SUPERVISOR RUSSELL: Please rise and join in the Pledge of Allegiance. Thank you. First I
would just like to extend the regrets of Councilman Ghosio. He actually has been very ill, he
actually came in during work session today because he didn't want to miss the budget discussion
but honestly, with a high fever, he just couldn't come back. Now, I am going to offer the
opportunity to anyone who wants to comment on any of the agenda items to please feel free?
Actually, before you do that, I want to announce that on November 6 at 3:30 right down here at
Silversmiths Corner there is going to be a service called Respect and Civility Vigil and that is
going to be sponsored by the Southold Town Anti-Bias Task Force. Again, that is Sunday,
November 6 at 3:30 at Silversmiths Corner. Now, would anybody like to address the Board on
anything on the agenda? (No response)

WHEREAS there has been presented to the Town Board of the Town of Southold, Suffolk
County,New York, on the 9t1i day of September, 2016, a Local Law entitled"A Local Law to
consider amending Southold Town Code Chapter 100 (Buildings, Unsafe; Property
Maintenance) to (i) restrict the placement of dumpsters on residential properties" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard,Now
Therefor Be It
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
law entitled, "A LOCAL LAW to consider amending Southold Town Code Chapter 100
Buildings, Unsafe; Property Maintenance) to (i) restrict the placement of dumpsters on
residential properties"which reads as follows:
LOCAL LAW NO. OF 2016
A LOCAL LAW entitled to "A LOCAL LAW to consider amending Southold Town Code
Chapter 100 (Buildings, Unsafe; Property Maintenance)
BE IT ENACTED by the Town Board of the Town of Southold as follows:
I. Purpose
The purpose of this amendment is to amending restrict the placement of dumpsters on residential

properties
II. Chapter 100 of the Code of the Town of Southold is hereby amended as follows:
§ 100-4 Standards.
A. Property maintenance.
(1) Surface and subsurface water shall be adequately drained to protect buildings and
structures, to prevent damage to adjacent property and to prevent the development
of stagnant ponds. Swimming pools, spas, hot tubs and other similar structures
erected for recreational use shall be maintained so as to avoid the stagnation of the
water therein.
(2) Landscaping shall be adequately maintained so that lawns, hedges, bushes, weeds
and trees do not become overgrown and unsightly so as to constitute an unsafe
condition or blight. At no time shall landscaping,hedges, bushes, weeds or trees
create an impediment to emergency and/or fire rescue vehicle access.
(3) Garbage, crates, rubbish, refuse or debris shall be kept inside a building or
buildings on the premises, or in an acceptable enclosed container, and shall be
regularly collected and removed from the premises.
(4) No dumpster shall be permitted in the front yard or side yard of a residential
Property for more than two weeks, unless the property benefits from an open
and valid building permit. If the property benefits from an open and valid
building permit, said dumpster may remain in the front yard or side yard
until either the building permit expires, or a certificate of occupancy and/or
compliance is issued for the work described in the permit,whichever occurs
first. Thereafter, the dumpster must be removed. Properties used for
bonafide agricultural production shall not be subject to this provision.
(4)_(51 Open wells, cesspools or cisterns shall be securely closed or barricaded to prevent
access by the public.
(-5)_(6)Junked or unregistered vehicles may not be located or stored in open view but
shall be stored in a suitable location inside a building or behind a fence outside of
public view.
(6)L71Exterior facades shall at all times be kept free of graffiti or other defacement.
111. Severability
If any clause, sentence,paragraph, section, or part of this Local law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgement shall not affect the validity of this
law as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. Effective Date
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

the Preliminary Budget of the Town of Southold for the fiscal year beginning on the 1St day of
January 2017,the itemized statement of estimated revenues and expenditures hereby attached
and made part of this resolution, and be it
FURTHER RESOLVED that this Town board shall meet at 4:00 PM, Wednesday, on the Stn
of November,2016, at the Southold Town Hall for the purpose of holding a public hearing on
the 2017 Preliminary Budget, and after all persons attending said hearing shall have had an
opportunity to be heard in favor or against the 2017 Preliminary Budget as compiled, or for or
against any item and items therein contained,that said hearing be then recessed and thereafter
convened at 7:00 PM on said day for the same purpose; and be it
FURTHER RESOLVED that the Preliminary Budget will be available for viewing on the
Southold Town official website: www.southoldtownny.gov, and be it

Town Clerk at the Southold Town Hall, 53095 Main Road, Southold,New York, where they are
available for inspection and where copies may be obtained by any interested person during
business hours.

A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED BY AND
SET FORTH IN GENERAL MUNICIPAL LAW § 3-C
Section 1. Purpose
The purpose of this Local Law is to allow the Town of Southold to override the limit on the
amount of real property taxes that may be levied by the Town of Southold, Suffolk County,New
York pursuant to General Municipal Law 3-c and to allow the Town of Southold to adopt a town
budget for town purposes and any other special or improvement districts governed by the town
board for the fiscal year 2017 that requires a real property tax levy in excess of the"tax levy
limit" as defined by General Municipal Law § 3-c.
The Town of Southold has made significant efforts to reduce spending in an effort to avoid
piercing the tax levy limit, however, in order to account for the increase in costs to provide town
services and fund town operations for 2017, while at the same time maintaining the Town's high
credit rating and general fund reserves, will likely require adoption of a budget in excess of the

SUPERVISOR RUSSELL: Let me just point out, that we have about $30,000 in Community
Block Grant. There was a time that this town received, I shouldn't speak but close to 10 times
that amount. Back in the days of Jim McMahon, it was a substantial amount. Certainly well
over$100,000 just a few years ago and that slowly but surely has been whittled away and that's a
shame.

local law? In the interests of clarity, this local law is necessary for the Town to adopt a budget
that would exceed the New York State tax cap. We need to essentially authorize ourselves
through a local law which is the subject of the hearing tonight

BENJA SCHWARTZ: Benja Schwartz, Cutchogue. How are you doing tonight? From what I
have heard, the need to exceed the budget increase permitted without this local law is essentially
necessitated by additional funding by the Highway Department is that a fair statement?
SUPERVISOR RUSSELL: Partially.
MR. SCHWARTZ: Partially? Maybe you could explain that to us a little better?

SUPERVISOR RUSSELL: Well, certainly we have increased allocations for asphalting, that's
one of the largest expenditures with the changes from last year's budget. We have now in the
current budget as if it was adopted, would provide $2.4 million to the Highway Department so
we can take on more aggressive road reconstruction program. There's another substantial
increase which was about $1.3 million in medical costs due to New York State, we are part of the
Empire program NYSHIP, and I believe our costs from 16-17 increased by $1.3 million.
COUNCILWOMAN DOHERTY: And what's the tax cap this year?
SUPERVISOR RUSSELL: I believe it's .73. I think Paul would probably know better than me.
I think it's .73.
MR. SCHWARTZ: So it's not all going to the highway, some of it's going to health insurance
basically?
JUSTICE EVANS: Basically the health insurance costs puts us over the cap.
SUPERVISOR RUSSELL: In order to not pierce the cap, we would set the Highway
Department needs to the side, we would need to offset about $1.3 million of new spending,
compulsory spending in the existing budget. For a budget that gets more or less raked over, year
after year after year, bonding $1.3 million is almost a possible task.
MR. SCHWARTZ: Well, I think that there are a lot of things that we could do and I hope to later
discuss specific ideas with you but as far as the highway asphalting goes,the history of roads and
highways in the Town of Southold started before there were cars and the roads were laid out and
the highways were set up and over the years they have been improved to the condition that we
have them in now. Essentially the philosophy....
COUNCILWOMAN DOHERTY: I don't mean to interrupt but can we stay on topic to the
public hearing?
MR. SCHWARTZ: This is directly relevant to the proposed spending on asphalting.
COUNCILWOMAN DOHERTY: Alright, but the public hearing is on going over the cap.
MR. SCHWARTZ: The budget cap, yes, exactly. And exactly why I am speaking on the
content of what we are spending the money for as part of this hearing.
COUNCILWOMAN DOHERTY: Okay.
MR. SCHWARTZ: Because I think that should be, we shouldn't be talking about money
without talking about what the money is being used for. And while I am not against paved roads,
in every case there is a movement called de-paving and I know we need to spend money
improving our roads but I think we might also put some of that money towards sidewalks for
example. I tried to find out where the sidewalks in Southold Town are and I don't believe we

even have a map of our sidewalks. It's kind of hard to improve something when you don't even
know what exists. In terms of the paved roads, there's a danger making the roads too smooth,
too fast, adds to the speed and then we end up putting stop signs where there never was one in 50
years and then we have to change our driving habits to stop for no reason except that we want
people to slow down, so I would ask that the town not consider funding any increase at least in
paving until we have a definitive, definite plan as to what will be paved and how it will and how
it will not contribute to increased danger on the roads and how it will not continue to contribute
to the environmental problems that were caused by the way the roads were designed in the Town
of Southold.

Linda Ruland, CAST
LINDA RULAND: My name is Linda Ruland and I live in Mattituck but tonight I am here
representing CAST, Community Action Southold Town which is located in Greenport. To
Supervisor Russell and members of the Town Board, thank you for the opportunity to attend this
meeting tonight and to share CAST's mission with you. CAST is a community based, not for
profit organization that was founded in 1965 to help low income residents meet their basic needs
in the areas of nutrition, employment, energy, health, housing and education. "It is the mission
of CAST to promote self-sufficiency and provide a safety net for Southold Town residents in
need." Having just celebrated our 50`h anniversary of `Neighbors helping Neighbors' last year,
we have come to realize that sadly, not much has changed over the last 50 years. There are still
hurting people unable to put food on their table, clothe themselves or learn English as a second
language or to gain adequate computer training to enable them to find meaningful employment.
For the past several years, the Town of Southold has given CAST money from the Community
Block Grant to help purchase food items for our neighbors in need. Since January 2016, 3,808
clients have walked through the doors of CAST asking for food for their families. That's 423
hungry people a month, right here in this beautiful Town of Southold. Along with that, CAST
has been able to help 737 families provide breakfast and lunch food items for children who
qualify for free or reduced meals at school during the school breaks. Your generosity toward
these families of poverty has helped to ease the strife they experience on a daily basis as they
struggle to provide for their families. We are asking you to consider CAST again, for monies
from the Community Block Grant in 2016. Thank you so very much for all you do for the Town
of Southold. Thank you for all you do for CAST, as well. Thank you.

SARAH BENJAMIN: Hi, my name is Sarah Benjamin, I am also from CAST and I live in
Greenport. I am adding an addendum for an additional program that we have at CAST, called
the North Fork Parent Child Home Program and I would like to take just a minute to tell you a
little bit about that that you might consider helping us for this program because the funding for
this program is raised in addition to the CAST budget. As Linda told you, the mission of CAST
providing a safety net for Southold Town residents in need and to promote self-sufficiency. We
believe that education leads to self-sufficiency and science has taught us that what happens early
in child's life, before they get to school, is a very crucial time for when their brain is developing
and what happens in these early years actually sets the stage for their ability to do well in school
and later in life. Education changes lives and what happens early in a child's life lasts forever.
That's why in 2013 CAST began the Parent Child Home Program which is a model that has been
in the nation for over 50 years and has extensive research on its outcomes. We started the

program in 2013 and we are going on our 4th year now. We have touched over 100 families so
far, low income families. The program is an early literacy parent support program, we go into
the homes from Laurel to Orient. The families are signed up, about 40 families a year and they
have the same home visitor. They can stay for two years. We give the parents new books and
toys and encourage them to teach their children because those early years are very important.
Language is important. The program has proven outcomes from the National Center Parent
Child Home Program that children who enter, have this program for two years enter school ready
to learn as their more advantage peers and they graduate high school at an 84.1 percent rate
which is higher than low-income families children. It really makes a difference in their lives. So
we are helping these young families so they can get ready, they are entering school speaking
English which is a big help for schools on the north fork. Linda and I have been in education on
the north fork for decades. Currently there are thousands of pre-school children on the north
fork. It's kind of an exploding population and many of them are affected by poverty. For
families of poverty on the north fork which last year had about 55 places. I don't know how
many they had this year. might be a little more. But that, and one pre-school class in Greenport.
All the other pre-schools are for tuition only or if they are lottery then you have the chance of the
draw with any person, whether you can get your child into that class. But most of all the
programs are for pay. But this program, North Fork Parent Child Program, is one of the only
things that is for families of poverty. We go to them, we find them hidden in farm fields, behind
businesses, down creeks in the backs of quiet streets. Families that are struggling and have
young children and we connect them to CAST, there are people that I have met that live on
Wiggins Street in Greenport that do not know that CAST is on Main Street. So it's good to be
able to go out into the community. As I said, we raise the money from other sources for this
program and we would appreciate anything that you might do as well for Parent Child Program.
I just want to add in a recent publication from Harvard University Center on the Developing
Child, entitled Supportive Relationships and Active Skill Building Strengthen the Foundations of
Resilience, they said decades of research on child development suggest that the programs that
facilitate positive and stable adult-child relationships, both in the home and the non-parental
settings in which young children spend significant amounts of time, are likely to reduce the
intergenerational transmission of economic dependence and social disadvantage. That's why we
are doing this. Thank you.

Maryann Gensler, Maureen's Haven Outreach
MARYANN GENSLER: Good evening, my name is Maryann Gensler and I live in Southold. I
am privileged to be the Director for Maureen's Haven Homeless Outreach. Thank you for the
opportunity to address you this evening to request funding in order to support our life-saving
work. Maureen's Haven provides safe, warm temporary shelter to homeless individuals from
November 1 through April 1 by utilizing over 23 houses of worship located throughout the twin
forks. Members of 17 congregations and community organizations offer additional support and
help comprise the over 1500 dedicated and selfless volunteers that provide an estimated 20,000
hours of community service to our guests. Maureen's Haven is responsible for screening and
transporting homeless guests to the host facilities each evening. In October 2011, we opened a
day center in order to provide services focused on building self-sufficiency and provide respite

during the day for those in need. All are welcome at the Day Center, clothing food and case
management services are available. We also partner with other agencies to provide mental
health and substance abuse treatment. Some of our host congregations even offer free medical
care. Last winter, we served 358 individuals over 113 nights. Our average number of guests per
evening was 49 with a high of 57. Overall, 5,463 beds were made for the season. Of that total,
82% were male and 18% female. At least half of our guests are temporarily or `first-time'
homeless. Generally, they are the working poor who have suffered setbacks like job loss, illness
and loss of transportation or divorce. The other 50% of our guests are chronically homeless.
They often face one or more serious issues, including mental illness, addiction and cognitive or
developmental disabilities (According to the Housing and Urban Development 2014 Point-in
Time report, 34% of the total homeless population is under 24, tragically, our most recent
statistics bear this out.) An alarming new trend for us has been an influx of young people. Since
January, on any given night 42% of our guests have been under the age of 25, of those, 50%have
been under the age of 21. These young people bring with them unique challenges and risks.
Many are runaways, or former foster children who have aged out of state services or they have
been victims of abuse or homophobia at home. Well known throughout the communities as a
safe haven, we are often the first point of entry for the newly homeless. We believe that our
reputation for compassion and inclusiveness is what has attracted so many young people to seek
solace and shelter from us. Through Maureen's Haven, our homeless guests can access
programs that meet their immediate needs, support them through transitional periods and lead
them back towards self-sufficiency and long term success. We assist homeless adults to acquire
supportive housing through Suffolk County's Single Point of Access. We help our guests with
securing entitlements and advocate for them tirelessly. While we continue this essential work,
we hope to meet the unique challenges that the influx of young people has presented us with.
We need to gather our resources in order to determine precisely how best to serve the young
people who have presented themselves before us. We feel a deep sense of urgency in front of
them, since we are well aware of the perils of the path that they are on. We hope to continue to
strengthen relationships, build trust, properly asses and adequately address the myriad of needs
of both our homeless youth population and our older guests. The impact of our work can best be
told through the stories of the people who come to us for assistance: Richard, age 34, grew up in
Mattituck. He suffered undiagnosed schizophrenia for almost 12 years. His parents divorced
when he was a teenager and his mother sent him to live with his abusive father when he was 17.
When he began to show symptoms of schizophrenia, his father abandoned him and he has been
homeless ever since. He heard about Maureen's Haven from a friend that he met on the street.
He worked with our staff and has been getting treatment for his illness at a nearby clinic. He has
come for food and respite for almost a year now and is warmly embraced by the Maureen's
Haven family. He is currently utilizing our emergency shelter but soon will be placed in
supportive housing. He is excited and happy to begin his new life and is full of hope for the
future. Sam is 20 years old and has high functioning autism. His parents divorced when he was
10. He was raised by his mother who moved out of the area when Sam attended college out of
state. As a result of his disorder, the stress and anxiety eventually became too much for him to
manage and he quickly dropped out. He lost his housing, his friends, and his self-worth. He
returned to eastern Long Island where his father, step-mother and younger siblings reside with
the hope of living with them. With no resources and no adequate supports for his disability, he
became depressed, anxious and disruptive. He dabbled in substance abuse and alcohol. Soon

after, he was told to leave because his family could no longer tolerate his behavior. He came to
Maureen's Haven seeking shelter, solace and support. After staying with us for a week, our case
worker was able to secure SNAP benefits for him and apply for SSI and Medicaid on his behalf.
After requesting his records from his former school district, she was able to get him an
appointment with ACCES/VR. Soon after, his demeanor and attitude had changed. We
arranged for a meeting with his stepmother, she agreed to allow him back into their home
because she witnessed him working towards something. He told us recently, `You guys
understand me and you are the only ones who took the time to really help me.' There are many
more people like Richard and Sam that we hope to help but we need the assistance of Southold
Town and others to support our life saving work. In an effort to provide services to the homeless
in Southold Town, we have partnered and collaborated with the faith community to provide
overnight shelter and other supportive services. Participating congregations include The First
Presbyterian Church of Southold, St. Patrick's RC Church, St. Peter's Lutheran Church in
Greenport, Sacred Heart Church in Cutchogue and Our Lady of Good Counsel in Mattituck. The
congregants of the Southold Universalist Church along with members of the Southold Rotary
participate by utilizing St. Peter's as an overnight host site while providing meals and
companionship to our guests. We are very appreciative of the past support we have received
from the Town of Southold and respectfully request funding once again in support of our
program. We ask the Town Board to consider an allocation of $5,000 to assist in the cost of
screening and transporting our guests to the host facilities throughout the season, ongoing
operations of our day center and to offset the salaries of the program staff. Thank you for your
consideration of this request.

BENJA SCHWARTZ: I just have a question on the notice for this hearing, on the Southold town
website. It says that Southold Town expects to receive $30,000 from the federal government in
2017, it says eligible activities la da da da da da da, last one, public services,there's not that says
total allotment limited to 15%. What is the category public services refer to in this case?
SUPERVISOR RUSSELL: I will defer to Denis Noncarrow.
DENIS NONCARROW: Basically the 15% is CAST and Maureen's Haven as such. But due to
the fact that they have lowered our amount that we get each year, they said that they are going to
take into consideration adjusting that. But HUD's amount was always 15%. So the rest of it for
things such as fixing up the walkway and handicap access. That type of thing.
SUPERVISOR RUSSELL: Capital improvements and residential....
MR.NONCARROW: Residential repairs, such as North Fork Housing Alliance.
MR. SCHWARTZ: Okay, because I didn't want to say anything to take away from this...

for other purposes in addition to these...

MR. SCHWARTZ: Well, I am glad the Southold Town Hall is getting some kind of sidewalk
with the access for handicap but if there are any funds left over, maybe you will consider at least
identifying locations where sidewalks are in town. Things like that benefit everybody. Whether
you are wealthy or not, especially if you are not. It's very safe and convenient to have
sidewalks.

BENJAMIN SCHWARTZ: Good evening. Benjamin Schwartz, Cutchogue. A couple of
things, one the notice in tonight's, well,just as a preliminary kind of matter, the functioning of
these Town Board meetings tonight. Not a lot of people here tonight, I didn't have any trouble
finding a seat although I was a little bit late. I apologize for that.
SUPERVISOR RUSSELL: Well, they are thinning out now, for sure.
MR. SCWHARTZ: Well, one, thank you. One thing that struck me on the way here was the
title's we give to the work sessions and the regular meetings. A lot of people don't know what
the difference is. I don't see any real attempt to explain it to people. I don't like the names,
maybe because I am not a regular kind of guy. But I appreciate, Supervisor Russell, I thank you
for inviting me here tonight. My suggestion on that would be to change what is called the work
session to, because the name work sessions implies that you are working at those meetings and I
know you all use your brains and do a lot of thinking and work on issues there but as a Town
Board, your work is legally done through resolutions and you are not legally allowed to actually
do anything at the work session. So if you can't do any work at a work session, why call it a
work session? It's a custom. It's been that way long before you, before me. But with all due
respect, why not call them preliminary meetings and call these meetings work sessions? Just a

thought. I wish I had had more time this morning to attend the preliminary meeting. The content
of these meetings isn't all work and I think one of it, there's been some good information. We've
heard about different things going on here today. I would like to mention and maybe you could
also incorporate as a part of this meeting, a regular announcement of events that are scheduled to
occur, town events that are important that are scheduled to occur in the next two weeks, before
the next meeting. Anybody guess what I am thinking of?
SUPERVISOR RUSSELL: That's a good idea.
MR. SCHWARTZ: Thursday night. Do you want to talk about it?
SUPERVISOR RUSSELL: Thursday night is the ecological study of Plum Island.
MR. SCHWARTZ: That's right. the first ever four season year-long biological what's on Plum
Island that was studied for over a year or a couple of years and Supervisor Russell and some
biologists are going to present it at Peconic Landing Community Center this Thursday at 7:30. I
hope I will get to attend that. one of the other information items that we got today was the fall
leaf cleanup and while the resolution was proposed by the Highway Department, I believe it's a
joint project whatever, activity conducted by Highway and Solid Waste Department and on the
website, I think it's the Solid Waste Department actually, not the Highway, there's almost
nothing on the Highway Department's website, that's another area we need to work on but this
notice that it's starting on November 21St is not yet on the website at all on anyone's department.
By putting it on the website, we have a place to refer to. Not only that we find out when it starts
but there could be periodic updates posted as it progresses, etc. It would make, I think, an
important contribution. There is a notice about the program on the website. It does not currently
include the date but the notice is a little more elaborate than the notice that was in the resolution
tonight. A little more specific. In addition to saying you have to use paper bags, it says you
can't use plastic. They will be left behind. The leaf pickup only in the fall, the leaves and
branches are in the spring, according to the website. On the subject of the website, I would like
to give a heads up to the police department. Southold Town Police Department has been
improving their website considerably. They have several sections, new sections, on there,
including a history of the police department which also has interesting information on the
Southold Town seal, etc. And also there's a page that they have put up on what areas are closed
an open for shellfishing in the Town of Southold and I want to commend them for putting
information out there instead of just going around and making people dump their clams out or
stopping them from clamming, by letting us know. I think that's the way government should
work, at least let us know what we are supposed to or not supposed to do. But you know, I have
been called loyal opposition, everything is not perfect and one of the problems with the police in
general is this Town Board is also a police commission and with all due respect is not doing its
job in that capacity. The police advisory committee is a very good example. The police
advisory committee is set up to advise the Town Board on police matters and I am not sure, are
people permitted to attend the police advisory meetings or are those closed to the public?
SUPERVISOR RUSSELL: No, not only are they permitted, those are noticed meetings.

MR. SCHWARTZ: So they are open to the public?
SUPERVISOR RUSSELL: Yes.
MR. SCHWARTZ: Okay, because the implication on the web page for the committee is that it's
not open to the public. Because it says the committee is advisory only to the Town Board and
does not accept or review citizen's complaints, all questions and inquiries should be directed to
the Town Board. So I guess we can go there but I don't know if we can contribute. Anyway, the
summary of the, on the police advisory committee website, the summary of the purpose and the
charge of the police committee is not bad. But it refers to resolutions that were passed by Town
Boards prior to you all sitting there, the first one in 98 and second one in 2003. With all due
respect, they need to be updated. We have discussed this before, I know there was a little
progress being made in updating all of the committees tasks but instead of referring in the
webpage, they have kind of a'summary or interpretation of what their purpose is which is not bad
but I don't know if it came from the Town Board or where it came from, the laserfiche folder of
the Police Advisory Committee has copies of the original resolutions which are useful but they
are also useful in showing us we need to do or you need to do some updating. The last meeting
of the Police Advisory Committee and they do post their minutes online, the new business
included law enforcement accreditation, appointment of a study team. And I was here this
morning....
SUPERVISOR RUSSELL: Let me just interrupt and say that's a direct result of your input. The
accreditation, that's an issue you have raised for some time and Jim wanted to make sure this
Town Board and the Police Advisory Committee were aware of it looked at it and gave it very
careful consideration.
MR. SCHWARTZ: I appreciate that. Thank you for that. I wish that I had been, was there, so
the Police Advisory Committee apparently according to the minutes or was it the agenda for
tonight's meeting, it says that the police advisory committee recommendation, police department
accreditation by law enforcement agency accreditation counsel. Did that, was their
recommendation in writing? Was there a document that we can access?
COUNCILMAN DINIZIO: No. we are going to start to work on that.
MR. SCHWARTZ: But the committee did not produce a statement in writing...
COUNCILMAN DINIZIO: No, when I received your email, Benja, I right away got it to that
committee because they seemed like the most logical place for us to explore how to get that done
under the budget constraints that we have, under time constraints, so my feeling was that we
were going to, that committee, we just advertised for a few more people because we lost some, to
dissect how we were going to go about becoming accredited. It's been started a few times and
stopped, it's a very expensive process to get through and so we are trying to, I think that the
committee can sort of hold the lead. They can't do a lot of work but I think we should investigate
it a little more, spend some time on it, see how we far we get with it before we have to perhaps
hire a police officer to actually do the work which is what they recommend.

MR. SCHWARTZ: Well, there was some real, some things that I strongly disagree with in the
presentation given this morning by members of the committee and the police chief, sorry I
couldn't be here for the whole thing but I had some other things to do but I think what I am
going to try to do is to meet with the police chief and discuss it with him. Maybe you would like
to join me or something like that. Don't feel like this is the appropriate forum....
COUNCILMAN DINIZIO: I would like to learn a little more about it before I try to tighten
these things up.
MR. SCHWARTZ: Well, besides having some involvement when I was a practicing attorney
before I retired, I was working with police, representing police. Online there's a lot of
information, on the New York State....
COUNCILMAN DINIZIO: John pointed that out yesterday. All the paperwork that I got, I will
give you a copy of that, he has a lot of websites that he has been through but again, it's a
committee that meets once a month and I think we still need to delve into it more. We are
realizing it's something that we should strive for, we just need to figure out how to do it.
MR. SCHWARTZ: What I heard this morning, what I heard was the police chief said he didn't
want to do it.
COUNCILMAN DINIZIO: It wasn't a question that he didn't want to do it, it's a question as to,
it's an onerous task that you can't just give to you know, an officer that's coming off the street.
You need somebody that's motivated....
MR. SCHWARTZ: Well, listen, I can disagree with, I disagree with you all the time. I disagree
with the police chief, I disagree with the New York State Department of, Division of Criminal
Justice Services. And I agree with some of the comments that you were making this morning
about possibly involving the committee in the process, that's not specifically foreseen by the
program as it exists, as it is handed down and administered by New York State. However, it's
not prohibited. Very briefly, I would just like to outline, the way the process works according to
the website and according to my, number one, there is an application. The application has to be,
okay, I think this one paragraph is really worth reading. Two, because I don't want to be
misinterpreted. `The chief law enforcement officer in an agency plays a critical role in the
accreditation process. The support and commitment shown by the highest ranking member of
the department will set the tone for h ow other members feel about the program. The chief law
enforcement officer must be firmly committed to accreditation in order for the agency to
succeed. If the chief law enforcement officer is only marginally interested in the program or is
pursuing accreditation at the insistence of others, such as municipal leaders, it will be difficult to
ask others in the department to make the commitment.' So I am not trying to push anybody to do
anything they don't want, I am just trying to convince you that this is something that will benefit
us all and that we can work together on. Basically the way the process works is that the chief
law enforcement officer and a member of the governing body, not necessarily the Supervisor,
sign an agreement to apply for accreditation. At that point, it appears to me that the chief law
enforcement officer then chooses a program manager from the local department and the program

manager takes it from there under the supervision of the chief and probably the governing body.
In this case, I think you could probably delegate that to the police advisory committee if you
wished. But in addition to the way that this is set up, that the police that are doing it all, in our
Police Advisory Committee we talked about having civilian members in there and as I said this
morning, I think it would appropriate, especially in a project like this, to have a member with
some legal background not necessarily law enforcement but law including legislation and
municipal government. Alright, I will be in touch, I appreciate your time tonight and considering
