97449,as Co-Trus tees the Henry and Lynne Fisher Revocable Trust,

WITNESSETH, that the party of the first part, in consideration of TWO HUNDRED
FIFTY THOUSAND ($250,000.00) AND NO/100 DOLLARS and other valuable
considerationpaid by the party of the second part, does hereby grant and release unto
the party of the second part, the heirs or successors and assigns of the party of the
second part forever,
ALL that certain plot, piece or parcel of land, with the buildings and improvements
thereon erected,situate,lying and being in the Town of Southold,County of Suffolk,and
State of New York,being more particularly bounded and described as follows:

BEING AND INTENDED TO BE the same premises conveyed to Henry Fisher and
Lynne Fisher, Trustees of the Henry and Lynne Fisher Revocable Trust, by deed dated
October 4, 2004 from Henry H. Fisher and Lynne G. Fisher, individually, which deed
was recorded in the Suffolk County Clerk's Office in Liber 12357 cp 46 on November 26,
2004.
TOGETHER with all right, title and interest,if any,of the party of the first part in and to
any streets and roads abutting the above described premises to the center lines thereof;
TOGETHER with the appurtenances and all the estate and rights of the party of the first
part in and to said premises; TO HAVE AND TO HOLD the premises herein granted
unto the party of the second part, the heirs or successors and assigns of the party of the
second part forever.
AND the party of the first part covenants that the party of the first part has not done or
suffered anything whereby the said premises have been encumbered in any whatever,
except as aforesaid.
AND the party of the first part,in compliance with Section 13 of the Lien Law,covenants
that the party of the first part will receive the consideration for this conveyance and will
hold the right to receive such consideration as a trust fund to be applied first for the
purpose of paying the cost of the improvement and will apply the same first to the
payment of the cost of the improvement before using any part of the total of the same for
any other purpose.
The word "party" shall be construed as if it read "parties" whenever the sense of this
indenture so requires.

ALL that certain plot, piece or parcel of land, situate, lying and being in the Town of Southold, at Fishers Island, County
of Suffolk and State of New York, being bounded and described as follows:
BEGINNING at a lead plug on the southwesterly side of Montauk Highway, whose coordinates are 2075.98 feet North
and 985.70 West as measured by the U.S. Coast and Geodetic Survey Triangulation Station "Pros", said point also being
the easterly corner of land now or formerly of Pequot Land and Property LLC:
RUNNING THENCE South 28 degrees 07 minutes 30 seconds East along the southwesterly side of Montauk Avenue,
65.36 feet to lands now or formerly of Austin McPhail;
THENCE along said lands, the following two courses and distances:
1) South 56 degrees 57 minutes 30 seconds West, 29,60 feet;
2) South 12 degrees 24 minutes 20 seconds West, 62.28 feet to the northeasterly side of a right of way;
THENCE the following 2 courses and distances along the right of way:
1) North 54 degrees 59 minutes 30 seconds West, 50.14 feet to a point;
2) North 54 degrees 30 minutes 23 seconds West, 35.20 feet to lands now or formerly of Pequot Land and Property
LLC;
THENCE North 42 degrees 03 minutes 30 seconds East along said land, 115.00 feet to the southwesterly side of Montauk
Avenue, the point or place of BEGINNING.
THE POLICY TO BE ISSUED under this commitment will insure the title to such buildings and improvements on the premises which
by law constitute real property.
FOR CONVEYANCING ONLY.- Together with all the right, title and interest of the party of the first part, of in and to the land lying
in the street in front of and adjoining said premises.
