to a depth of at least 9'. This soil condition is classic for a wetland. If the normal groundwater elevation is approximately 1.5, which I believe it is, then it is my opinion that a minimum design value for the "highest expected groundwater" elevation would be 2.0', which allows a half a foot above the normal groundwater elevation. If this groundwater elevation were used with the current sanitary design the top of the septic system retaining wall would be at elevation 7.5' and would result in a facial reveal of as much as 5.5', which is higher than the application states. Additionally the retaining wall shown on the applicants sanitary plan has a footing protruding 4' into the right of way,which I am sure would not be permitted. If this d'es'ign were amended and the footing were to protrude into the site the footing would be under the leaching area for the sanitary system and would impede the performance of the proposed sanitary disposal system. During the hearing there was discussion about relocating the sanitary retaining wall to 4'within the property.If this was done,the retaining wall could be constructed as shown on the current plan, but the footing-for the wall would be under the 4' setback area and would likely hamper the propagation of any propose screen plantings within the setback. Additionally it should be recognized that this would be a great reduction from the 15'wide undisturbed buffer along King Street which was a condition of approval in Trustees Permit No. 8920 dated November 16,2016. Also the 4'relocation of the retaining wall would necessitate the inward movement of the sanitary leaching system and result in a further diminishing of the already inadequate separation distance between the proposed water supply wells and the sanitary leaching system on the subject property and the property of Mrs. Matthews. As proposed the well to cesspool separation distance is 87' for the Mrs. Matthews well and 78'for the on site well. The Health Department normally requires a minimum well to cesspool separation of 150' but this minimum can be reduced to an absolute minimum of 100' if a deeper well is provided. In this case'we do not know the depths of the existing wells, but we do know that they are well below the absolute minimum separation and if the proposed sanitary system wall is relocated to 4' inside the property line the separation distances will be only 83'for Mrs. Matthews well and 74' for the well on the subject property. Further, it is likely that Mrs:Matthews well depth is such that it will require the 150' separation. Site Drainage The construction of the leaching portion of the sanitary system and the storm water drainage will require excavation of all poor draining material existing below such systems (in other words a full excavation of the loam and silt strata), followed by the importing of coarse sand fill to facilitate drainage.It is also likely, thaffor structural p ECEIVE APR 2 6 7019 11/ , reasons, the same loam and silt strata will have to be excavated and replaced with compacted structural bearing material under the proposed dwelling and the septic system retaining wall. The upper soil strata of the proposed construction site are nonporous, and currently storm water falling on the property remains on the surface and leaches very slowly.having little impact upon the water table. However, the removal of most of the nonporous strata and replacement with well draining material will result in a rapid absorption of sanitary effluent and storm water and an increase in the local water table for both the subject and adjoining properties during storm events. This will have an adverse effect on both the sanitary and drainage systems for these adjoining properties. Storm water is proposed to be contained by a French drain system as specified on the sanitary/site plan. The storm water containment proposed on the sanitary plan will store approximately 336 cu. ft. of storm water at full efficiency. This volume is based upon a design parameter of a 35%void in the French drain material. The proposed dwelling is approximately 2,115 sq. ft. and the driveway is an additional 400 sq. ft. Based upon a 2" rainfall the runoff from these improvements would require the storage of 420 cu.ft. of storm water, therefore the proposed French drain system is inadequate. Additionally there are many storms that exceed a,2" rainfall which would further overwhelm the system and result in an increase in the water table or runoff onto the contiguous properties and it must be recognized that French drain systems become less efficient over time due to the intrusion of silt fines. Additionally,there are a number of grading issues with the site,particularly in the area of the driveway and the French drain, as well as the grading transition to the Adjoining property. As a minimum,the applicant should be required to have a complete topographic survey of the subject property with the topography extending onto portions of the adjacent properties, and based upon this complete topography, the applicant should provide a comprehensive grading plan prepared (at a minimum scale of 1"=20') that details the proposed dwelling and grading details for all of the proposed construction and the transitional grading to the adjoining properties. Impacts to the Neighborhood Another consideration is the visual impact of the improvements proposed by the application. The proposed concrete retaining wall with a maximum facial exposure of 5.5' located on the property line, or even 4' from it, is visually objectionable; even if landscaped the visual impact of the wall will be substantial and will certainly not be mitigated by the planting of"Beach Grass" and the wall may actually be hazardous due to its impairment of vehicular site distance as the property is a corner lot. In addition to the aesthetically displeasing retaining wall,the proposed dwelling, as shown on the plans, has a proposed first floor area of approximately 2,115 sq. ft., and according to the plans, is to be a 2-story residence which could result in a home with a total floor area of over 4,000 sq. ft. It is highly questionable whether a home of such size EC EE VE APR 2 6 2019 Southold Town would be appropriate for this 93'by 128' corner lot with an area of 12,505 sq. ft. Plus the home appears to have a unique shape and only one accessible parking place which will also adversely impact the character of the community.I also observed'that while the lot has an area of 12,505 sq. ft.,the lot area on the sanitary/site plan is incorrectly stated as 25,505 sq. ft. This area should be corrected so that any reviewing authorities'are basing their'determinations on the correct lot area. I am appalled by the fact that the project would be put before the Board of Trustees in the middle of February when no one is around to attend and object to this proposal. I will attach a photo of the notice for the hearing for you to decide if it is prominently placed. Note that it is posted on a stick less than two feet high, is not protected by plastic, and is not readable from ones car, would not even be noticed from the other side of the road. 1. I am shocked that after 40 plus years and various attempts at finding potable water, that this has been accomplished. 2. I question the "new" septic system because if it fails, I have no potable water which directly effects the value of my beloved home. Unless you can guarantee this will not happen, I and other neighbors will be forced to seek legal council. 3. I'm confused about who is proposing the dwelling on this property. The last proposal was from the Hansen's and if memory serves me right, the lot in question is presently owned by Ms. Pescucci. I am led to believe the sale of said lot is contingent upon approval of the proposed project. 4. Let it be known that the lot behind, owned by Abby Tannenbaum is available and would present less headaches for the proposed project, well and septic are already in place. 5. The lot should be declared wetlands as it is under water at all times, rain or no rain, and completely floods during even the most insignificant rain storms. 6. Wildlife have made this lot a place of refuge and would be displaced if the proposed project was to be completed. 7. This is my biggest concern. The amount of fill, ( SIX AND ONE HALF FEET!) required to install the "new" septic system and construction would cause gross displacement of water from the lot to the surrounding properties, flooding basements with the possibility of causing structural damage. They are obviously aware of the flooding issue and are willing to solve the issue at the expense of their neighbors. This is outrageous!! 8. The delicate ecological balance of this area we call Hog Pond will be greatly disturbed the negative effects will remain forever. 9. No one could have predicted the amount of change that would take place over the years. The properties on the Bay in front of my house have half of the beach that they had when they built. Mother Nature is unstoppable, but we mortals have a grave responsibility to save what's left so that generations to come can experience the pristine beauty of that which I call home. Please carefully consider this project and avoid setting a dangerous precedent allowing septic systems dangerously close to drinking water and the wetlands across the Narrow River Road, not even twenty feet away. I live and own property on the same block of the proposed build site at 305 Narrow River Road in Orient under the name of"Pascucci". We live very nearby the property and have concerns about the proposed addition of 300 cy of fill and a retainer wall being added to that location. During heavy rains and high tides, the property at 305 Narrow River Road is constantly flooded, as are all of the surrounding properties. That site specifically (305 Narrow River Road) is flooded at nearly all times, even without a storm as it appears to be mostly wetlands. Any building on that site, specifically an addition of a retainer wall and 300 cy of fill will only exacerbate the flooding on our property and those of our neighbors. The town placed a berm across from that property about 3 years ago. The berm does help but it needs to be MUCH HIGHER, as flooding still does occur in that area frequently, and rises OVER the berm that the town put in place. Should the town create a berm that is taller for that area, perhaps the flooding would be kept at bay. The berm that the town built is across from the property at 305 Narrow river road and runs from the cemetery to the parking lot near the bay. We are not opposed to building on that site, but we of course do have concerns that any design be created in a way that is mindful of the surrounding properties when it comes to flooding - specifically water being pushed to the surrounding properties. Any structure placed on 305 Narrow River road must be designed in a way that water from future flooding does not push water to the surrounding properties, including ours. We don't know if you realize how wet that lot is. It floods frequently, even on high tides. When water comes in from across the marsh, it is the first place that gets flooded. The lot retains a lot of water. Putting in 300 cubic yards of fill will cause worst flooding in the surrounding properties. I am attaching three photos that I took. One is of a shore bird, perhaps a plover or a ruddy turnstone, feeding in that lot on September 30, 2018. The lot was a wetland even though there had not been rain or a storm in the past several days. The other 2 photos show the flooding during the nor'easter on Oct 27, when much of the block was flooded. We really can't understand allowing more development in an area that constantly floods. How will roof runoff be directed to the proposed French Drain? • How will stormwater be directed from the driveway trench drain to the French Drain? What size pipe? Will the drainage pipe be continued into the French drain? • Due to the soil types as shown in the Test Hole provided, I would recommend that all basic fill material proposed for this site be clean sand or bank run materials. From what I can see,the concept for storrnwater management is acceptable. However,some changes will be required as follows: 1. The proposed French drain detail will need to be revised. The final area of the gravel drain will need to be elevated or spread out to provide a minimum separation of two (2)feet from the water table. In addition,the leaders from the gutter system need to be connected to a system of perforated drainage pipe running through the gravel drainage field. 2. The proposed gravel drainage field will also require over-excavation to a depth below the indicated layer of Brown SIR, According to the test hole, that will be a depth of approximately 4' below grade. This area must then be backfilled with clean send to a height of 2'above ground water prior to construction of the gravid field. 3. The proposed sanitary system retaining wall enclosure should be set back from the property line by about five(6)feet. This will allow stormwtater in the roadway to pond in the Town's road shoulder without negatively affecting the functionality of the proposed sanitary system. From what I can see, the concept for stormwater management is acceptable. However, some changes will be required as follows: 1. The proposed French drain detail will need to be revised. The final area of the gravel drain will need to be elevated or spread out to provide a minimum separation of two (2')feet from the water table. In addition, the leaders from the gutter system need to be connected to a system of perforated drainage pipe running through the gravel drainage field. 2. The proposed gravel drainage field will also require over-excavation to a depth below the indicated layer of Brown Silt. According to the test hole, that will be a depth of approximately 4' below grade.
