Y~ur actlonf or should I say non-action, was the identical action you had t~ken monthsprior t~ my sending you the aforementioned letter. This leads me to ask if you even read the contents of my letter. You seem to be adamant about receiving letters from the neighbors, and yet the neighbors are adamant about not sending any letters. Rather ~han repeat myself, would you please read my July 15, 1992 letter wherein we address our efforts to obtain such letters. A very upset Mr. Gobic called our office today; Another year has gone by and he is about to leave for Florida again, no closer to having a permit than this same time last year. He is paying taxes on this property and does not understand how the Trustees can allow the lac~ of cooperation by the adjoining property owners to prevent him from due process of his application. By not scheduling a public hearing, I believe you are relinquishing your authority to act on this application and giving the control to the ad~oinin~ property owners as to whether or not the proposed dock should b~ constructed. Isn't the reason to hold such ~earings for the Trustees to obtain public comments before a decision is rendered? Please note that the letters were sent in April and they included photographs of docks similar to that proposed for Mr. Gobic. Having received no written response to our letter, Mr. Gobic and his son visited the neighbors in person to discUss the ma~ter. Contact was made with Mrs. Young's grandson, who acting on behalf of his grandmother, expressed they had no objection to the proposed dock. Mr. Loehr, the other adjoining property owner, advised our client that his only objection was that he did not want to visually see the dock from his property. Not being able to obtain a written statement in opposition nor in favor, and in lieu of the foregoing, we respectfully request that the Town schedule a public hearing to bring this matter to a conclusion. A public hearing, at this time, will give the neighbors a "third" opportunity to express any opposition they may have. This would then allow the Board of Trustees to make a determination based on the information brought forward. I would also like to reiterate that the Army Corps sent each neighbor notification of the proposed project and they were given an opportunity to express their comments. Mrs. Young had her grandson address the matter by corresponding with the Army. Since that time, the concerns they expressed have been resolved. Because one neighbor fails to respond, I do not believe this Southold Town Board of Trustees July 15~ 1992 Page 2 of 2 constitutes reason that Mr. Gobic be denied his right to a public hearing and due process of his application.
